I K. ~a } ) ~. ~~ ORDINANCE N0, 1 ORDINANCE ACCEPTING IMPROVEMENTS ON A PORTION OF Raider Road AND PORTIONS OF SUNDRY OTHER STREETS, AVENUES AND PUELIC PLACES IN THE CITY OF FORT WORTH, TEXASa DECLARING THE CONTRACT WITH APAC-Texas, Inc FOR THE CONSTRUCTION OF SAID IMPROVEMENTS FULLY COMPLETED ANP1 PERFORMEDa DIRECTING THE ISSUANCE, EXECUTION AND DELIVERY OF CERTYFICATES IN EVIDENCE OF SPECIAL ASSESSMENTS LEVIED AFTER GIVING EFFECT TO SUNDRY CREDITS HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS; DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THYS ORDINANCE EY COPYING THE CAPTION OF SAME IN THE MINUTE BOOR OF THE CITY COUNCIL OF FORT WORTH, TEXAS, AND EY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE RECORDS OF SAID CITYs AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Fort Worth, Texas, has heretofore entered into a contract with APAC-Texas, Inc , for the matting and construction of certain street improvements on the hereinafter described portions of streets, avenues and public places in said City, to-~ait: UPJIT I RAIDER ROAD From South Pipeline Road to Tube~~Drive, known and des- ignated as Project No 013-36468, Unit I, a seven-inch thick reinforced concrete pavement on a six-inch thick Lime stabilized subgrade with seven-inch high~super- imposed concrete curb on a forty-foot roadway Six-inch thick concrete driveways will be constructed where specified UNIT II SO PIPELINE ROAD From Highway 183 to Raider Road, known and designated as Project No. 013-36468, Unit II, a seven-inch thick reinforced concrete pavement on a six-inch thick lime stabilized subgrade with seven-inch high superimposed concrete curb on a forty-foot roadway Six-inch thick concrete driveways will be constructed where specified. UNIT III BELL DRIVE From South Pipeline Road to Tube Drive, Known and des- ignated as Project No. 013-36468, Unit III, a seven- inch thick reinforced concrete pavement on a six-inch thick lime stabilized subgrade with seven-inch high superimposed concrete curb on a forty-foot roadway. Six-inch thick concrete driveways will be constructed where specified UNIT IV TUBE DRIVE From Reves Drive to Raider Road, known and designated as Project No 013-36468, Unit IV, a seven-inch thick reinforced concrete pavement on a six-inch thick lime stabilized subgrade with seven-inch high superimposed concret curb on a forty-foot roadway. Six-inch thick concrete drive ways will be constructed where specified ' ~ It n .. tivHENx;AS, by sundry proceedings heretofore passed by the City Council of the Gity of Fort Worth, Texas, including Ordinance No, 8362 , a portion of the cost of said improvements was levied and assessed against the respective properties abutting on each of the above described portions of streets, avenues acid public places and against the real and true owners thereof; and, wHER:r;A~, the City Council of the City of Fort ~'~orth, Texas, has, upon review, found and determined that, in some instances, in order to effect substantial justice and equality, it is desirable and necessary to grant and issue certain credits against some one or more of the assessments levied by Ordinance No. 8362 , and WHEI~:Aa, the street improvements hereinabove mentioned have been completed upon each of the portions of streets, avenues and public places hereinabove described, and have been inspected and found to be in complete accordance with the contract therefor; NU4u', TtiERE;F'ORE, BE IN ORDAINED ~3Y THE CITY COUNCIL OF THE CITY OF FORT WORTH, TF.XAJ, THAT I. The improvements on each of the portions of streets, avenues and publio places hereinabove described be, and they are hereby, accepted; and the contract with reference thereto be, and it is hereby, found and declared fully completed and performed, II. The Mayor, be, and he is hereby, directed to issue and execute in the name of the City, certificates in evidence of the special assessments levied against abutting property and the owner thereof for such improvements, and the City Secretary is directed to attest same and impress thereon the corporate seal of the City, all in accordance Frith the proceedings relating to such improvements and assessments, The certificates shall be numbered, shall describe the property against which the assessment has been levied, shall, where known, state the name or names of the true owners of the respective parcels of pro- perty assessed and shall be issued in an amount equal to the difference between the principal amount of the assessment and the amounts of any credit issued thereone The numbers of the certificates, with the property descriptions to be shown on the respective certificates, together with the names of the owners of said property, the principal amount of the assessment, the respective credits, if any which are hereby authorized, granted and allowed against the principal amount of some one or more of the assessments heretofore levied, and the principal amount for which each certificate is to be issued after giving effect to such credit, if any, are hereby enumerated and itemized as follows: _ __ _ _ III. When each of the certificates has been duly executed as hereinabove provided, same shall be delivered to the Tax Assessor-Collector as part payment of the contract pricee IV. The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same in the Minute Book of the City Council of Fort Worths Texans and by filing the complete ordinance in the appropriate Ordinance Records of said City. These utility lines were either owned by the City of Euless or acquired from them by the City of Fort Worth. Unfortunately, the City of Euless did not have adequate location records and construction was therefore considerably more complex and difficult resulting in numerous disagreements as to responsibility. The overrun is the result of differences between quantities estimated for the contract documents and quantities actually used to complete the work. The extreme amount of tie-in required behind the curb adjacent to commercial buildings, and special driveways required to permit ingress and egress at depressed loading docks resulted in an overrun of 72 tons of Hot-Mix Asphaltic Concrete (HMAC) and 3,7.00 square feet of driveways for a total of $34,686.00. Minor variations on other items reduced the construction overrun to $28,062.00. Contract Time The contractor used 39 'working days in addition to the time allotted for construction. A charge of $5,850.00 ($150 per day) has been deducted from the final payment as liquidated damages in accordance with the contract. Financing Final payment is to be made from Project Numbers 029-036468-00 and 013-036468-00. A bond fund transfer is needed in the amount of $23,000.00. Compliance with Specifications The project has been completed in accordance with the requirements of the contract. Recommendation It is recommended that City Council 1.
