ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION Ol° WESTVIEW AVENUE
AND PORTIONS OF SUNDRY OTHE#L STREETS, AVENUES AND PUBLIC PLACES
IN THE CITY OP FORT WORTH, TEXASa DECLARING THE CONTRACT WITH
HARROD PAVING COMPANY, TNC. FOR T1f~E CONSTRUCTION OF
SAID IMPROVEMENTS FULLY COMPLETED AND PERFORMEDy DIRECTING THE
ISSUANCE, E7(ECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF
SPECIAL ASSESSMENTS LEVIED AFTER GYVING EFFECT TO SUNDRY CREDITS
HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS;
DIRECTING THE CITY SECRETARY TO ENGROSS A1~1D ENROLL THIS ORDINANCE
BY COPYING THE CAPTION OF SAME IN THE MINUTE BOOK OF THE CITY
COUNCIL OF FORT WORTH, TE7CAS, AND BY FILING THE COMPLETE ORDINANCE
IN APPROPRIATE ORDINANCE RECORDS OF SAID CITY$ AND PROVYDYNG AN
EFFECTIVE DATE.
WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract
wrath HARROD PAVING OMPANY, TN('.. , for the maleing and construction of
certain street improvements on the hereinafter described portions of streets, arrenues and
public places in said City, to®~iito
WESTVIEW AVENUE From West Fifth Street to 300' North of Monticello Drive,
(Unit II) known and designated as Project No 029-040110, Unit II,
a six-inch thick hot-mix asphaltic concrete pavement sur-
face on a six-inch thick lime stabilized subgrade with
seven-inch high concrete curb and eighteen-inch wide
concrete gutter on a thirty-feet wide roadway. Six-inch
thick driveway approaches will be constructed where spec-
ified.

tivHEN.EAS, by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No, 8762 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above; described portions of streets, avenues and public places and against
the real and true owners thereof;~and,
wHEiiEAS, the City Council of the dity of Fort ~~orth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and~,necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No, 8762 , and
IrdHEf~Aa, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in com~+lete accordance with the contract therefor;

BE IN ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS, 'THAT

The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and performed.
IIa
The Mayor, be, and he isihereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance Frith
the proceedings relating to such improvements and assessmentso The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and shall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereone The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after diving
effect to such credit, if arty, are hereby enumerated and itemized as follows:

When each of the certificates has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City,
V.
This ordinance shall take effect and be in full force and effect from and after
the date of its passage.

300 FEET NORTH OF MONTICELLO DRIVE, to be improved by construction of six-inch thick

Deviation from Revised Price
Final measured quantities at contract unit prices yield an earned total price
for this contract of $251,007.76 which is $4,449.04 (1.74%) under the revised
price. The underrun is the result of liquidated damages a~~fi `i~e~~es between
quantities estimated for the contract documents and qua 1~~~V~a4~t~'~~~y used to

The contractor used 3 working days in addition to th t'me allotted for
construction. In accordance with the contract, a charg~~~$,21~~p,~~icda~~ been

as liquidated damages. Analysis indicates that v~~ls~~o~°~t~~ntractor took
significantly longer to complete the work than the contract p.e~'o~`°reflects, he
was able to do so and incur only three days of liquidated damages because of
excessive days when utility conflicts were uncovered. and excessive days of bad

Bather. While these each occurred to some extent, the contractor took every
dvantage of the sequence of events to avoid legally being charged contract
ime. While the contractor may have only exceeded the legal time limit by 3
orking dyas, staff believes the contractor did not act in good faith in regard
o timely execution of the work and should not be considered for future
ontracts of this nature.
Financing
Sufficient funds are available for the recommended final payment to be made from
the Project IVo. 29-040110-00 and 30-040110-00 accounts.
Compliance with Specifications
The project has been completed in accordance with the requirements of the
contract.
Recommendation
It is recommended that the above project be accepted by the adoption of an
ordinance and final payment in the amount of $27,475.33 be made to Harrod .Paving
Company, Inc.
