AN ORDINANCE CLOSING AND VACATING A PORTION OF SUNSET TERRACE AND THE UTILITY EASES ADJACENT TO LOTS 3, 45 5, 6, 7, 8, 9, 10, 11, 12 AND 15, ALL IN INDIAN HILL VILLAGE, AN ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE i n&DIATELY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the following described portion of Sunset Terrace, in Indian Hill Village, an addition to the City of Fort Worth, Tarrant County, Texas, be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever: That portion of Sunset Terrace between the northwest line of the East-West Freeway and a line drawn from the most easterly corner of Lot 15 to a point in the north- westerly line of Lot 16, 53 feet northerly from and 30 feet easterly from the most southerly southwest corner of said'Lot 16. That the ten foot utility easements adjacent to Lots 3, 4, 5, 6, a 7, 8, 9, 10, 11, 12 and 15, Indian Hill Village, an addition to the City of Fort Worth, Tarrant County, Texas, be and the same are hereby extinguished, vacated, closed and permanently abandoned as easements for public utilities. SECTION 2. That the fee to the land in said street and in said easements above described is hereby released and will revert to the owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and ef- fect from and aver the date of its passage. Marc 17, 1954 Mr. W. 0. Jones Re: Request for Closing a Portion City Manager of Sunset Terrace and Certain Building Utility Easements, Indian Hill Village. Dear Sir: Attached is a letter dated March 16, 1954, from Reverend Walter E. Dorre, Pastor of St. Paul Lutheran Church, requesting the closing of a portion of Sunset Terrace near the East-West Freeway and the 10-foot utility -easements within the boundaries of their property in Indian Hill Village. We are attaching a plat which shows the property that these people own and the portion of Sunset Terrace and the utility easements they wish to close. These people are constructing an expensive church on this tract of land. Reverend Dorre states that if his request is granted that they plan to open a driveway approach from Sunset Terrace to the Service Drive of the Fast-driest Freeway across Lot 16 which will provide an outlet for the other owners in this block. We have checked this request on the ground and as far as we are con- cerned we see no reason why the closing should not be granted. Sunset Terrace cannot be opened into the service drive of the Freeway at its present location as it is some 10 or 12 feet above Freeway service drive. There are no utilities in the portion of the street that they wish to close or in the utility easements within their property. Our recommendation is that that portion of Sunset Terrace between the northwest line of the East-West Freeway and a line drawn from the most easterly corner of Lot 15 to a point in the northwesterly line of Lot 16 53 feet northerly from and 30 feet easterly from the most southerly southwest corner of said Lot 16, and the utility easements adjacent to Lots 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, and 15, all be closed as requested. DORRE, Pastor 310 West Cannon Fort Worth 4, Texas March 29, 1954 City of Fort Worth Engineering Department Fort Worth, Texas Attention Mr. Thelin Dear Mr. Thelin: With reference to the protests regarding parking at our new church property now under development, I am happy to give you the following resume of the outcome of conversations with the parties in- volved. I called on Mrs. Roy E. Worley of 1305 Smilax, who is the owner of the property at 1705 Sunset Terrace. Mrs. Worley was very much disturbed about the protests of her tenants regarding the parking that went on at our Ground-breaking Services. After apologizing to Mrs. Worley for this annoyance and ex- plaining to her that we are providing parking facilities on our pro- perty, also providing entrance and exit from and to the service road running parallel to the East-?pest Expressway, she was very pleased that Sunset Terrace would not be used for parking nor as an entrance to the property. In fact, when Mr. Lane, the architect, and I left her home she wished us well in the building of our church. I also talked with Mr. Trentman, owner of the property at 1711 Sunset Terrace, over the telephone regarding the entire parking situation and he suggested we talk to his tenant Mrs. M. A. Handy who also protested to your office. I then talked with Mrs. Handy on two different occasions at her home and in eachinstance she was very courteous and remarked that she was happy that we were building the church at this location. However, she objected to our using the land immediately south of her home as a parking lot. We could sympathize with her objection and after assuring her that we had changed our plans and would not park in this area but cut it down for landscaping and beautification, she was also very pleased and thanked us for our consideration. All of the parties we called on were very considerate and we are sure they all now are very much in accord with the plans of our project. Yours very truly, WFB/d /s/ W. F. DQRRE, Pastor, 310 West Cannon, Fort Worth 4,Texas March 16, 1954 City of Fort Worth Engineering Department Fort Worth, Texas Gentlemen: St. Paul's Evangelical Lutheran Church is the owner of lots 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 15 and 16 of Indian Hill Village, 2nd Filing. Lots 5 to 12 and lot 16 front on the East-West Freeway. However, Sunset Terrace divides our property between lots 12 and 15 on the West and lot 16 on the East. We therefore humbly petition that Sunset Terrace be closed from the auxiliary street of the Freeway to the north- east line of lot 15 and that this line be extended to lot 16. If this our petition is granted, we shall open an en- trance through lot 16 which would then be a direct approach to Sunset Terrace, and would afford an opening for the few home owners fronting on Sunset Terrace. If this is done, then we would develop our property so that private parking for some 100 cars would be available. We further petition that all utilities easements within the confines of our property be cancelled. ST.
