HomeMy WebLinkAboutContract 45860-A1 AMENDMENT No. O 1 GI��` CTRET TO CITY SECRETARY CONTRACT No. 45860 WHEREAS, the City of Fort Worth (CITY) and Kleinfelder Inc. , (ENGINEER) made and entered into City Secretary Contract No. 45860, (the CONTRACT) which was authorized by M&C No. : C-26874 on the 22 day of July, 2014 in the amount of $ 153 , 834 . 50 ; and WHEREAS, the CONTRACT involves engineering services for the following project : N Como Ground Storage Tank Repair and Re-Painting Project; and r WHEREAS, it has become necessary to execute Amendment No. 01 to the ; CONTRACT to include an increased scope of work and revised fee. (iT NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: r. 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated March 04, 2016, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $9, 690. (See Attached Letter) 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $163, 524 . 50. 3 . All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect . EXECUTED and EFFECTIVE as of the date last written by a signatory, below. March 4, 2016 Kleinfelder Project No.: 20152103.001A Ms. Farida Goderya, PhD, PE Senior Project Manager Fort Worth Water Department 1000 Throckmorton Street Fort Worth, Texas 76102 SUBJECT: Como GST—Addition Construction Observation Phase Services Dear Ms. Goderya: The successful rehabilitation of the 6.0 MG Como Ground Storage Tank (GST) Repair and Re-painting Project was completed on Friday, March 4, 2016. It has been a pleasure to assist the City of Fort Worth staff with this COMO GST rehabilitation project. Kleinfelder along with the City of Fort Worth and contractor completed a final walkthrough on February 19, 2016 to review all the work that had been completed to date. Kleinfelder submitted the final punch list to the contractor that identified all the items that did not meet the Specification requirements and design plans. The contractor addressed all the comments, demobilized, and are off the site by Friday March 04, 2016. The disinfection for the GST occurred on Tuesday, March 01, 2016 and tank was put back in service as per my understanding. As you are aware, the original schedule for Como GST project was to be completed by November 4, 2015; however the final completion of the project did not occur until Friday, March 4, 2016. As evidenced by these dates the project schedule was extended by almost 4 months. As we have discussed previously, the duration of our construction observation phase services scope of services was also extended for an additional 4 months. Because of that extension of time our construction support services effort has surpassed the original contract amount due the following reasons: • Additional site visits to observe the construction progress. • Additional progress and site meetings. As mentioned in our recent conversations, we would like you to consider our request for an increase to our original construction support services budget in order to be compensated for those services provided throughout the extended construction period. We have reviewed our records and have identified dates and staff time expended during this extended construction period.
