AN ORDINANCE CREATING A NEW DEPARTMENT OF EMPLOYMENT AND TRAINING; CREATING THE OFFICE OF DIRECTOR OF EMPLOYMENT AND TRAINING; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES AND CODE PROVISIONS NOT INCONSISTENT WITH THIS ORDINANCE; PROVIDING FOR A SEVERA- BILITY CLAUSE; AND NAMING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. There is hereby created a Department of Employment and Training to be codified as Chapter 20B of the Fort Worth City Code (1964), as amended, and said Chapter shall read as follows: "CHAPTER 20B DEPARTMENT OF EMPLOYMENT AND TRAINING "Section 20B-1. Department Establishment; Appointment of Director. "There is hereby created a Department of Employment and Training which Department is charged with planning, designing, implementing and evaluating employment and training programs for unemployed, underemployed and eco- nomically disadvantaged residents of the City. The Depart- ment shall be under the direction of the Employment and Training Programs Director which office is hereby creat- ed. The Director of said Department shall be subject to appointment and removal by the City Manager, who shall determine the classification and salary of the Director and the qualification of the person selected. The Director of Employment and Training shall be subjected to all per- sonnel rules and regulations governing employees appointed by the City Manager. Said Department and its Director shall be subject at all times to the provisions of Chapter VIII of the Fort Worth City Charter. "Section 20B-2. Duties. "The Director of Employment and Training shall have charge of the Department. In general, the duties and responsibil- ities of the Director shall require that he: 1. Supervise the development and implementation of employment and training programs; 2. Serve as the City of Fort Worth liaison with Federal, State and local agencies/groups and organizations; 3. Initiate and maintain necessary dialogue with private sector/business community to ensure that programs are designed to meet their employment needs; 4. Prepare and present periodic reports to the City Council and other City-appointed Boards or Committees as deemed. necessary; 5. Develop and manage the annual operating budget; 6. Perform other appropriate tasks assigned/directed by the City Manager or designee. "Section 20B-3. Appointment of Employees. r .~ "The Director of Employment and Training shall have the power to appoint, employ, make assignments, and remove staff within the department in accordance with established personnel policies and procedures as deemed necessary to accomplish departmental goals and objectives." SECTION 2. This ordinance shall repeal every prior ordinance and provision of the Fort Worth City Code in conflict herewith but only insofar as any portion of such prior ordinance or provision shall be in con- flict, and, as to all other ordinances or provisions of the Fort Worth City Code not in direct conflict herewith, this ordinance shall be, and is hereby, made cumulative. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitu- tional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionally shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph, or section. SECTION 4. This ordinance shall be in full force and effect from and after the date of its passage, and it is so ordained. Background The Private Industry Council (PIC) at its July 12, 1984 meeting voted to request that the City Manager take appropriate actions to establish a Department of Employment and Training The Job Training Partnership Act grant received from the State would cover the operating costs of the new Department. The position of Employment and Training Director would be established and the Director would report to the City Manager.
