ORDINANCE NO.
AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN-
GUISHING THE 10 FOOT WIDE NORTH/SOUTH UTILITY EASEMENT
LOCATED ACROSS AND BETWEEN BLOCKS 8 AND 9, SOUTH CREEK
ADDITION; PROVIDING FOR REVERSION OF FEE IN SAID LAND;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVID-
ING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
THAT THE 10 foot wide north/south utility easement located
across and between Blocks 8 and 9, South Creek Addition, said
utility easement being more particularly described in Exhibit "A",
attached hereto and incorporated herein, be and the same is
vacated, abandoned, and permanently closed and extinguished as a
public utility easement.
SECTION 2.
That the fee to the land in the above described vacated public
utility easement is hereby released and shall revert to the adjacent
owner as provided by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so
ordained.

Metes and Bounds Description
To Accompany Request for Vacation of
a 10-foot Utility Easement
Being 0.059 acres of land located in the S. A. and M. G. Railroad Company Survey,
Abstract No. 1463, City of Fort Worth, Tarrant County, Texas, and being centered on the
boundary line between Block 8 and Block 9 of the South Creek Addition, recorded in
Volume 388-157, Pages 65-fib, Plat Records, Tarrant County, Texas; said 0.059 acre
easement being more particularly described as follows:
Commencing, at a 1/2-inch iron rod set in the southwest corner of Block 8, said point
also being the northwest corner of Lot 3, Block 13, in the South Ridge II Addition, an
addition to the City of Fort Worth as recorded in Volume 388-122, Page 88, Plat Records,
Tarrant County, Texas;
THENCE, N 09° 26' 08" E, a distance of 5.07 feet to a point in the north line of a 5.0 foot
utility easement as recorded by said South Creek Addition Plat;
THENCE, N 89° 55' 24" W, with said North easement line, a distance of 5.07 feet to a
.point for corner, said point being the southwest corner of said 10-foot utility easement,
and the PLACE OF BEGINNING;
THENCE, N 09° 26' 08" E, a distance of 252.93 feet, to a point for corner;
THENCE, N 05° 49' 20" E, a distance of 1.21 feet, to a point for corner; said point being
in a curve to the left whose central angle is O1° I4' 5311 and whose radius bears N 07° 13'
O6" E, a distance of 472.5 feet from said point;
'THENCE, with said curve to the left in an easterly direction, and with the south line of
an existing 135-foot drainage easement, an arc distance of 10.29 feet to a point for
corner at the end of said curve;
'THENCE, S 05° 49' 20" W, a distance of 3.95 feet, to a point for corner;
THENCE, S 09° 26' 0811 W, a distance of 251.60 feet to a .point for corner;
THENCE, N 89° 55' 2411 W, a distance of 10.13 feet, to the PLACE OF BEGINNING;
Containing, 2,548 square feet or 0.059 acres.

RATION $
Robert H Tonetti Interests, owner of all abutting property, has requested
that the City vacate the 10' wide north/south utility easement across and
between Block 8 & 9, South Creek Addition, from the .south right-of-way
line of an east/west drainage utility easement southward to within 5'
of the south property line of said Blocks $ & 9, South Creek Addition,
as shown on the attached map
The subject easement, acquired by dedication, is platted but contains no
utility facilities. The subject vacation request is made in order to
consolidate the vacated easement right-of-way with abutting property,
thus expanding the building area and providing more usable yard space
Reviewing City departments and private utility companies have raised no
objections to this request The Real Property Division has determined
that the right, title, and interest of the City in the subject easement
has no fair market value.
Recommendation '
It is recommended that an ordinance be adopted vacating the 10.' wide north/
south utility easement in Block 8 & 9, South Creek Addition.
