If ORDINANCE NO. ~~~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING THE 2800-3000 BLOCKS OF GRACE STREET, A 50-FOOT WIDE PUBLIC STREET RIGHT-OF-WAY, FROM PREMIER STREET SOUTH TO KIMBO ROAD; PROVIDING FOR RETENTION OF UTILITY EASE- MENTS FOR EXISTING AND PROSPECTIVE UTILITIES IN SAID LAND; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFEC- TIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the 2800-3000 blocks of Grace Street, a 50-foot wide pub- lic street right-of-way, from Premier Street south to Kimbo Road, be and the same is vacated, abandoned and permanently closed and extin- guished as a public street right-of-way. SECTION 2. That the fee to the land in the above described vacated public street right-of-way is hereby released and shall revert to the adja- cent owners as provided by law, SAVE AND EXCEPT that easements are retained for any and all existing and prospective utilities. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. SERVICES. 2 AE.VELOPMEIdfw Schell Properties, with the written consent of all abutting property owners, has requested that the City vacate the 2800-3000 blocl~:s of Grace Street a width of JAyCsYI 50' from Premier Street southward to Kimbo Road. The subject street right-of-way, acquired by dedication, is open on the ground and contains water, sewer, storm drainage, electric, and telephone utility facilities. 'he subject vacation request has been submitted in order to permit the replatting of the vacated right-of.-way with abutting property, so that the building area on the abutting property can be expanded and more usable yard space can be provided, including off_street parking area. It is the opinion of the Real Property Department that the reasonable value of the rights; title, and interest of the City in the land area comprising the Grace Street right-of-way, extending from Kimbo Road to Premier Street and containing a total of 68,000 sq ft, of land area, constitutes a total consideration of $15,000 when said right-of-way is vacated and closed to the use of the general public. The aforementioned monetary consideration has been placed in escrow in accordance with information received from the Real Property Department Mr Bob Bailey, representing the applicant, has requested by letter that this compensable interest be waived and the monetary consideration refunded. A copy of the letter is contained in the file of this case and is attached to this communication Under the existing City policy, staff believes that $15,000 is a reasonable and fair consideration and in the opinion of the Department of Law, a o~mplete waiver would not be permissable. The applicant's representative has also requested that the required replatting of the east half of the previously described Grace Street right-of-way be delayed to permit Tarrant County to carry out required procedures relative to their interest in the east half of said right-of-way This can be accomplished only after the City of Fort Worth has officially vacated the subject right-of-way. The Plan Com- mission has recommended that the replat required for the east half of the right-of• way be waived as requested Other reviewing City departments, private utility companies, and pertinent parties have raised no objections to this request, sub- ject to the west half of the right-of-way being replatted with adjacent property and the entire right-of-way (both halves), being retained as utility easements for the existing utilities A satisfactory replat, retaining and dedicating, as appro priate, the necessary utility easements, has been submitted. All other require- ments have been complied with.
