HomeMy WebLinkAboutOrdinance 9183~~ t :,y, x ORDINANCE NO. ~ ~/~~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING CERTAIN PUBLIC UTILITY EASEMENTS LOCATED IN AND BETWEEN LOTS 14, 15, AND 20, BLOCK 1, MCGEE PLACE; PRO- VIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFEC- TIVE DATE. BE T'I' ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXA5: SECTION 1. THAT the following be and the same are vacated, abandoned and permanently closed and extinguished as public utility easements: A. The 10-foot wide east/west utility easement located in and between Lots 14, 15 and 20, Block 1, McGee Place, beginning at a point 5 feet east of the north- west corner of said Lot 14, and extending eastward 134.2 feet along, collinear with, and 5 feet on either side of the common property line of said Lots 14, 15 and 20, to the southeast corner of said Lot 20; B. The 10-foot wide north/south utility easement located in and between Lots 15 and 20, Block 1, McGee Place, beginning at the southeast corner of said Lot 20 and extending 63 feet northward along, collinear with, and 5 feet on either side of the common property line of said Lots 15 and 20, to the northwest corner of said Lot 20; C. The 5-foot wide east/west utility easement located adjacent to and south of the north property line of Lot 15, Block 1, McGee Place, beginning at the north- west corner of said Lot 15 and extending 55 feet eastward to the west right-of-way line of a 5-foot wide north/south utility easement; and D. The 10-foot by 15-foot utility easement located in Lot 15, Block 1, McGee Place, as shown on plat re- corded in Volume 388-P, Page 56, Plat Records, Tarrant County, Texas. SECTION 2. That the fee to the lands in the above described vacated public utility easements is hereby released and shall revert to the adja- cent owner as provided by law. SECTION 3. Post 8235, owner of all abutting property, has requested that the City vacate the following: (1) The 10' wide east/west utility easement in and between Lots 14, 15 and 20, Block 1, McGee Place, beginning at a point 5' east of the northwest corner of said Lot 14, extending eastward 134 2' along, 5' on either side of and collinear with .the common property line of said Lots 14, 15 and 20, to the southeast corner of said Lot 20, (2) The 10' wide north/south utility easement in and between Lots 15 and 20, Block 1, McGee Place, beginning at the southeast corner of said Lot 20, ex- tending 63' northward along, 5' on either side of and collinear with the common property line of said :Lots 15 and 20, to the northwest corner of said Lot 20, (3) The 5' wide east/west utility easement in Lot 15., Block 1, McGee Place, beginning at the northwest corner of said Lot 15, extending 55' eastward along, 5' south of and collinear with the north property line of said Lot 15, to the west right-of-way line of a 5' wide north/south utility easement;. and , (4) The 10' x 15' wide utility easement in Lot 15, Block 1, McGee Place, as recorded in Vol. 388-P, Page 56, P.R.T C.T. All of the above-mentioned utility easements are as shown on the attached map. The subject utility easements, acquired by dedication, are platted but contain no utility facilities. The subject vacation request is made in order to consolidate the vacated easement rights-of-way with adjacent property, thus expanding the building area and providing more usable yard space. It is the opinion of the Real Property Department that the interest of the City in the subject utility easements described in this vacation request has no mone- tary value to the City, if same are vacated.
