ORDINANCE NO. ~ [ (PJ
AN ORDINANCE AMENDING THE FORT WORTH CITY CODE (1964), AS
AMENDED, BY REPEALING CHAPTER 20A ("DEPARTMENT OF HOUSING
AND COMMUNITY DEVELOPMENT") AND ASSIGNING SAID DESIGNATION
CHAPTER 20A TO THE DEPARTMENT OF HOUSING AND HUMAN SER-
VICES HERETOFORE CREATED BY ORDINANCE NO. 8723, WHICH
ORDINANCE EFFECTIVELY REPEALED BY ITS PROVISIONS THE SAID
HOUSING AND COMMUNITY DEVELOPMENT DEPARTMENT AS BEING IN
CONFLICT THEREWITH; AMENDING SIMULTANEOUSLY THE NEW
CHAPTER 20A BY DELETING THEREFROM THE WORDS "EMPLOYMENT
AND TRAINING"; PROVIDING THAT THIS ORDINANCE SHALL BE
CUMULATIVE OF ALL ORDINANCES AND CODE PROVISIONS NOT
INCONSISTENT WITH THIS ORDINANCE; PROVIDING FOR A SEVERA-
BILITY CLAUSE; AND NAMING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That part of Ordinance No. 8006 creating a Chapter 20A
("Department of Housing and Community Development") of the Fort
Worth City Code (1964), as amended, is hereby repealed in its
entirety.
SECTION 2.
Ordinance No. 8723 of October 1, 1983 (Department of Housing
and Human Services) is hereby amended and recodified as Chapter 20A
of the Fort Worth City Code (1964), as amended, and after said
amendment said ordinance shall be and read as follows:
"CHAPTER 20A
DEPARTMENT OF HOUSING AND HUMAN SERVICES
"Section 20A-1. Department Establishment; Duties.
"There is hereby created a Department of Housing and
Human Services, which Department, under the supervision of
the Director of Housing and Human Services, shall be
responsible for executing programs of consumer affairs,
neighborhood facilities, housing and economic development,
and youth and elderly services. Subject to approval of
City Manager and City Council, the Department of Housing
and Human Services Department will provide for the admin-
istration of programs and expenditures of funds for hous-
ing and neighborhood revitalization, economic development,
commercial revitalization, consumer affairs, neighborhood
facilities, and youth and elderly services, with funds
received from donations, grants, or contracts, using both
private and public funds.
"Section 20A-2. Appointment of Director.
"The Director of Housing and Human Services shall
have charge of the Department. In addition to the duties
of Section 20A-1, the Director shall perform such other
tasks as may be assigned by the City Manager from time to
time for the purpose of promoting the well-being of the
citizens of the City of Fort Worth. The Director shall be

subject to the appointment and removal by the City
Manager. The salary of the Director shall be in accordance
with the compensation plan of the City.
"Section 20A-3. Advisory Boards.
"The City Council shall appoint Advisory Boards to
act in an advisory capacity to the City Manager and City
Council in conjunction with the Housing and Human Services
Department. The members of such Advisory Boards shall each
serve for designated terms, shall serve without compensa-
tion and may be removed at any time by the City Council.
"The Advisory Boards may recommend to the City
Manager and City Council plans for development of facili-
ties and services to meet the needs of the City. The
Boards will review and comment upon the proposed annual
operating budget and capital improvement program re-
quests. Recommendations made by the Boards will be
presented to the City Manager and the City Council for
consideration.
"The Director of the Housing and Human Services or
his authorized representative shall serve as the non-
voting Secretary of the Advisory Boards to the Depart-
ment. It shall be the duty of the Secretary to prepare and
be custodian of all necessary minutes and records."
SECTION 3.
This ordinance shall repeal every prior ordinance and provision
of the Fort Worth City Code in conflict herewith but only insofar as
any portion of such prior ordinance or provision shall be in con-
flict, and, as to all other ordinances or provisions of the Fort
Worth City Code not in direct conflict herewith, this ordinance
shall be, and is hereby, made cumulative.
SECTION 4.
It is hereby declared to be the intention of the City Council

that the sections, paragraphs, sentences, clauses, and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionally shall not affect any of the
remaining phrases, clauses, sentences, paragraphs or sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph, or section.

SECTION 5.

This ordinance shall be in full force and effect from and after
the date of its passage, and it is so ordained.

Background
In 1979, the City Council, by Ordinance No. 8006, created a Department of
Housing and Community Development. In 1983, a consolidation of the Human
Resources and Housing and Community Development Departments resulted in the
creation of a new Department of Housing and Human Services. Although Ordinance
No. 8723 creating the Department effectively repealed those provisions of
Ordinance No. 8006 which had created the Housing and Community Development
Department, the provisions were not formally repealed. As a result, the pub-
lished City Code still includes the obsolete provisions at Chapter 20A.
Proposal
Because the Department of Housing and Human Services has never been assigned a
City Code number, it is proposed that the old Housing and Community Development
Department provisions be formally 'repealed and the Code designation,
Chapter 20A, assigned to Housing and Human Services.
The proposed ordinance has been reviewed by the Department of Law and
the City Manager's office.
Recommendation
It is recommended that the City Council adopt an ordinance repealing the
existing Chapter 20A ("Housing and Community Development") designation and re-
assigning it to the Housing and Human Services Department.
