,,, .. -, . . ~ ~. a r .. d ~ ~ •'7 rerq 1 ~~®~s ~'~'' ORDINANCE NO. ?~~ AN ORDINANCE VACATING, ABANDONING, CLOSING AND EXTINGUISH- -' _ ING THE 1300 BLOCK OF PRUITT STREET, A PUBLIC STREET RIGHT-OF-WAY, EXTENDING FROM SOUTH LAKE STREET WEST TO 6TH AVENUE, AND VACATING, ABANDONING, CLOSING AND EXTINGUISH- ING THE 600 AND 700 BLOCKS OF SOUTH LAKE STREET, A PUBLIC STREET RIGHT-OF-WAY, EXTENDING FROM PENNSYLVANIA AVENUE SOUTH TO WEST COOPER STREET; RETAINING UTILITY EASEMENTS IN A PORTION OF THE VACATED RIGHT-OF-WAY FOR SOUTH LAKE STREET; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVID- ING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following portions of Pruitt Street and South Lake Street be and the same are vacated, abandoned and permanently closed and extinguished as public street rights-of-way: A. The 1300 block of Pruitt Street, extending from South Lake Street west to 6th Avenue; and B. The 600 and 700 blocks of South Lake Street, extend- ing from Pennsylvania Avenue south to West Cooper Street. SECTION 2. That the fee to the lands in the above described vacated pub- lic street rights-of-way is hereby released and shall revert to the adjacent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities in that portion of the above-vacated right-of-way for South Lake Street extending from the intersection of South Lake Street with the above-vacated portion of Pruitt Street northward to Pennsylvania Avenue. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. DATE REFERENCE NUMBER SUBJECT Vacation of Streets: Harris HOS- PAGE „o"a 3/20/84 ** PZ-1267 pital Sub Block "A", Sandidge Addn., 1 Blocks 5 6R 7 & 12 1300 Block Pruitt >°t ___ Street and 600-700 Blocks South Lake Street (V-83-13) Harris Hospital-Methodist, with the written consent of all abutting property owners, has requested that the City vacate the 1300 block of Pruitt Street from South Lake Street west to 6th Avenue, and the 600-700 blocks of South Lake Street from Pennsylvania Avenue south to West Cooper Street, as shown on the attached map The subject street rights-of-way, acquired by dedication, are open on the ground, improved, and in use. The northernmost portion of the South Lake Street right-of way, from Pruitt Street northward to Pennsylvania Drive, contains water, electric gas, and telephone utility facilities; and the South Pruitt right-of-way contains no utility facilities. The subject vacation request is made in order to replat the vacated rights-of-way with. adjoining property, thus facilitating the expansion of the Harris Hospital complex. ' Reviewing City departments and private utility companies have raised no objectio to this request, provided the vacated rights-of-way are replatted with adjacent property and the northernmost portion of South Lake Street is retained as a utility easement for the existing utility facilities. A satisfactory replat has been submitted, retaining and dedicating the necessary and appropriate utility easements. The subject vacation request was submitted and reviewed prior to 'the adoption of the City's compensation policy, therefore, compensation for the vacated rights-of: way is not required. The City Plan Commission has reviewed this request and recommends that the sub- ject rights `of-way be vacated as requested Recommendation It is recommended that the City Council adopt an ordinance vacating the 1:300 block of Pruitt Street and the 600-700 blocks of South Lake Street, as recom- mended by the City Plan Commission.
