HomeMy WebLinkAboutOrdinance 22252-06-2016 ORDINANCE NO. 22252-06-2016 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF$298,600.00,FROM AVAILABLE FUNDS,FOR THE PURPOSE OF FUNDING THE INTER-LOCAL AGREEMENT WITH THE CITY OF LAKE WORTH FOR THE DESIGN AND CONSTRUCTION OF THE COMANCHE TRAIL BRIDGE; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2015-2016 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Water Capital Projects Fund in the amount of$298,600.00, from available funds, for the purpose of funding an Inter-Local Agreement with the City of Lake Worth for the Design and Construction of the Comanche Trail Bridge. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 21873-09-2015 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached Appropriation Ordinance increasing estimated receipts and appropriations in the Water Capital Projects Fund in the amount of$298,600.00 from available funds; and 2. Authorize an Inter-local Agreement with the City of Lake Worth for the design and construction of the Comanche Trail Bridge within Fort Worth City limits between Marina Drive and Malaga Drive in an amount not to exceed $1,348,600.00. DISCUSSION: On February 12, 2002, the City of Fort Worth and the City of Lake Worth entered into a Joint Resolution (Fort Worth Resolution No. 2806) agreeing to shared responsibility for addressing drainage issues in the Comanche Creek watershed. This Inter-local Agreement (ILA) is being recommended pursuant to that Resolution. A section of Comanche Trail between Marina Drive and Malaga Drive within the city limits of Fort Worth, but accessed by streets in both Fort Worth and Lake Worth, has undersized culverts and the crossing commonly experiences flooding during storm events. City of Lake Worth residents are the primary users of this stretch of road and City of Lake Worth emergency personnel generally respond to flooding at this crossing. Pursuant to the Joint Resolution, the City of Lake Worth has previously spent $1,005,184.12 for engineering, property acquisition, and utility relocations associated with the mitigation of drainage issues in the Comanche Creek watershed. Under this ILA, the City of Lake Worth will pay up to $195,652.00 for the design, procurement, and management of the construction of a bridge on Comanche Trail to mitigate the risk of flooding as described above. The City of Fort Worth will pay for the construction costs subject to approval of the design. Construction of the project is anticipated to begin in Fiscal Year 2017. Staff supports this ILA and finds the costs to be fair and reasonable. Appropriations for the project will be as indicated in the table below. Stormwater funding for this project was approved on December 15, 2015 by City Council (M&C G-18625, Stormwater Fiscal Year 2016 CIP).
