AN ORDINANCE DEANNEXING AND DISCONTINUING
TERRITORY FROM WITHIN THE CORPORATE LIMITS
OF THE CITY OF FORT WORTH, TEXAS; PROVIDING
THAT THIS ORDINANCE SHALL AMEND EVERY PRIOR
ORDINANCE IN DIRECT CONFLICT HEREWITH; PRO-
VIDING THAT THIS ORDINANCE SHALL BE CUMULA-
TIVE OF ALL PRIOR ORDINANCES NOT IN DIRECT
CONFLICT; AND PROVIDING FOR SEVERABILITY AND
NAMING AN EFFECTIVE DATE.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT
WORTH, TEXAS:
SECTION 1.
That the hereinafter described territory within the corporate
limits of the City of Fort Worth, Texas be and the same is
hereby deannexed and discontinued as a part of the City of
Fort Worth, Texas; said territory being Tract 3D of the Sarah
Grey Survey No. 558, situated approximately 13 miles south of
the Courthouse of Tarrant County, Texas, and being more parti-
cularly described by metes and bounds as follows:
BEGINNING at the intersection of the easterly right
of line of U.S. Highway No. 81 South (also known as
Interstate Highway I-35W), with the northerly right
of way line of Hardgrove Road (also known as County
Road No. 1064), said point being in the Fort Worth
city limit line according to the judgment entered in
Cause No. 57175-C by the District Court of Tarrant
County, Texas, 153rd Judicial District, said judg-
ment being dated October 8, 1970;
THENCE: Westerly, along the extension of the said
northerly right of way of County Road No. 1064, and
said existing. city limit line, to a point in the
westerly right of way line of the Missouri, Kansas
and Texas Railway;
THENCE: Northwesterly, along the westerly right of
way line of said Railway, to the intersection of a
line 900.0 feet measured at right angles, south of
the centerline of McAllister Road, (also known as
Country Road No. 1017);
THENCE: Easterly, along a line 900.0 feet south of
and parallel with the centerline of said McAllister
Road, to its intersection with the easterly right of
way line of said Interstate Highway 35W;.
THENCE: Southerly, along the easterly right of way
line of said Interstate Highway 35W to the point of
beginning, containing approximately 80 acres of
land.

SECTION 2.
That this ordinance shall and does hereby amend every prior
ordinance in direct conflict herewith, but as to all other
ordinances or sections of ordinances not in direct conflict
herewith, this ordinance shall and the same is hereby made
cumulative.
SECTION 3.
That it is hereby declared to be the intent of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and if any phrase,
clause, sentence, or paragraph or section of this ordinance
shall be declared unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such unconsti-
tutionality shall not affect any of the remaining phrases,
clauses, sentences, paragraphs and sections of this ordinance,
since the same would have been enacted by the City Council
without the incorporation in this ordinance of any such uncon-
stitutional phrase, sentence, paragraph or section.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

On September 9, 1983, the 249th Judicial District Court, Johnson County, Texas,
in the case of City of Burleson v. City of Fort Worth, approved an agree d
settlement based on Stipulations for Compromise, whereby provisions were made
)o~~for a land swap and boundary adjustment that will facilitate orderly
construction of a gener al aviation airport in south Tarrant County. The
subject site contains approximately 80 acres of land. This area was annexed by
the City of Fort Worth on June 6, 1969 by Ordinance Number 6116. (See Attached
Exhibit "A").
City Plan Commission
On January 25, 1984, the City Plan Commission recommended approval of the Fort
Wort/Burrleson land swap and boundary adjustment.
Recommendation
It isrecommended that the City Council accept the recommendation of the City
Plan Commission and adopt the attached disannexation ordinance.
