Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Transportation Impact Fund in the amount of$1,449,172.20 from available funds; and 2. Authorize the execution of a contract with McClendon Construction Co., Inc., in the amount of $1,380,164.00 for the reconstruction of Alsbury Boulevard from Interstate 35W to Stone Road. DISCUSSION: The Alsbury Boulevard Paving and Drainage Project is necessary for increased traffic demand and to provide added drainage capacity along Alsbury Boulevard from east of Interstate Highway 35W to Stone Road. Alsbury Boulevard will be reconstructed as a four-lane divided arterial roadway with sidewalk. The project includes drainage improvements as well as minor water and sewer adjustments. Funding for this project is being provided from the transportation impact fee revenues in Service Area Z and the 1998 CIP New Development Street Improvement Funds. This Project is Funded as Follows: Fundin-q Source Amount Transportation Impact Fee Revenues in Service Area Z $1,449,172.20 1998 CIP New Development Street Improvement Funds $ 309.290.00 Total $1,758,462.20 Anticipated Expenditures are as Follows: Construction Contract $1,380,164.00 Construction Services $ 196,790.00 Temporary Construction Easements and Right-of-Way $ 62,500.00 Appraisals Management Services $ 50,000.00 Contingencies 69 008.20 Total $1,758,462.20 The project was advertised in the Fort Worth Star-Telegram on April 25, 2013 and May 2, 2013 and the following bids were opened on May 23, 2013. McClendon Construction Co., Inc., identified several subcontracting and supplier opportunities. However, the MBE's contacted in the areas identified did not submit the lowest bids. The City's MBE goal on this project is 15 percent. This project is located in COUNCIL DISTRICT 6, Mapsco 119T. Article of the Certificate of Insurance. 29 30 SC 5.04C.,"Contractor's Insurance" 31 5.04C. Automobile Liability,under Paragraph GC-5.04C.Contractor's Liability Insurance under 32 Paragraph GC-5.04C.,which shall be in an amount not less than the following amounts: 33 34 (1) Automobile Liability-a commercial business policy shall provide coverage on"Any Auto", 35 defined as autos owned,hired and non-owned. 36 37 $1,000,000 each accident on a combined single limit basis. Split limits are acceptable if limits are at 38 least: 39 40 $250,000 Bodily Injury per person/ 41 $500,000 Bodily Injury per accident/ 42 $100,000 Property Damage 43 44 SC-5.04D.,"Contractor's Insurance" 45 46 The Contractor's construction activities will require its employees,agents,subcontractors,equipment,and 47 material deliveries to cross railroad properties and tracks 48 49 I CITY OF FORT WORTH Alsbury Boulevard STANDARD CONSTRUCTION SPECIFICATION DOCUMENTS City Project No.01273 Revised April 1,2013 007300-4 SUPPLEMENTARY CONDITIONS Page 4 of 6 1 The Contractor shall conduct its operations on railroad properties in such a manner as not to interfere with, ' 2 hinder,or obstruct the railroad company in any manner whatsoever in the use or operation of its/their trains 3 or other property. Such operations on railroad properties may require that Contractor to execute a"Right of 4 Entry Agreement"with the particular railroad company or companies involved,and to this end the 5 Contractor should satisfy itself as to the requirements of each railroad company and be prepared to execute 6 the right-of-entry(if any)required by a railroad company.The requirements specified herein likewise relate 7 to the Contractor's use of private and/or construction access roads crossing said railroad company's 8 properties. 9 10 The Contractual Liability coverage required by Paragraph 5.04D of the General Conditions shall provide 11 coverage for not less than the following amounts, issued by companies satisfactory to the City and to the 12 Railroad Company for a term that continues for so long as the Contractor's operations and work cross, ' 13 occupy,or touch railroad property: 14 15 (1) General Aggregate: $Confirm Limits with Railroad 16 17 (2) Each Occurrence: $Confirm Limits with Railroad 18 19 Required for this Contract X Not required for this Contract 20 21 With respect to the above outlined insurance requirements,the following shall govern: 22 23 1. Where a single railroad company is involved,the Contractor shall provide one insurance policy in 24 the name of the railroad company. However, if more than one grade separation or at-grade 25 crossing is affected by the Project at entirely separate locations on the line or lines of the same 26 railroad company,separate coverage may be required,each in the amount stated above. 27 28 2. Where more than one railroad company is operating on the same right-of-way or where several 29 railroad companies are involved and operated on their own separate rights-of-way, the Contractor 30 may be required to provide separate insurance policies in the name of each railroad company. ' 31 32 3. If, in addition to a grade separation or an at-grade crossing,other work or activity is proposed on a 33 railroad company's right-of-way at a location entirely separate from the grade separation or at- 34 grade crossing, insurance coverage for this work must be included in the policy covering the grade 35 separation. 