HomeMy WebLinkAboutOrdinance 9264 ORDINANCE N0. `~~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING THE 10-FOOT WIDE UTILITY EASEMENTS LOCATED PARAL- LEL AND COLLINEAR WITH THE COMMON LOT LINES OF LOTS 30 AND 31, BLOCK 12, LINCOLNSHIRE ADDITION, PHASE IA, AND LOTS 41 AND 42, BLOCK 12, LINCOLNSHIRE ADDITION, PHASE IA; PROVID- ING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFEC- TIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the 10-foot wide utility easements located parallel and collinear with the common lot lines of Lots 30 and 31, Block 12, Lincolnshire Addition, Phase IA, and Lots 41 and 42, Block 12, Lincolnshire Addition, Phase IA, said easements being more particu- larly described by metes and bounds in Exhibit "A", attached hereto and incorporated herein, be and the same are vacated, abandoned and permanently closed and extinguished as public utility easements. SECTION 2. That the fee to the lands in the above described vacated public utility easements is hereby released and shall revert to the adja- cent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. Herrera Survey, Abstract No. 2027, City of Fort Worth, Tarrant County, Texas, said easement being out of Lincolnshire Addition, Phase IA as recorded in Volume 3$8-171, Pages 77 and 78 of the Tarrant County Plat Records and being more particularly described as follows: COMMENCING at the Southeast corner of Lot 42, Block 12 of said Lincolnshire Addition, Phase IA said point also being in the North line of Woodhall Way, a 50' right-of-way and the West line of Horncastle Street, a 50' right-of-way; THENCE along the West line of said Horncastle Street along a curve to the right having a radius of 361.83 feet with a central angle of 15 degrees 17 minutes 08 seconds, an arc distance of 96.53 feet to the point of beginning; THENCE North 85 degrees 06 minutes 35 seconds West ~a distance of 57..19 feet; THENCE North 00 degrees 15 minutes 24 seconds East a distance of 10.03 feet; THENCE South 85 degrees 06 minutes 35 seconds East a distance of 60.03 feet to a point in the West line of said Horncastle Street said point being on a curve to the left; THENCE along said curve to the left having a radius of 361.83 feet and a central angle of O1 degrees 36 minutes 57 seconds whose chord bears South 16 degrees 21 minutes 00 seconds West an arc distance of 10.20 feet to the POINT OF BEGINNING and containing 0:013 acres more or less. West along the West line of said Lot 30 a distance of 95.00 feet; THENCE North 62 degrees 06 minutes 23 seconds East a distance of 10.00 feet; THENCE South 27 degrees 53 minutes 37 seconds East a distance of 95.00 feet to a point in the North line of said Horncastle Street; THENCE South 62 degrees 06 minutes 23 seconds West along the North line of said Horncastle Street a distance of 10.00 feet to the POINT OF BEGINNING and containing 0.022 acres more or less. The two subject utility easements are as shown on the attached map. The subject utility ,easements, acquired by dedication, are platted but contain no utility facilities. The subject vacation request is made in order to incorporate the vacated rights-of-way with adjacent property, thus expanding the building area and providing more usable yard space. It is the opinion of the Real Property Division that the interest of the City in the subject utility easements described in the vacation request have no monetary value to the City if they are vacated.
