ORDINANCE NO.
AN ORDINANCE PRESCRIBING AYD LEVYING CER-
TAIN OCCUPATION TAXES OR LICENSE FEES FOR
PERSONS, FIRMS, CORiIORATIONS OR ASSOCIATIONS
OF PERSONS AUTHORIZED BY THE STATE OF TEXAS
TO ENGAGE IN THE MANUFACTURE, SALE OR DIS-
TRIBUTION OF ALCOHOLIC LI;�UORS, VINOUS OR
MALT BEVERAGES; nkKING A VIOLATION OF THE
PROVISIONS THEREOF A MISDEMEANOR AND %ROVID-
ING A PENALTY FOR THE VIOLATION THEREOF;
AND REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES PERTAINING TO THE SAME SUBJECT-
MATTER.
PREAMBLE
?WHEREAS, by virtue of the terms of House Bill Number
77, duly passed by the Forty-fourth Legislature of the State of
Texas , the City of Fort Worth was authorized to levy and collect
from every person that may be given a license by the State to
manufacture, sell or distribute alcoholic liquors or vinous or
malt beverages a fee equal to one-half (1/2) of the fee paid
the State of Texas, NOW, THEREFORE,
BE I^1 ORDAINED BY THE CITY COUNCIL OF TIS CITY OF
FORT WORTH, TEXAS :
SECTION I.
That there is hereby levied and assessed and shall be
collected from every person, firm, corporation or association of
persons pursuing or that may pursue, within the corporate limits
of the City of Fort 'North, Texas, the business of selling alco-
holic liquors defined in Article I. Section 15, of said House Bill
Number 77, passed by the Forty-fourth Legislature, as follows :
(a) From the holder of each `Brewer' s Permit, " as de-
fined and required by the terms of the above mentioned
act of the Legislature, domiciled in the City of Fort
Worth and carrying on business therein under such per-
mit, an annual tax or fee of five hundred dollars
($500.00) for each such permit.
(b) From the holder of each "Distillerts Permit, " as
defined and required by the terns of such act, domi-
ciled in the City of Fort 'North and carrying on busi-
ness therein under such permit, an annual tax or fee
of five hundred dollars (4500.00) for each such permit,
(c) From the holder of each 'Winery Permit," as de-
fined and required by the terms of such act, domiciled
in the City of Fort "North and carrying on business
therein under such permit, an annual tax or fee of
twenty-five dollars ($25.00) for each such permit.
Provided, however, there is not included herein nor
covered hereby the holder of a Class "B" 'vinery Per-
mit as defined in such act.
(d) From the holder of each "Rectifier' s Permit,t'
as defined and required by the terms of such act,
domiciled in the City of Fort 'Worth and carrying on
business therein under such permit, an annual tax
or fee of five hundred dollars (�p500.00) for each
such permit.
(e ) From the holder of each "18holesaler's Permit,"
as defined and required by the terms of such act,
domiciled in the City of Fort Vilorth end carrying
on business therein under such permit, an annual
tax or fee of six hundred and twenty-five dollars
($625.00) for each such permitp
7f) From the holder of each "Beer and 'bine Whole-
saler's Permit, " as defined and required by the
terms of such act, domiciled in the City of Fort
'North and carrying on business therein under such
permit, an annual tax or fee of fifty dollars
(450.00) for each such permit,
(g) From the holder of each "Package Store Permit,"
as defined and required by the terms of such act,
domiciled in the City of Fort Worth and carrying
on business therein under such permit, an annual
tax or fee of one hundred and twenty-five dollars
($125.00). Provided that the annual tax or fee from
the holder of a "Package Store PermitS4 to sell win_ e
only shall be six and 25/100 dollars ($6.25) f6r
each permit.
(h) From the holder of each "`'dine and Beer Retailer' s
Permit, " as defined by the terms of such act, domi-
ciled in the City of Fort Worth and carrying on bus-
iness therein under such permit, an annual tax or
fee of fifteen dollars ($15.00) for each such permit.
SECTION II.
That there is hereby levied and assessed and shall be
collected from every person, firm, corporation or association of
persons pursuing or that may pursue, within the corporate limits
of the City of Fort Worth, Texas, the business of selling vinous
or malt beverages as defined in Ijouse Bill Number 77, Article II,
Section 5, passed by the Forty-fourth Legislature, as follows:
(a) From the holder of each "Manufacturer' s or Brewer's
Permitil " as defined and required by the terms of the
above mentioned act of the Legislature, domiciled in
the City of Fort Worth and carrying on business there-
under under such permit, an annual tax or fee of two
hundred and fifty dollarw ($250.00) for such permit.
(b) From the holder of each "General Distributor's
Permit, " as defined and required by the terms of the
above mentioned act of the Legislature, domiciled in
the City of Fort VjTorth and carrying on business there-
under under such permit, an annual tax or fee of one
hundred dollars (. 100.00) for such permit.
(c) From the holder of each "Local Distributor's Per-
mit," as defined and required by the terms of the
above mentioned act of the Legislature, domiciled
in the City of Fort Worth and carrying on business
thereunder under such permit, an annual tax or fee
of twenty-five dollars ($25.00) for such permito
(d) From the holder of each "Retailer' s Permit," as
defined and required by the terms of the above men-
tioned act of the Legislature, domiciled in the City
of Fort Worth and carrying on business thereunder
under such permit, authorizing the sale of beer by
retail dealer for consumption on or off the premises
where sold, an annual tax or fee of twelve and 50/100
dollars (412.50) for such permit.
(e ) From the holder of each "Retailer' s Ferriit, " as
defined and required by the terms of the above men-
tioned act of the Legislature, domiciled in the City
of Fort T',orth and carrying on business thereunder
under such permit, authorizing the sale of beer by
retail dealer in the original container direct to
the consumer, but not for resale, and not to be con-
sumed on the premises where sold, an annual tax or fee
of five dollars (45.00) for such permit*
SECTION III.
Upon the payment of the applicable tax or fee herein
prescribed to the Tax Assessor and Collector and exhibition to
him of a permit duly issued by the State of Texas to the appli-
cant or person paying such tax or fee , the Tax Assessor and Col-
lector shall in the name of the City of Fort Worth issue and de-
liver to such applicant or person a permit to engage in the busi-
ness in the City of Fort :North of the character described in and
authorized by the permit from the State of Texas held by such
applicant or person, and the permit so issued in the name of the
City of Fort Worth shall authorize the conduct of such business
upon the premises described in the permit from the State of Texas,
and shall remain in force only so lona as such permit from the
State of Texas remains in force.
SECTION IV.
Any person, firm or corporation who shall fail to pay
any tax or fee prescribed in Sections I and II hereof and secure
a permit before engaging in any business for which the payment
of any such fee and securing of any such permit is required by
the terms of this ordinance, or who shall engage in any such bus-
iness without holding an unrevoked or unexpired permit from the
City of Fort Worth authorizing the same shall be deemed guilty
of a misdemeanor and upon conviction shall be punished by fine
in any amount not exceeding Two Hundred Dollars ($200.00).
SECTION V.
All ordinances and parts of ordinances pertaining to
the same subject-matter as this ordinance are hereby repealed;
and this ordinance shall take effect and be in full force and
effect from qnd after the date of its passage and publication,
as required by law.
