ORDINANCE NO. ! ~ ~~
AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN-
GUISHING THE 7.5 FOOT WIDE EAST/WEST UTILITY EASEMENT
LOCATED ADJACENT TO THE SOUTH PROPERTY LINE OF LOT 31R,
BLOCK 3, PHASE 2, COUNTRYSIDE ADDITION; PROVIDING FOR
REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
THAT the 7.5 foot wide east/west utility easement located in
Lot 31R, Block 3, Phase 2, Countryside Addition, the southern bound-
ary line of said easement being parallel and colinear with the com-
mon property line of Lots 31R and 32R, Block 3, Phase 2, Countryside
Addition, extending from Cuculu Drive eastward 110 feet to a point
five (5) feet from said Lot 31R's southeast corner, be and the same
is vacated, abandoned and permanently closed and extinguished as a
public utility easement.
SECTION 2.
That the fee to the land in the above described vacated public
utility easement is hereby released and shall revert to the adjacent
owner as provided by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

Homecraft Land Development, Inc., owner of all abutting property, has requested
that City vacate the 7.5'' wide east/west utility easement in and between lots
31R and 32R, Block 3, Phase 2, Countryside Addition, from Cuculu Drive eastward
110' along and 7.5' parallel and colinear with the south property line of Lot
31R to a point 5' from said Lot 31R's southeast corner, as shown on the attached
map
The subject utility easement, acquired by dedication, is platted but contains
no utility facilities. The subject vacation request is made in order to in-
corporate the vacated easement area with adjacent property, thus expanding
the building area and providing more usable yard. space.
It is the opinion of the Real Property Department that the interest of the
City in the subject utility easement described in this vacation request has
no monetary value to the City if same is vacated
Reviewing City departments and private utility companies have raised no
objections to this request.
RECOMMENDATION
It is recommended that the City Council adopt an ordinance vacating the 7 5'
wide east/west utility easement in Lots 31R and 32R, Block 3, Phase 2, Country-
side Addition.
