AN ORDINANCE AMENDING CHAPTER 26, "MOTOR VEHICLES AND
TRAFFIC", OF THE CODE OF THE CITY OF FORT WORTH (1964), AS
AMENDED, BY AMENDING SECTION 26-1 THEREOF BY THE ADDITION
OF THE DEFINITIONS OF AND TERMS "BUS LANE", "STAND OR
STANDING", "STOP OR STOPPING"; BY AMENDING SECTION 26-3
THEREOF TO PROVIDE THAT THE CITY TRAFFIC ENGINEER MAY
DETERMINE AND DESIGNATE BUS LANES; BY AMENDING SECTION
26-47 THEREOF TO PROVIDE FOR RIGHT TURNS FROM BUS LANES;
BY ADDING A SECTION 26-61 THERETO TO PROHIBIT THE PROPEL- -
LING OF A VEHICLE IN ANY BUS LANE AND TO DESIGNATE CERTAIN
BUS LANES ON THROCKMORTON STREET AND HOUSTON STREET BY
AMENDING SECTION 26-86 THEREOF TO PROHIBIT THE STOPPING,
STANDING OR PARKING OF A VEHICLE IN ANY BUS LANE, EXCEPT
WHEN SUCH BUS LANE IS ADJACENT 'TO CERTAIN LOADING ZONES;
PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL
PROVISIONS OF ORDINANCES AND OF SUCH CODE AFFECTING MOTOR
VEHICLES AND TRAFFIC; PROVIDING FOR REPEAL; PROVIDING A
SAVINGS CLAUSE; PROVIDING A SEVERABILI'I'Y CLAUSE; PROVIDING
A PENAL CLAUSE; AND NAMING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That the following terms and definitions be, and the same are
hereby added, in the proper alphabetical sequence, to Section 26-1
of Article 1 of Chapter 26 of the Code of the City of Fort Worth
(1964), as amended, and, after being so added, same shall be and
read as follows:
"Bus lane. That portion of roadway devoted primarily
to the use by buses of the public bus transportation
system operating in the Fort Worth area, such system being
commonly .known as 'CITRAN'.
"Stand or standing means the halting of a vehicle,
whether occupied or not, otherwise than temporarily for
the purpose of and while actually engaged in receiving or
discharging passengers.
"Stop or stopping when prohibited means any halting,
even momentarily, of a vehicle, whether occupied or not,
except when necessary to avoid conflict with other traffic
or in compliance with the directions of a police officer
or official traffic control device."
SECTION 2.
That Subparagraphs (12) and (13) of Section 26-3 of Article I
of Chapter 26 of the Code of the City of Fort Worth (1964), as
amended, be, and the same are hereby amended to read as follows:
"(12) To determine and designate spaces and/or lanes
for exclusive uses as bus zones, bus lanes, taxicab stands
and passenger and- freight loading zones, no parking zones,
and 'one-way' traffic lanes in which driving is prohibited
in one direction and permitted in the opposite direction,
and to place or erect official traffic-control devices,
indicating same, within any areaway, parkway, traffic-way
or parking space owned or controlled by any public service
concern, public service utility company, terminal company,
railroad or other quasi-public corporation or public con-
cern, designed for the temporary parking of patrons of
such public concern, utility or corporation;
"(13) Reserved;"
SECTION 3.
That Section 26-47 of Article III of Chapter 26 of the Code of
the City of Fort Worth (1964), as amended, be, and the same is
hereby amended to read as follows:
"Unless a different method of turning is prescribed
by law or directed by an official traffic-control device,
in which event turning shall be made in accordance with
such law or with the directions of such device, the ap-
proach for a right turn shall not be begun or made in a
bus lane designated as such by an official traffic-control
device prior to the midway point of that block preceding
the corner at which such right turn is to be executed."
SECTION 4.
That Article III of Chapter 26 of the Code of the City of Fort
Worth (1964), as amended, be, and the same is hereby amended by the
addition thereto of Section 26-61, which section, after being so
added, shall be and read as follows:
"(a) Except for turning as provided in Section 26-47,
a person commits an offense if he propels a vehicle which
is not a bus of the public bus transportation system or if
he causes said vehicle to be propelled in any portion of a
roadway designated as a bus lane by an official traffic-
control device.
"(b) In addition to any bus lanes established by the
City traffic engineer, as authorized in this chapter, each
of the following is designated as a bus lane:
"(1) Throckmorton Street - The easternmost lane
between the north curb line of West Lancaster Street
and the south curb line of West Belknap Street.
"(2) Houston Street - The westernmost lane
between the south curb line of Belknap Street and the
north curb line of West Lancaster Street."
SECTION 5.
That Subsection (a) of Section 26-86 of Division 1 of
Article VI of chapter 26 of the Code of the City of Fort Worth
(1964), as amended, be, and the same is hereby amended to read as
follows:

