HomeMy WebLinkAboutOrdinance 9265~. . ,, _ .g _• ORDINANCE NO. ~.~(~ AN ORDINANCE VACATING, ABANDONING AND CLOSING AND EXTIN- GUISHING THE 10-FOOT WIDE NORTH/SOUTH UTILITY EASEMENT LOCATED IN AND BETWEEN LOTS 1 AND 2, NORTHCUT ADDITION, FROM MENZER ROAD NORTHWARD 92.5 FEET TO BRENTWOOD STAIR ROAD; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEAL° ING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the 10-foot wide north/south utility easement located in and between Lots 1 and 2, Northcut Addition, from Menzer Road north- ward 92.5 feet to Brentwood Stair Road, be and the same is vacated, abandoned and permanently closed and extinguished as a pubic utii- ity easement. SECTION 2. That the fee to the land in the above described vacated public utility easement is hereby released and shall revert to the adjacent owners as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- ~, . dained. PROPS ~rVFLOPMET DATE I'~ 5 REFERENCE NUMBER SUBJECT Vacation of Utility Easement: PAGE 12 / 11 / 84 **PZ-1320 Northcut Addition, Lots 1 and 2 (V-83-74) > of 1 ~ ^3 .---- Mr Richard James Sallie, with the written consent of all abutting property owner has requested that the City vacate the 10' wide north/south utility easement in and between Lots 1 and 2, Northcut Addition, from Menzer Road northward 92.5' to Brentwood Stair Road, as shown on the attached map. The subject utility easement, acquired by dedication, is platted but contains no utility facilities. The subject vacation request is made in order to replat the vacated easement right-of-way with adjacent property, thus expanding the building area and providing more usable yard space. It is the opinion of the Real Property Division that the rights and interest of the City in the utility easement denoted in this request has no monetary value, if vacated. Reviewing City departments and private utility companies have raised no objections to this request, and a satisfactory replat has been submitted. Recommendation It is recommended that the City Council adopt an ordinance vacating the 10' wide north/south utility easement in and between Lots 1 & 2, Northcut Addition.
