ORDINANCE No. ~~ ~~
AN ORDINANCE AMENDING CHAPTER 2, ARTICLE V, "RULES FOR
CERTAIN CITY BOARDS°', OF THE CODE OF THE CITY OF FORT
WORTH TO AMEND SECTION 2-34.3 THEREOF TO CHANGE THE
PROCEDURE FOR REMOVAL OF BOARD MEMBERS; TO CLARIFY CERTAIN
PROVISIONS OF SECTION 2-35.2 THEREOF CONCERNING EXCEPTIONS
TO THE GENERAL RULES ADOPTED IN ARTICLE V; PROVIDING A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES AND REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; PROVIDING AN EFFECTIVE DATE; AND. PROVIDING FOR
ENGROSSMENT AND ENROLLMENT OF THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Section 2-34.3 of Article V of Chapter 2 of the Code of
the City of Fort Worth, Texas (1964), as amended, be, and is hereby
amended to read as follows:
"Sec. 2-34.3. Report To City Council; Removal of Board
Members.
At the next City Council meeting after a report under
Sec. 2-34.2 is received, the City Secretary shall report
such information to the City Council, in writing. The City
Secretary shall notify each affected board member in
writing, that a report of absences has been made to the
City Council. If the City Secretary receives another
report as specified in Sec. 2-34.2, the City Secretery
shall make another report to the City Council, and shall
notify the affected board member, in writing, that he or
she has been removed from the board. That member's place
shall be declared vacant automatically° and shall be
included in the next regular listing of board vacancies."
SECTION 2.
That Section 2-35.2 of Article V of Chapter 2 of the Code of
the City of Fort Worth, Texas (1964), as amended, be, and is hereby
amended to read as follows:
"Sec. 2-35..2. Exceptions.
"a) Those boards excepted from the provisions of this
section regarding the number of members serving on the
board because of conflicting state or federal law, city
charter provision or City Council exception shall include
currently, but shall not be limited to, the following:
Board of Adjustment - State law exception
Civil Service Commission - State law exception
Dallas-Fort Worth Regional Joint Airport Zoning Board
- State law exception
Meacham Field Joint Airport Zoning Board - City
Council exception (ordinance}
Dallas-Fort Worth Regional Airport Board - State law
exception
Board of Commissioners of the Fort Worth Housing
Authority - State law exception

of conflicting state or federal law, city charter
provision or City Council exception shall include
currently, but shall not be limited to, the following:

"c) Those boards exempted from the provisions of this
section regarding the limitation on the number of terms
which may be served, because of conflicting state law,
city charter provision or City Council exception shall
include currently, but shall not be limited to, the
following:
Board of Trustees of the Employee Retirement Fund -
City Council exception (ordinance)."
SECTION 3.
This ordinance shall be cumulative of all provisions of ordi-
nances and of the Code of the City of Fort Worth, Texas (1964), as
amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in
which event conflicting provisions of such ordinances and such Code
are hereby repealed.
SECTION 4.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.

SECTION 5.
The City Secretary of the City of Fort Worth, Texas, is hereby
authorized to publish this ordinance in pamphlet form for general
distribution among the public, and the operative provisions of this
ordinance as so published shall be admissible in evidence in all
courts without further proof than the production thereof, as pro-
vided in Chapter XXV, Section 3, of the Charter of the City of Fort
Worth, Texas.
SECTION 6.
The City Secretary of the City of Fort Worth is hereby directed
to engross and enroll this ordinance by copying the caption and
effective date in the minutes of the City Council and by filing the
ordinance in the ordinance records of the City.
SECTION 7.
This ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

staff has drafted an ordinance amending the present role (City Code, Chapter 2,
Section 2-34.3) with regard to the absences of board/carrrnission members frcaYn
meetings of the various City boards and commissions.
Currently, this section stipulates the following: "At the next City Council
meeting after a report under Section 2-34.2 is received, the City Secretary
shall report such information to the City Council in writing. When the
absences of any board member are reported to the City Council, the City Council
shall, by the next regular City ~uncil meeting, take action to retain such
board member. Should no such action be taken, the position filled by such
board member shall be declared vacant. The .City Secretary shall notify such
board member, in writing, of his or her removal. The City Secretary shall
include the vacancy in the next regular listing of board vacancies." (Ord. No.
8758, 1, March 1.5, 1983)
The proposed amendment stipulates the following: At the next City Council
meeting after a report under Sec. 2-34.2 is received, the City Secretary shall
report such information to the City Council, in writing. The. City Secretary
shall notify each affected board member in writing, that a report of absence
has been made to the City Council. If the City Secretary received another
report as specified in Sec. 2-34.2, the City Secretary shall make another
report to the City Council, and shall notify the affected board member, in
iting, that he or she has been removed frown the board. That member's place
shall be declared vacant automatically and shall be included in the next
regular listing of board vacancies."
In addition, an amendment to City Code, Sec. 2-35.2 has been drafted to clarify
the exception to the general provision with regard to the number of members and.
length of terms of service on boards and commissions. The amendment will
specifically list those boards which are comprised of fewer or more than nine
rs, and those with terms of service more or less than two years.
