ORDINANCE NO. 03 / __
AN ORDINANCE APPROVING AND ADOPTING ESTIMATES OF THE COST OF IMPROVE-
MENTS AND OF AMOUNTS TO BE ASSESSED FOR IMPROVEMENTS ON A PORTION OF
VILLAGE CREEK ROAD
AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUBLIC PLACES IN THE
CITY OF FORT WORTH, TEXAS; FIXING TIME AND PLACE FOR HEARING TO THE
OWNERS OF ABUTTING PROPERTY AND TO ALL OTHERS INTERESTED; DIRECTING
THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND DIRECTING THE
CITY SECRETARY TO ENGROSS AND ENROLL THIS ORDINANCE BY COPYING THE
CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL AND BY FILING
THE COMPLETE ORDINANCE IN THE APPROPRIATE ORDINANCE RECORDS OF THE
CITY, AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Fort Worth, Texas, has heretofore ordered that each of the
hereinafter described portions of streets, avenues and public places in the City of Fort Worth, Texas, be im-
proved by raising, grading and filling same and by constructing thereon the following, to-wit
VILLAGE CREEK ROAD From Richardson to Ramey, known and desig-
nated as Project No. 013-022-152-00, a seven-
inch thick reinforced concrete pavement with
seven-inch high superimposed concrete curb
on a six-inch thick lime stabilized subgrade,
so that the finished roadway will be thirty-six
feet wide. Six-inch thick concrete driveway
approaches and turn lanes will be constructed
where specified. Four foot wide concrete
sidewalk will be constructed adjacent to all
developed property.

together with concrete curbs, gutters, driveways and incidentals to such improvements
on proper grade and line where same are not already so constructed, together with storm
sewers and drains and other necessary incidentals and appurtenances, all of said im-
provements to be constructed as and where shown on the Plans and in strict accordance
with the Plans and Specifications therefor; contract therefore has been made aid
entered into with J. L. Bertram Construction and Engineering,_Inc. ;
and
WHEREAS, the City Council of the City of Fort Worth, Texas, has caused the Public
Works Director to prepare and file estimates of the cost of such improvements and
estimates of the amount per front foot proposed to be assessed against abutting property
and the owners thereof, and such estimates have been examined, NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT•

Such estimates be, and they are hereby adopted and approved.
II.
It is hereby found and determined that the cost of improvements on each portion of
streets, avenues, and public places hereinafter described, with the amount or amounts
per front foot proposed to be assessed for such improvements against abutting pro-
perty and the owners thereof, are as follows, to-wit:
VILLAGE CREEK ROAD From Richardson to Ramey, known and designated
as Project No. 013-022-152-00.
The estimated cost of improvements is $ 1,127,902.60 the estimated amount
per front foot to be assessed against abutting property and the owners thereof for
concrete curb ~~~ is $ 2.05 the estimated amount per front foot to
be assessed against abutting property and the owners thereof for pavement is $ 47.53 ;
the estimated amount per front foot to be assessed against abutting property and the
owners thereof for four-feet wide concrete sidewalk is $ -0- the estimated
amount per square foot to be assessed against abutting property and the owners thereof for
six-inch thick concrete driveway is $ 2.92 per square foot, the total
estimated amount per front foot to be assessed against abutting property and the owners
thereof is $ 49.58 , plus the cost incurred for concrete driveway construction
where specified

