ORDINANCE NO. 9~~0
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING THE 4-FOOT WIDE NORTH/SOUTH UTILITY EASEMENT
LOCATED IN AND BETWEEN LOTS 1-R, 2-R AND 3, McDONNELL
SUBDIVISION, FROM N.E. 28TH STREET ALONG, PARALLEL AND
ADJACENT TO THE WEST PROPERTY LINE OF SAID LOTS 1-R AND
2-R, NORTHWARD 276.7 FEET TO A POINT 5 FEET SOUTH OF THE
NORTH PROPERTY LINE OF SAID LOT 2-R; PROVIDING FOR REVER-
SION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CON-
FLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the 4-foot wide north/south utility easement located in
and between Lots 1-R, 2-R and 3, McDonnell Subdivision, from N.E.
28th Street along, parallel and adjacent to the west property line
of said Lots 1-R and 2-R, northward 276.7 feet to a point 5 feet
south of the north property line of said Lot 2-R, be and the same is
vacated, abandoned and permanently closed and extinguished as a
utility easement.
SECTION 2.
That the fee to the land in the above described vacated utility
easement is hereby released and shall revert to the adjacent owner
as provided by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

Phelps Leasing, Inc owner of all abutting property, has requested that the
City vacate the 4' wide north/south utility easement in and between Lots 3, 1-R
"sand 2-R, McDonnell Sub , from N.E. 29th Street along, parallel and co-linear
with the west property line of said lots 1-R and 2-R, northward 276.7' to a
point five feet from the north property line of said Lot 2-R, as shown on the
'w~attached map
The subject utility easement, acquired by dedication, is platted but contains no
utility facilities The subject vacation request is made in order to consolidate
the vacated easement right-of-way with the adjacent property to expand the
building area
It is the opinion of the. Real Property Department that the rights and interest
of the City in the utility easement denoted in this request has no monetary
value, if vacated. Other reviewing City departments and private utility com-
panies have raised no objections to this request. '
Recommendation
It is recommended that an ordinance be adopted vacating the 4' wide north/south.
utility easement in Lots 3, 1-R, and 2-R, McDonnell Subdivision
