HomeMy WebLinkAboutOrdinance 18026-03-2008Ordinance No. 18026-03-2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE CRITICAL CAPITAL PROJECTS FUND IN THE AMOUNT OF $20,000 FROM AVAILABLE FUNDS FOR THE PURPOSE OF EXECUTING AMENDMENT 1 CITY SECRETARY CONTRACT NO. 29608 WITH TXDOT FOR ADDITIONAL COSTS ACCUMULATED WHILE REVIEWING THE SCHEMATIC DESIGN PLANS FOR THE NORTH TARRANT PARKWAY/US 287 INTERCHANGE; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2007- 2008 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Critical Capital Projects Fund in the amount of $20,000 from available funds for the purpose of executing Amendment 1 City Secretary Contract No. 29608 with TxDOT for additional costs accumulated while reviewing the schematic design plans for the North Tarrant Parkway/US 287 Interchange. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance stall take effect upon adoption. Authorize the City Manager to execute an Advance Funding Agreement accepting $20,000 from Diversified Asset Planning, LLC; 2. Authorize the City Manager to execute Amendment No. 1 in the amount of $20,000 to City Secretary Contract No. 29608 with the Texas Department of Transportation; and 3. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Critical Capital Projects Fund by $20,000. DISCUSSION: On January 13, 2004, (M&C C-19929) the City Council authorized the City Manager to execute an Advance Funding Agreement with Presidio Vista I, Ltd. and a Local Project Advance Funding Agreement with TxDOT for the review of the schematic design plans for the North Tarrant Parkway/US 287 Interchange. In May 2006, Presido Vista I, Ltd., sold the property to Diversified Asset Planning, LLC. TxDOT has since requested an additional $20,000 for the review of the schematics due to an increase in project scope of services. TxDOT prepared Advance Funding Agreement Amendment No. 1 in the amount of an additional $20,000 to complete its review. City Staff prepared an Advance Funding Agreement with Diversified Asset Planning, LLC, to memorialize the developer's commitment to reimburse the City for costs incurred by the City under its agreement with TxDOT to review the schematics for this project. The Transportation and Public Works Department will be responsible for the collection and expenditure of these funds in the N. Tarrant Parkway Project of the 2000 Critical Capital Projects Fund.
