JACKSON SURVEY, ABSTRACT NO. 862, CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; AS RECORDED IN REAL PROPERTY RECORDS OF TARRANT COUNTY, TEXAS AND CONTAINING RESPECTIVELY APPROXIMATELY 12,757 SQUARE FEET OR 0.293 ACRES AND 2,507 SQUARE FEET OR 0.058 ACRES OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of I.M. Terrell Circle South, a fifty foot wide right of way, situated in the Moses A. Jackson Survey, Abstract No. 862, according to the plat of Chambers Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 1359, Page 91, Plat Records, Tarrant County, Texas and a ten foot wide alley located Block 14, Chambers Addition, an addition to the City of Fort Worth, Tarrant County, Texas, as recorded in Volume 10, Page 130 of the Plat Records of Tarrant County, Texas, containing respectively approximately 12,757 square feet or 0.293 acres and 2,507 square feet or 0.058 acres of land more or less, and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein by reference be and the same are vacated and extinguished. SECTION 2. That the easements to the land in the above-described vacated street rights of way are hereby released and shall revert to the adjacent owner as provided by law. I.M. Terrell Elementary School (COUNCIL DISTRICT 8) RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached ordinance vacating a portion of IM Terrell Circle South and an alley in Block 14 Chambers Addition, replatted with the adjoining property for a new Science Technology Engineering and Math facility for Fort Worth Independent School District; and 2. Waive any and all purchase fee value of the vacated land in accordance with City Policy. DISCUSSION: Pacheco Koch Consulting Engineers, on behalf of the Fort Worth Independent School District, has requested the vacation of these rights-of-way, to be replatted with the adjoining property for the new Science Technology Engineering and Math (STEM) facility. The City Plan Commission recommended approval of this request at its meeting on February 24, 2016. An acceptable final plat (FS-15-221) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting process. The City does not own any fee interest in the rights-of-way or own any property adjacent to the rights-of-way and did not expend any City funds to purchase the rights-of-way easements. In accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6, 2007 (M&C G-15624), staff recommends waiving the fair market value or any portion thereof of purchase price of the right-of-way easements for the streets. This project is located in COUNCIL DISTRICT 8, Mapsco 77B. This M&C does not request approval of a contract with a business entity.
