SEAS, the City of Fort Worth, Texas, has heretofore entered into a contract
with TEXAS BTTLTT.TTHTC COMPANY for the making and construction of certain
street improvements on the hereinafter described portions of streets, avenues and public places
in said City, to-wit:
DECATUR AVENUE, UNIT III From Dixie Street to Terminal Road, known
and designated as Project No. 104-27000-
159, Unit III.

WHEREAS,, by sundry proceedings heretofore passed by the City Council of the
City ,o£ Fort Worth, Texas, including Ordinance No. 6498 a portion of the cost of
said improvements was levied and assessed against the respective properties abutting
on each of the above described portions of streets, avenuesz�and. public places and against
the real and true owners thereof'; and,
WHEREAS, the City Council of the City of Fort Worth, Texas, has, upon review,
found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits Against
some one or more of the assessments levied by Ordinance No. 6498 , and
WHEREAS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove describedp
and have been inspected and found to be in complete accordance with the contract therefor-,
NOW,, THEREFORE,
BE IT ORDAINED BY THE.�:CITY COUNCIL OF THE CITY OF FORT WORTH,,
TEXAS,, THAT:
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; ,and the contract with
reference. thereto be, and it is hereby, found and declared fully completed and performed.
Ii.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is 'directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements-and assessments. The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, ,state' the name or names of the'true owners of the respective parcels of. pro
perty assessed and shall be .issued 'in an amount equal to the difference between the
principal amount of the .assessment and' the amounts of any credit issued thereon. The
numbers of the ,certificates, with the property descriptions to be shown on'the respective
certificates, together with the names of the owners of said property, the principal amount
of the assessment, the respective credits, if any which are hereby -authorized, granted and
allowed against the principal amount ,of some one or more of the assessments heretofore
levied, and the principal amount for which each certificate is to be issued after 'giving
effect to such credit, if any, are hereby enumerated and itemized as follows.-,

When each of the certifiadtes has been duly executed as hereinabove provided,
same shall be delivered to the Tax Assessor-Collector as part payment of the contract
price;
IV.
The City Secretary is hereby directed to engross and enroll this ordinance by
copying the caption of same in the Minute Bbok of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the_ appropriate Ordinance Records of said City.,
V.
This ordinance shall Cake effect and be in full force and"effect from and after
the date of its passaged

PROJECT NO. 104-27000-159, UNIT III: DECATUR AVENUE FROM DIXIE STREET TO TERMINAL ROAD, to
be improved by constructing a two-inch thick hot-mix asphaltic concrete surface on a seven-
inch thick cement stabilized gravel base on a six-inch thick lime stabilized subgrade, with
seven-inch high concrete curb and two-foot wide concrete gutter, so that the finished road-
way will be forty feet wide and by constructing six-inch thick concrete driveways and four-
foot wide concrete sidewalk where specified.

Original Bid Price: $123,179.00

Final Contract Cost: 108,593.33
Partial Payments Previously Made: 6 Amount: $97,734.00
Final Payment Due: $ 10,859.33
Sufficient funds are available for, the final payment to be made from Project
Number 104-27000-159.
Deviation from Bid Price: The final contract cost of this project is
$14,662.45 under the revised bid price. A major portion of the savings, $7200
resulted because 6" metal pipe subdrain was found to be unnecessary, A savings
of $4294.73 was realized because it was not necessary to adjust as many utili-
ties as anticipated and a savings of $942 resulted because more suitable material
than was estimated was found on the site for finishing parkways; consequently,
less top soil was required. The remaining cost difference $2,225.72 is attri-
buted to minor variations between quantities estimated in the contract documents
and quantities measured and used at the job site.
Compliance with Specifications
Tests made during construction show that materials used and required thickness
were in compliance with contract specifications,
Recommendations
It is recommended that the project described be accepted by the adoption of an
ordinance and that final payment of $10,859.33 be authorized to Texas Bitulithic
Company.
