~ ^3 .----
Mr Richard James Sallie, with the written consent of all abutting property owner
has requested that the City vacate the 10' wide north/south utility easement in
and between Lots 1 and 2, Northcut Addition, from Menzer Road northward 92.5' to
Brentwood Stair Road, as shown on the attached map.
The subject utility easement, acquired by dedication, is platted but contains no
utility facilities. The subject vacation request is made in order to replat the
vacated easement right-of-way with adjacent property, thus expanding the building
area and providing more usable yard space.
It is the opinion of the Real Property Division that the rights and interest of
the City in the utility easement denoted in this request has no monetary value,
if vacated.
Reviewing City departments and private utility companies have raised no objections
to this request, and a satisfactory replat has been submitted.
Recommendation
It is recommended that the City Council adopt an ordinance vacating the 10' wide
north/south utility easement in and between Lots 1 & 2, Northcut Addition.
