HomeMy WebLinkAboutOrdinance 9230`~ ,. ;~..~ c ~_ .. .r,! ~\. i n ~ 8`9 ORDINANCE NO. ~°~~~~ . : - ~~d3~ AN ORDINANCE AMENDING CHAPTER 19, "HEALTH AND SANITATION," OF THE CODE OF THE CITY OF FORT WORTH (1964), AS AMENDED, BY INCREASING SOME PUBLIC HEALTH SERVICE FEES .AT THE IMMUNIZATION CLINIC; CHANGING THE PLAN REVIEW aFEES; PRO- VIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL; PRO- VISIONS OF ORDINANCES AND OF SUCH CODE AFFECTING HEALTH AND SANITATION; PROVIDING A SAVINGS CLAUSE, PROVIDING A SEVERABILITY CLAUSE; AUTHORIZING PUBLICATION IN PAMPHLET FORM; DIRECTING PUBLICATION OF THE CAPTION AND PENALTY CLAUSE; DIRECTING THE ENGROSSMENT AND ENROLLMENT OF THE CAPTION AND PENALTY CLAUSE AND THE FILING OF THIS ORDI- NANCE; PROVIDING A PENAL CLAUSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 19-421.1 of Chapter 19 of the Code of the City of Fort Worth (1964), as amended, is hereby further amended to read as f o 11 ow~s "Sec. 19-421.1. Plan review fee. 1) Food Service Establishments a) 0-150 sq. ft. $ 35.00 b) 151-8,000 sq. ft. $200.00 c) 8001 - 20,000 sq. ft. $250.00 d) 20,001 sq. ft. and larger $325.00 2) Public Swimming Pools, Public Spas, $ 65.00 Public Water Slides . - ,, 3) Mobile Food Unit $ 65.00 (excluding snowcone vendors, ice cream truck vendors, and fruit and vegetable vendors)" SECTION 2. That Section 19-440.1 of Chapter 19 of the Code of the City of Fort Worth, Texas (1964), as amended, be, and the same is hereby further amended by changing the fee schedule in Subsection (c) thereof to read as follows: "(c) Immunization Clinic (1) Yellow fever immunization .............. $ 15.00 (2) Clinic fee ... ......................... $ 2.00 (3) Copy of immunization record............ $ 2.00 (4) Immunoblobulin fee ..................... $ 2.00 (5) Hepatitis B vaccine fee ................ $105.00" ,r ~ •A ~ ~ ~ a a ~~ SECTION 3. This ordinance shall be cumulative of all provisions of ordi- nances and of the Code of the City of Fort Worth, Texas (1964) , as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than One Thousand Dollars ($1,000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 6. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Chapter 19 or any other ordinances affecting public health which have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. .~ ~,; ~~ r.9 SECTION 7. The City Secretary of the City of Fort Worth, Texas, is hereby authorized to publish this ordinance in pamphlet form for general distribution among the public, and the operative provisions of this ordinance as so published shall be admissible in evidence in all courts without further proof than the production thereof, as pro- vided in Chapter XXV, Section 3, of the Charter of the City of Fort Worth, Texas. SECTION 8. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption and penalty clause in the minutes of the City Council and by filing the ordinance in the ordinance records of the City. SECTION 9. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption and penalty clause of this ordinance for two (2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Art. 1176b-1, Revised Civil Statutes of Texas. SECTION 10. This ordinance shall be in full force and effect from and after its passage and publication as required by law, and it is so ordained.. This increase in revenue was reflected in the ~t~,Fl 984'85 adopted budget by increasing the estimate for: (1) licensee and permits by $74,340, (2) revenue from other governmental authorities by $25,298, and ~~~+a(3) charges for current services by $200,362. ,i. ,As a basis for these fee adjustments, City staff referred to the recently- completed update of the City-wide user fee analysis that was conducted by s,r~rg~id M. Griffith and Associates, Ltd. The consultant recommended adjusting fees so that the cost/recovery rates that were established in 1963-84 could be "~ maintained. All affected departments were consulted for guidance and assistance ee Rc#,~c,daveloping these proposed fee adjustments. Some fee adjustments recommended by departments resulted in cost/recovery rates that are lower than those estab- lished in 1983-84. The ,City Council was assured that Council approval for these fee adjustments. would be secured on an individual fee basis.
