ORDINANCE NO.

AN ORDINANCE VACATING, ABANDONING AND CLOSING THE 1400 AND
1500 BLOCKS OF WINDMILL STREET AS A PUBLIC STREET RIGHT-
OF-WAY; PROVIDING FOR REVERSION OF FEE IN SAID LAND; RE-
PEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the 1400 and 1500 blocks of Windmill Street, being more
particularly described in Exhibit "A", attached hereto and incorpo-
rated herein, be and the same are vacated, abandoned and permanent-
ly closed and extinguished as a public street right-of-way.
SECTION 2.
That the fee to the land in the above described vacated public
street right-of-way is hereby released and shall revert to the adja-
cent owner as provided by law, SAVE AND EXCEPT that easements are
retained for any and all existing and prospective utilities.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

Part of the F. G. Mulliken Survey, Abstract No. 1045 situated in the City of Fort Worth,
in Tarrant County, Texas, and embracing a portion of 13-536/1000 acres tract described
in the deed to Ashland Oil, Inc. recorded in volume 7538 page 357 of the Tarrant County
Deed Records, and being a portion of Windmill Street as it appears upon the map
.recorded in volume 388-Q page 525 of the said Deed Records.
Commencing at a 7/8" iron for the southeast corner of said 13-536/1000 acres tract, and
then run, north 3 degrees-41 minutes-15 seconds west, along the east line of said 13-
536/1000 acres tract for the west line of Cold Springs Road, 375 feet to a 7/8" iron for
the southeast and beginning corner of the tract being described.
Thence south 89 degrees-48 minutes-45 seconds west, along the south line of said
Windmill St., 728-56/100 feet to the west line of said 13-536/1000 acres tract and
southeast corner of the former portion of Windmill Street closed by Ordinance No. 4629
which is recorded in volume 3701 page 431 of the said Deed Records and also described
in the Quit Claim Deed to C. R. I. & P. R. R. Co. recorded in volume 3684 page 193
of the said Deed Records.
Thence north 30 degrees west, along the west line of said 13-536/1000 acres tract and
the. east line of said former portion of Windmill Street, 57-62/100 feet to the northeast
corner of said former portion of Windmill Street closed by Ordinance No. 4629.
Thence north 89 degrees-48 minutes-45 seconds east, along the north line of said
Windmill Street, 754-15/100 feet to a 7/8" iron in the east line of said 13-536/1000 acres
and said west line of Cold Springs Road.
Thence south 3 degrees-41 minutes-15 seconds east, along the said east line of 13-
536/1000 acres tract, for the said west line of Cold Springs Road,for the east terminus
of said Windmill Street, 50-09/100 feet to the place of beginning and containing 0-
850/1000 of an acre.

Ashland Oil, Inc., owner of all abutting property, has requested that the
r.a City vacate the 1400 and 1500 blocks of Windmill Street a width of 50',
extending from Cold Springs Road westward a distance of 730' to the east
property line of the C.R.I. & G.N. R.R., as shown on the attached map.
~ISTk~'lerosubject street right-of-way, acquired by dedication, is open on the
ground, partially improved, and contains water, sewer, gas, telephone,
>TRAa~tdLelectric utility facilities. The subject vacation request is in-
tended to permit the replatting of the vacated right-of-way with adjacent
property in order to expand the building area and provide more yard space.
The applicant, with regard to necessary and appropriate monetary considera-
tion, has satisfactorily responded to the requirements outlined by the
Real Property Department of the City of Fort Worth.
Other reviewing City departments and private utility companies have raised
no objections to this request provided the vacated right-of-way is replatted
with adjacent property and retained as a utility easement for any remaining
existing utility facilities. A satisfactory replat, dedicating the appropri-
ate utility easements, has been submitted.
The City Plan Commission has reviewed this request and recommends that the
subject street be vacated as requested.
Recommendation
It is recommended that an Ordinance be adopted vacating the 1400 & 1500
blocks of Windmill Street a width of 50', extending westward from Cold Springs
Road a distance of 730' to the east property line of the C.R.I. & G.N. R.R.,
as recommended by the City Plan Commission.
