AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE SEWER CAPITAL PROJECT FUND IN THE
AMOUNT OF $120,000.00 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF
EXECUTING A CONTRACT WITH WILLIAM J. SCHULTZ, INC. D/B/A CIRCLE
"C" CONSTRUCTION COMPANY FOR VILLAGE CREEK DRAINAGE BASIN
SANITARY SEWER SYSTEM REHABILITATION AND IMPROVEMENTS, PART
1 (CITY PROJECT NO. 00438); PROVIDING FOR A SEVERABILITY CLAUSE;
MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED. BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1
That in addition to those amounts allocated to the various City departments for Fiscal Year 2007-
2008 in the Budget of the City Manager, there shall also be increased estimated receipts and
appropriations in the Sewer Capital Projects Fund in the amount of $120,000.00 from available
funds, for the purpose of executing a contract with William J. Schultz, Inc. d/b/a Circle "C"
Construction Company for Village Creek Drainage Basin Sanitary Sewer System Rehabilitation and
Improvements, Part 1 (City Project No. 00438).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
ADOPTED AND EFFECTIVE: March 25, 2008
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the transfer of $120,000.00 from the Water & Sewer Operating Fund to the Sewer Capital
Project Fund;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriation in the Sewer
Capital Project Fund in the amount of $120,000.00, from available funds; and
3. Authorize the City Manager to execute a contract with William J. Schultz, Inc., d/b/a Circle "C"
Construction Company in the amount of $2,820,008.00 for Village Creek Drainage Basin Sanitary Sewer
System Rehabilitation and Improvements, Part 1.
DISCUSSION:
On November 7, 2000, (M&C C-18336) the City Council authorized the City Manager to execute an
engineering agreement with Wade & Associates, a CH2M HILL Company, for the Village Creek Drainage
Area Wastewater Collection System Evaluation Study.
This project, Part 1, consists of the replacement of sanitary sewer main M-188 beginning from the Plaza
Circle/E. Rosedale Street intersection easterly 2,300 feet, then southerly 1,000 feet to Truman Drive, then
southerly along Truman Drive to a point located 150 feet south and 50 feet east of the Ramey
Avenue/Truman Drive intersection.
The project was advertised for bid on November 8 and 15, 2007. On December 20, 2007, the following
bids were received:

In addition to the contract cost, $120,100 is included for survey, inspection and other construction related
tasks.

William J. Schultz, Inc., d/b/a Circle "C" Construction Company is in compliance with the City's M/VVBE
Ordinance by committing to 20 percent M/WBE participation. The City's goal on this project is 16 percent.
The project is located in COUNCIL DISTRICT 5, Mapsco 79M, R and 80N.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of
the Sewer Capital Projects Fund and the State Revolving Loan Fund.