"(a) No person shall stop, stand or park or cause to
be stopped, stood or parked any vehicle in any bus lane,
except to render by bus the service of the public bus
transportation system or except in those portions of that
bus lane, being described as the easternmost lane of
Throckmorton Street and the westernmost lane of Houston
Street between the north curb line of West Lancaster
Street and the south curb line of West Belknap Street,
adjoining the following described loading zones:
"(1) Throckmorton Street
"(A) That loading zone which may be employ-
ed as such zone at any time except between the
hours of 7:00 A.M. and 9:00 A.M., such zone
being more particularly described as that space
or section of the curb adjoining such lane
between a point of beginning being twenty-eight
(28) feet north from the north curb line of West
Fourth Street and a point of termination being
eighty (80) feet north from such point of begin-
ning.
"(B) Those loading zones which may be em-
ployed as such zones at any time except between
the hours of 7:00 A.M. and 9:00 A.M. and between
the hours of 4:00 P.M. and 6:00 P.M., such zones
being more particularly described as follows:
"(a) That space or section of t'ne curb
adjoining such lane between a point of
beginning being twenty-four (24) feet north
of the north curb line of West Sixth Street
and a point of termination being sixty (60)
feet north from such point of beginning;
"(2) Houston Street
"(A) That space or section of the curb
adjoining such lane between a point of
beginning being one hundred twenty-five
(125) feet north from the north curb line
of West Second Street and a point of termi-
nation being forty (40) feet north from
such point of beginning."
SECTION 6.
That this ordinance shall be cumulative of all provisions of
ordinances and of the Code of the City of Fort Worth (1964), as
amended, affecting motor vehicles and traffic, except where the pro-
visions of this ordinance are in direct conflict with the provisions
of such ordinances and such Code, in which event such conflicting
provisions of such ordinances and such Code are hereby repealed.

SECTION 7.
That all rights or remedies of the City o.f Fort Worth, Texas,
are expressly saved as to any and all violations of the provisions
of Chapter 26 of the Code of the City of Fort Worth (1964), as
amended, and of any other ordinance affecting motor vehicles and
traffic which have accrued at the time of the effective date of this
ordinance; and, as to such accrued violations and all pending liti-
gation, both civil and criminal, whether pending in court or not,
under such chapter and/or other ordinances, same shall not be
affected by this ordinance but may be prosecuted until final dispo-
sition by the courts.
SECTION 8.
That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared
void, ineffective or unconstitutional by the valid judgment or final
decree of a court of competent jurisdiction, such voidness, ineffec-
tiveness or unconstitutionality shall not affect any of the remain-
ing phrases, clauses, sentences, paragraphs and sections of this
ordinance, since the same would have been enacted by the City
Council without the incorporation herein of any such void, ineffec-
tive or unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION 9.
that any person violating any of the provisions of this ordi-
nance shall be deemed guilty of a misdemeanor, and each such person
shall be deemed guilty of a separate offense for each day or portion
thereof during which any violation of any of the provisions of this
ordinance is committed, continued or permitted, and each violation
shall be punishable by a fine not to exceed Two Hundred Dollars
($200.00).

SECTION 10.
That this ordinance shall be in full force and effect from and
after the date of its passage and publication, as required by law,
and it is so ordained.

On June 3, 1974, the City Council approved MSC TE-77, "Exclusive Bus Lanes.
This approval authorized ordinance 47015 of the City Code which establishes
exclusive-bus lanes adjacent to the curbs, north and south bound on Throclamorton
Street. The Houston/Throckmorton Bus Mall project requires that this portion of
the ordinance be amended to conform to the new routing as established by this
project. The newly established exclusive bus lanes will be northbound on
Throclanorton Street and southbound on Houston Street. During the construction
of this project, changes will have to be made that necessitate the passage of
the new ordinance prior to actually placing the bus lanes in operation. Curb
usage will have to be adjusted during the construction phases in order to
facilitate the needs of businesses along Houston and Throckmorton. This revised
ordinance allows the City St aff to make changes as necessary during construction
and establishes the necessary control of bus lanes along Houston and
Throckmorton after the project is completed and the new bus routing is
established.
Recommendation:
It is recommended that the City Council adopt the proposed ordinance revision
establishing exclusive bus Lanes on the eastside of Throckmorton Street and the
westside of Houston Street so that orderly progress can be accomplished during
the construction phase of the Houston-Throckmorton Street Project and so that
the new bus lanes adjacent to Houston and Throckmorton Streets can be protected
from curb usage encroachments.
