HomeMy WebLinkAboutOrdinance 18035-04-2008Ordinance No. 18035-04-2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GENERAL FUND IN THE AMOUNT OF $68,528.26 FROM THE DISTRIBUTION OF PROCEEDS FROM PRIOR SURPLUS PROPERTY SALES DESIGNATED FOR THE FORT WORTH PARTNERSHIP FOR COMMUNITY DEVELOPMENT FOR THE PURPOSE OF PARTIALLY FUNDING THE SECOND YEAR'S SCOPE OF SERVICES UNDER A PROFESSIONAL SERVICES AGREEMENT WITH THE FORT WORTH PARTNERSHIP FOR COMMUNITY DEVELOPMENT; PROVIDING FOR SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2007- 2008 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the General Fund in the amount of $68,528.26 from the distribution of proceeds from prior surplus property sales designated for the Fort Worth Partnership for Community Development for the purpose of partially funding the second year's scope of services under a Professional Services Agreement with the Fort Worth Partnership for Community Development. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct .conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the extension of City Secretary Contract No. 34839, Professional Services Agreement with the Fort Worth Partnership for Community Development executed on January 29, 2007; 2. Authorize execution of a Professional Services Agreement with the Fort Worth Partnership for Community Development to expire on the earlier of the date all services are completed by Fort Worth Partnership for Community Development or January 28, 2009, for the purposes outlined below; 3. Adopt the attached supplemental appropriation ordinance increasing estimated receipts and appropriations in the General Fund in the amount of $68,528.26; and 4. Authorize stafF to proceed with the sale of additional warranty-deed surplus property to fulfill the balance of Year 2 commitment which is $206,471.74. DISCUSSION: The Fort Worth Partnership for Community Development (FWPCD) is a local funding intermediary that pools private and public financial resources to sustain and grow the impact and capacity of community development organizations and advocates for the community development industry. On January 29, 2007, the City of Fort Worth entered into City Secretary Contract No. 34839 with the FWPCD to provide professional consulting services to assist certain Fort Worth community-based development organizations in providing comprehensive community economic development and diverse, focused activities that produce housing units and create and retain jobs, and completing other comprehensive projects that result in substantial, measurable improvements in the quality of life in low and moderate income neighborhoods. On November 6, 2007, the FWPCD briefed the Central City Revitalization and Economic Development Committee of the City Council on its performance against first-year benchmarks. Accomplishments include: Leadership and Organization Structure: The Board of Directors was expanded to five members, and is currently seeking additional members who will provide financial and leadership support. After an initial national search, the Board chose an Interim Director to help achieve its goals while a second search was launched. The permanent President/CEO was hired in January 2008. The organization received its IRS designation and has adopted six-month and twelve-month objectives for the year ahead. Financial management and policy infrastructure are in place. Logname: OSFWPCDYR2 Page 1 of 2 Fund Development: The sale of a city-owned property provided the City's first year funding commitment of $250,000. Two local foundations, the Amon Carter Foundation and the Sid Richardson Foundation, have committed $400,000 over athree-year period. The President of the Board of Directors is actively seeking corporate funding support. The U. S. Department of Housing and Urban Development (HUD) provided a technical. assistance grant through the City to provide business planning coaching for candidate non-profit organizations. Program Delivery Organization self-assessments were conducted with local community development organizations. Participants completed business plans through the HUD technical assistance grant. The development of a pool of experts was initiated, who will provide technical assistance through the FWPCD to local community development organizations. A grant process was formalized resulting in the award of operating grants to the first three successful organizations. Year 2 performance benchmarks include: 1. Expansion of the Board of Directors by two members; 2. Raise $200,000 in corporate gifts for the financial support of the FWPCD and its goals; 3. Complete the financial audit of Year 1 operations; 4. Transition of operations to the new President/CEO of the FWPCD; 5. Operations infrastructure development including payroll and insurance for its employees; 6. Deliver technical assistance and training to grantees and to other nonprofit development organizations with in-place but more nascent capacity; and 7. Conduct Year 2 grant selection process and award. Contingent on successful annual benchmark performance and financial and organizational reporting requirements, the City committed to a three-year funding of $800,000 consisting of $250,000 in Year 1 and $275,000 in each of Years 2 and 3. Council directed staff to fund Year 1 and Year 2 through the sale of City-owned surplus properties. To date $318,528.26 has been raised toward that two-year commitment ($525,000) through surplus property sales authorized by M&C L-14280, M&C L-14281, and M&C L- 14203. A disbursement of $75,000 has been made and a request for disbursement of an additional $175,000 has been processed. Council action authorizing distribution of the remaining proceeds of $68,528.26 to the FWPCD is sought in this Council action. The extension of the previous Professional Services Agreement with FWPCD authorizes the disbursement of future surplus property sale proceeds designated for the FWPCD as they become available, the total of which not to exceed $525,000. Staff will continue its effort to identify additional properties to raise the remaining $206,471.74 of the Year 2 commitment. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the attached supplemental appropriation ordinance, funds will be available in the General Fund.