A hearing be given and held by and before the City Council of the City
of Fort Worth, Texas, to all owning or claiming any property abutting upon said
portions of highways, streets, avenues and public places, as well as to all
owning or claiming any interest in any such property. Such hearing shall be
given and held on the 6th day of arc 19 84 at 7:30 P.M.,
in the Council Chamber in the City Halpin the City of Fort Worth, Texas, and
the Cfty Secretary is hereby directed to give or cause to be given notice of the
time and place of such hearing and of other matters and facts in accordance with
the terms and provisions of an Act passed at the First Called Session of the
Fortieth Legislature of the State of Texas, and known as Chapter 106 of the Acts
of said Session, now being known as Article 1105b of Vernon's Texas Civil Statutes
as amended by Acts 1967, 60th Legislature, Page 365, Chapter 176, Section 1,
emergency effective May 12, 1967 Such notice shall be by advertisement inserted
at least three (3) times in a newspaper published in the City of Fort Worth,
Texas, the first publication to be made at least twenty-one (21) days before
the date of said hearing. Said notice shall comply with and be in accordance with
the terms and provisions of said Act as amended The City Secretary is further
directed to give or cause to be given personal notice of the time and place of
such hearing to all owning or claiming any property abutting on' said portions of
highways, streets, avenues and public places, as well as to all owning or claiming
any interest in any such property. Such personal notice shall be in writing and
shall be given or caused to be given by the City Secretary by depositing such
written notice in the United. States Mail at least fourteen (14) days before the
date of the hearing, postage prepaid, ict envelopes addressed to all persons
owa~ng or claiming any interest in the respective properties abutting the high-
ways, streets, avenues and public places or portions thereof to be improved, as
the names bf such persons are shown on the current rendered tax rolls of the City
of Fort Worth and at the addresses so shown, or if the name of such respective
owners do not appear on such rendered tax rolls, then address to such owners as
their names are shown on the current unrendered tax rolls of the City of Fort Worth
at the addresses shown thereon. In those cases in which an owner of property
abutting a highway, street, avenue or public place or portion or portions there-
of which is to be inproved is listed as "unknown11 on the then current City of
Fort Worth tax rolls, or the name of an owner is shown on the City of Fort Worth
tax rolls but no address for such owner is shown, no notice need be mailed. In
those cases where the owner is shown to be an estate, the mailed notice may be
addressed to such estate. In this connection, the City Secretary shall prepare
and file or cause to be prepared and filed with these proceedings a list of the
properties to be assessed, the names of those persons owning or claiming any
interest in said properties to whom the notice was mailed, together with the last
known addresses determined as aforesaid of the respective owners and those per3
sons owning or claiming any interest in said property
The City Secretary shall certify that each of the parties in said list whose
address is shown on the then current rendered or. unrendered tax rolls of the City
of Fort Worth was mailed a copy of the notice of hearing and shall further certify
the date or dates on which said notice was mailed A copy of each notice shall be
attached to such certificate. The cert.ificat:e of the City Secretary will be con-
clusive evidence of the facts therein recited,

IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council and by
filing the complete ordinance in the appropriate Ordinance Records of this City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage

Origin and History of Project
The 1976-78 Capital Improvement Program (CIP) provided for the improvement of
Village Creek Road, from Berry Street to Ramey Avenue. The 1977 allocation for
this project was $670,000 in bond funds.
On August 30, 1977 (M&C C-3890), a contract was awarded to J. L. Bertram Company
based on a low bid of $997,080.47 for improvements to Village Creek Road
(Richardson to Ramey) consisting of a 60 ft. wide pavement of seven inch
concrete, with curbs, driveway approaches, and sidewalks as well as storm
drainage facilities. In addition, some $95,000 in water mains were to be
constructed. On October 11, 1977 (M&C C-3593), the Council held a benefit
hearing on this project and ordered it canceled. Primary objections were to the
amount of the proposed assessments and to the width of the pavement.
Village Creek Road is a narrow county type roadway from Berry Street to Ramey.
The Master Thoroughfare Plan adopted by the Plan Commission on March 15, 1978,
now shows Village Creek Road proposed to be a two-lane undivided collector.
On February 26, 1980 (M&C G-4453), the City Council approved the 1980-81 Capital
Improvement Program for Street and Storm Drainage Improvements. On May 20, 1980
(M&C C-4548), the City Council approved allotment of funds to specific projects
and authorized funds for engineering design for the completion of previously
authorized projects, including improvement of Village. Creek Road from Richardson
to Ramey.
On August 18, 1980 (M&C C-5221), the Council approved a design contract with the
firm of Freese-Nichols for the redesign of Village Creek Road as a two-lane
undivided collector with left turn lanes at major intersections. The Water
Department also contracted for the design of water and sewer lines in Village
Creek Road.
Improvements
Village Creek Road will be improved with 7-inch concrete pavement with concrete
curb and driveway approaches. Four foot wide concrete sidewalks are included on
both sides of the street with the exception of a section along the west side of
the street just south of Fitzhugh Avenue to East Berry Street adjacent to an
undeveloped tract of land. Drainage improvements include a concrete bridge and

Water improvements in this contract include 2,447 linear feet of pretensioned
concrete cylinder and ductile iron pipe, complete with required appurtenances.
Receipt of Bids
The project was advertised for bids on December 8 and 15, 1983, and the
following bids were received on January 1L, 1984, with 150 working days allotted
to complete the project.

Project Cost and Financing
Based on standard' Policy in effect at the time this project was approved by the
City Council, cost to the property owners (assessments) is approximately
$189,876.05,. which will be provided for by a bond fund transfer from the
"Revolving Fund Unspecified'" account.
Cost to the City for street and storm drain. improvements is approximately
$835,489.95 of which. $391,LU7.59' is for street construction. and $444,,382.36 for
storm drain. facilities, to include the bridge over Wildcat Branch,. plus
$102,53b.60 (10%) engineering. Sufficient funds are available in the project
account for the City's total construction cost. A bond fund. transfer is required
from the "Engineering Unspecified" account for the City's engineering cost.
Cost to the City for Water Main improvements on this project is $157,536.90,.
plus inspection.. engineering in the amount of $7,463.10'. It is proposed to
finance the water portion cost by a fund transfer from 60-90-2.0, "Water
Capital Projects" Account (I.C. 380899).
