ORDINANCE NO. ~~J /
AN ORDINANCE AMENDING CHAPTER 18, "GASOLINE SERVICE
STATIONS", OF THE CODE OF THE CITY OF FORT WORTH, TEXAS,
BY AMENDING SECTION 18-3 THEREOF, TO CHANGE CERTAIN FEES
FOR USE OF PUBLIC STREETS AND SIDEWALKS; PROVIDING FOR
REPEAL OF ORDINANCES AND CODE SECTIONS IN CONFLICT
HEREWITH AND THAT THIS ORDINANCE SHALL BE CUMULATIVE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY
CLAUSE AND A SAVING CLAUSE; PROVIDING FOR PUBLICATION;
PROVIDING FOR ENGROSSMENT AND ENROLLMENT; PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Chapter 18 of the Code of the City of Fort Worth, Texas
(1964), as amended, is hereby further amended by changing Section
18-3 thereof to read and be as follows:
"Sec. 18-3. Annual charge for use of streets.
An annual charge on a per pump basis of ten dollars
($10.00) for the first gasoline pump, six dollars ($6.00)
for the second gasoline pump, and four dollars ($4.00) for
each additional gasoline pump used, maintained or situated
on the premises is hereby made against each gasoline
filling station installed, operating and making use of any
street or sidewalk or any portion thereof within the city,
or using any portion of any street or sidewalk for the
purpose of ingress or egress of automobiles in connection
with such gasoline filling station. The charge herein
provided for shall be payable in advance at the office of
the city assessor-collector of taxes by any person desir-
ing to establish and use a gasoline filling station on any
street or sidewalk, or part thereof, where any part of any
sidewalk is used for the purpose of ingress or egress of
automobiles in connection with such gasoline filling
station."
SECTION 2.
This ordinance shall be cumulative of all provisions of ordi-
nances and of the Code of the City of Fort Worth, Texas (1964), as
amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in
which event conflicting provisions of such ordinances and such Code
are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,

paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4.
Any person, firm or corporation who violates, disobeys, omits,
neglects or refuses to comply with or who resists the enforcement of
any of the provisions of this ordinance shall be fined not more than
Two Hundred Dollars ($200.00) for each offense. Each day that a
violation is permitted to exist shall constitute a separate offense.
SECTION 5.
All rights and remedies of the City of Fort Worth, Texas, are
expressly saved as to any and all violations of the provisions of
Chapter 18~ or any other ordinances affecting gasoline service
stations which have accrued at the time of the effective date of
this ordinance; and, as to such accrued violations and all pending
litigation, both civil and criminal, whether pending in court or
not, under such ordinances, same shall not be affected by this
ordinance but may be prosecuted until final disposition by the
courts.
SECTION 6.
The City Secretary of the City of Fort Worth, Texas, is hereby
directed to publish the caption, and penalty clause and effective
date of this ordinance for two (2) days in the official newspaper of
the City of Fort Worth, Texas, as authorized by Art. 1176b-1,
Revised Civil Statutes of Texas.
SECTION 7.
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption and

penalty clause in the minutes of the City Council and by filing the
ordinance in the ordinance records of the City.
SECTION 8.
This ordinance shall be in full force and effect from and
after its passage and publication as required by law, and it is so
ordained.

During the budget study sessions with the City Council, City staff was direeted

~",.~ t`;~~hNi+. r R~~ be generated in 1984-85. This increase in revenue was reflected in the
~984~-85 adopted budget by increasing the estimate for: (1) licenses and permits
apt by $74,340, (2) revenue -from -other governmental authorities by $25.,298, and
+~~~ .~F~drnEts .z(3) charges for current services by $200,362.
f N~ + ~,~.a+.r:+,i. ,As a basis for these fee adjustments, City staff referred to the recently-
completed update of the City-wide user fee analysis that was conducted by
,~« nr?nt+"+sT ~'l9f~id M. Griffith and Associates, Ltd. The consultant recommended adjusting
fees so that the cost/recovery rates that were established in 19$3-84 could be
~"'~~LPF~"'~"~ maintained. All affected departments were consulted for guidance and assistance

by departments resulted in cost/recovery rates that are lower than those estab-
lished in 1983-84.
The ,City Council was assured that Council approval for these fee adjustments
~+ould be secured on an individual fee basis.
