AN ORDINANCE AMENDING ORDINANCE NO. 3011, BEING AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE, OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING AND THE DENSITY OF POPULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST BY FIRING DEFINITE USES OF THEBUILDINGS HEREINAFTER ERECTED IN SAID DESCRIBED AREAS FROM THE USES AS SHOWN ON THE MAPS CONTAINED IN SAID ORDINANCE NO. 3011; PRESCRIBING A SAVINGS CLAUSE; PROVIDING A FINE OF NOT LESS THAN $5.00 NOR MORE THAN $200.00 FOR EACH OFFENSE, AND THAT EACH DAY THAT A VIOLATION IS PERMITTED TO EXIST SHALL CONSTITUTE A SEPARATE OFFENSE; AND NAMING AN EFFECTIVE DATE. The zoning regulations and districts, as herein established, have been made in accordance with the comprehensive plan for the purpose of promoting health, safety, morals, and the general welfare of the community. They have been designed to lessen congestion in the streets; to secure safety from fire, panic, flood and other dangers; to provide adequate light and air; to prevent overcrowding of land; to avoid undue concentration of population; to facilitate the adequate provision of transportation, water, sewerage, parks and other public requirements. They have been made after a full and complete public hearing with reasonable considera- tion, among other things, of the character of the district and its peculiar suitability for the particular uses and with a view of conserving the value of buildings and encouraging the most appropriate use of land throughout the community. SECTION 3. This ordinance shall be cumulative of all other ordinances of the City of Fort Worth affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of those ordinances are in direct conflict with the provisions of this ordinance. SECTION 4. Should any section, clause or provision of this ordinance be declared by the court to be invalid, the same shall not affect the validity of the ordinance as a whole or any part thereof, other than the part so declared to be invalid. SECTION 5. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not less than Five and No/100 Dollars ($5.00) nor more than Two Hundred and No/100 ($200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 6. This Ordinance will take effect and be in full force and effect from and after its passage and publication as required by law. The propertir adjoining this on the west is zoned "F-R" restricted Commercial and extends north of the north boundary of this property. This will penalize lir. Thorp in his development unless his property has the same zoning. 6. A filling station site is located on Convair Access Rd. but before proceeding with further development of t.. e property, lir. Thorp wishes to have the zoning established which will aid in a plan for all of the property. 7. After the discussion, the petitioner agreed to accept "D" Apartment zoning on Tract D, ' estover Ridge., which adjoins "A" One-Family Residential zoning on the north 8. As there is no access to the property proposed for change, from Convair Access R&, the traffic thru residential areas will be a problem and could result in loss of value in those areas. 5. Investments in any properties are safe-guarded thru zoning of adjacent property and there has been no change in this area since the original �* zoning was established which would justify the proposed change. SUMRY: The proposed change is compatible with existing zoning and proposed development of the area, It will permit the highest and best use of the property. Sam Lee was present and made the following statements in favor of the change: 1. The property adjoins Forest Park and fronts on University Drive. There is a go—cart track on one corner and a driving rangeon a portion of the property. The Forest Bark Motel adjoins on the north. 2. If the changes approved, it is proposed to construct a motel and convention center on the property. 3. Under the present zoning, a "string" commercial development or factories could be located on the property. The proposed change, he believes, will upgrade the property, be an attractive use adjoining the Park and fill a need in Fort Worth. SUMARY: The proposed change will permit uses compatible with existing and futaire use of the area. It also will prevent undesirable uses which are permissible unddr existing zoning. Hamilton, 5725 Prieadowbrook Drive, appeared before the Commission with reference to a petition signed by many property owners in the vicinity of Weiler and i-eadowbrook. They asked that the Commission set a public hearing, without a petition and without agreement of the owner, to consider ■, a change�n zoning on property at the northeast corneof the intersection, to "A" One-Family Presidential. The City Zoning Commission had recommendhd and the City Council had approved changing the zoning from "A" to "C" Apartment and 'IF-R" Restricted Commercial on Docket 62-Z-71-CC, over the protests of adjoining property owners. The request was referred to the Staff for a study and a report to the Zoning Commission at a futur*eeting. The Staff was instructed to set a public hearing July 16, 1963, to consider initial zoning on a newly annexed area lying south of the U.; . Narcotics Hospital, on both side of Loop Freeway I-820. The Staff was instructed to set a public hearing to consider a change in zoning on property lying immediately south of G.S.I. Airport - Dallas-Fort North Field, July 16, 1963. The Staff was instructed to invite the City Council to a joint meeting with the Zoning Commission to review two proposed new sections in the Zoning Ordinance, one ~ covaring flood plans and one covering agricultural districts.
