ORDINANCE ACCEPTING IMPROVEI~NTS ON A PORTION OF CARTEN LA. & GREENLEE ST
AND PORTIONS OF SUNDRY OTHE#t STREETS, AVENDES AND PUBLIC PLACES
IN THE CITY OP FORT WORTHa TEXAS9 DECLARING THE CONTRACT WITH
LOWELL B. ALLISON CONTRACTOR, INC. FOR CONSTRUCTION OF
SAID YMPROVEMENTS FULLY COI~RP~TED AND PERFORMEDb DIRECTING THE
ISSUANCEy EXECUTION AND DELIVERY OF CERTIFICATES IN EVIDENCE OF
SPECIAL ASSESSMENTS LEVIED AFTER GYVING EFFECT TO SUNDRY CREDITS
HEREIN AUTHORIZED AND ALLOWED AGAINST SOME OF SAID ASSESSMENTS;
DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL T~IIS ORDINANCE _
BY COPYING THE CAPTION OF SAME IN THE rIINUT~ BOOR OF THE CITY
COUNCIL OF FORT WORTHY TEXAS, A1~D BY FILING THE COI~'YPL~TE ORDINANCE
IN APPROPRIATE ORDINANCE RECORDS OF SAID CITYe AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS9 the City of Fort Worthy Texasa has heretofore entered into a contract
with LOWELL B. ALLISON CONTRACTOR. ING. 9 for the making and construction of
certain street improvements on the hereinafter described portions of streets avenues and
public places in said Citj9a to®~iit:
CARTEN LANE From Beaty Street to the Nor"th Property Line of Lot 22R,
Block 2, Eastern Meadows Addition, known and designated as -"r:
Project No. 030-036-771-00, Unit I, a five-inch thick hot-
mix asphaltic concrete pavement with seven-inch high concrete
curb and eighteen-inch wide concrete gutter on a five-inch
thick lime stabilized subgrade, so that the finished roadway
will be twenty-eight feet wide.
GREENLEE STREET From Carten Lane to Janice Lane, known and designated as
Project 030-036-771-00, Unit IA, a five=inch thick hot-mix
asphaltic concrete pavement with seven-inch high concrete
curb and eighteen-inch wide concrete gutter on a five-inch
thick lime stabilized subgrade, so that the finished road-
way will be twenty-eight feet wide.

tivHEREAS, by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No, 9091 , a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenues and public places and against
the real and true owners thereof; and,
wHEf1FA3, the laity Council of the City of Fort ~yorth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No, 9091 , and
YdHEfiEA~, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described,
and have been inspected and found to be in complete accordance erith the contract therefor;
NOW, TtiE1t~FORE,
BE IN ORDAIN1t:D BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
'rF..XA:i, THAT
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with
reference thereto be, and it is hereby, found and declared fully completed and perfolttned.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance Frith
the proceedings relating to such improvements and assessmentso The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and~hall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereone The
numbers of the certificates, with the property descriptions to be shown on the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby authorized, granted and
allowed against the principal amount of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after diving
effect to such credit, if any, are hereby enumerated and itemized as follows:

III.
When each of the certificates has been duly executed as hereinabowe provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City,
V.
This ordinance shall take effect and be in full force and effect from and after
the date of its passage.

Deviation from Bid Price
Final measured quantities at contract unit prices yield an earned total price
for this contract of $63,881.56 which is $4,617.64 (6.74%) under the revised
price. The underrun is the result of differences between quantities estimated
for the contract documents and quantities actually used to complete the work.
