HomeMy WebLinkAboutOrdinance 18022-03-2008Ordinance No. 18022-03-2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AVIATION CAPITAL PROJECTS FUND IN THE AMOUNT OF $202,594.50 FROM AVAILABLE FUNDS FOR THE PURPOSE OF PURCHASING THREE NEW JOHN DEERE TRACTORS AND MOWERS USING A COOPERATIVE CONTRACT THROUGH THE TEXAS ASSOCIATION OF SCHOOL BOARDS WITH JOHN DEERE COMPANY FOR THE AVIATION DEPARTMENT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2007- 2008 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Aviation Capital Projects Fund in the amount of $202,594.50 from available funds for the purpose of purchasing three new John Deere tractors and mowers using a cooperative contract through the Texas Association of School Boards with John Deere. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. Adopt the attached appropriations ordinance increasing estimated receipts and appropriations by $202,594.50 in the Aviation Improvements Capital Projects Fund from available funds; and 2. Authorize the purchase of three new John Deere tractors and mowers using a cooperative contract through the Texas Association of School Boards (TASB) with John Deere Company for Aviation Department for a cost not to exceed $202,594.50, with payment due within 30 days of receipt of the invoices. DISCUSSION: This recommendation is for the purchase of three new tractors and mowers using TASB Cooperative Contract 255-05 with John Deere Company. The equipment will be delivered through the local dealership, Saginaw Implement Company, located in Rhome, Texas. These tractors and mowers are replacements for a unit that can no longer be economically maintained and which will be sold at auction. The department will use the vehicles in the performance of assigned duties. The Aviation and Equipment Services Departments have reviewed the pricing and find the costs to be competitive. PRICE ANALYSIS -The annual line item prices are about a +2 percent difference than previous prices. The annual price represents no significant change because this equipment is being bought from a TASB Cooperative Contract. Changes area result of different options or the cost of production by the manufacture. Overall, prices received from cooperative contracts are considered fair and reasonable and equal to or better than current market prices for comparable vehicles in this region due to higher volumes when purchases by multiple governmental entities are combined from across the state. State law provides that a local government purchasing an item under a cooperative purchasing agreement satisfies state laws requiring that the local government seek competitive bids for purchase of the item. TASB contracts have been competitively bid to increase and simplify the purchasing power of local government entities across the State of Texas.