36 37 4. If no grade separation is involved but other work is proposed on a railroad company's right-of- 38 way, all such other work may be covered in a single policy for that railroad,even though the work 39 may be at two or more separate locations. 40 41 No work or activities on a railroad company's property to be performed by the Contractor shall be 42 commenced until the Contractor has furnished the City with an original policy or policies of the insurance 43 for each railroad company named,as required above. All such insurance must be approved by the City and 44 each affected Railroad Company prior to the Contractor's beginning work. 45 46 The insurance specified above must be carried until all Work to be performed on the railroad right-of-way 47 has been completed and the grade crossing, if any, is no longer used by the Contractor. Be advised that the Contract Documents on file with the City shall constitute all of 10 the information which the City will furnish. All additional information and data 11 which the City will supply after promulgation of the formal Contract Documents 12 shall be issued in the form of written addenda and shall become part of the Contract 13 Documents just as though such addenda were actually written into the original 14 Contract Documents.No information given by the City other than that contained in 15 the Contract Documents and officially promulgated addenda thereto, shall be 16 binding upon the City. 17 18 4.1.6. Perform independent research,investigations,tests,borings, and such other means 19 as may be necessary to gain a complete knowledge of the conditions which will be 20 encountered during the construction of the project. On request,City may provide 21 each Bidder access to the site to conduct such examinations,investigations, 22 explorations,tests and studies as each Bidder deems necessary for submission of a 23 Bid. Bidder must fill all holes and clean up and restore the site to its former 24 conditions upon completion of such explorations, investigations,tests and studies. 25 26 4.1.7. Determine the difficulties of the Work and all attending circumstances affecting the 27 cost of doing the Work,time required for its completion,and obtain all information 28 required to make a proposal. Bidders shall rely exclusively and solely upon their 29 own estimates, investigation,research,tests,explorations, and other data which are 30 necessary for full and complete information upon which the proposal is to be based. 31 It is understood that the submission of a proposal is prima-facie evidence that the 32 Bidder has made the investigation,examinations and tests herein required. City may consider the qualifications and experience of Subcontractors, Suppliers,and 2 other persons and organizations proposed for those portions of the Work as to which 3 the identity of Subcontractors, Suppliers,and other persons and organizations must 4 be submitted as provided in the Contract Documents or upon the request of the City. 5 City also may consider the operating costs,maintenance requirements,performance 6 data and guarantees of major items of materials and equipment proposed for 7 incorporation in the Work when such data is required to be submitted prior to the 8 Notice of Award. 9 10 17.3. City may conduct such investigations as City deems necessary to assist in the 11 evaluation of any Bid and to establish the responsibility, qualifications,and financial 12 ability of Bidders,proposed Subcontractors, Suppliers and other persons and 13 organizations to perform and furnish the Work in accordance with the Contract 14 Documents to City's satisfaction within the prescribed time. 15 16 17.4. Contractor shall perform with his own organization,work of a value not less than 17 35%of the value embraced on the Contract,unless otherwise approved by the City. 18 19 17.5. If the Contract is to be awarded, it will be awarded to lowest responsible and 20 responsive Bidder whose evaluation by City indicates that the award will be in the 21 best interests of the City. 22 23 17.6. Pursuant to Texas Government Code Chapter 2252.001,the City will not award 24 contract to a Nonresident Bidder unless the Nonresident Bidder's bid is lower than 25 the lowest bid submitted by a responsible Texas Bidder by the same amount that a 26 Texas resident bidder would be required to underbid a Nonresident Bidder to obtain a 27 comparable contract in the state in which the nonresident's principal place of 28 business is located. 29 30 17.7. The Contractor also recognizes the delays, expense and difficulties involved in proving in a legal proceeding the actual loss suffered by the City if the Work is not completed on time. This indemnification provision is specifically intended to operate and be effective even if it is alleged or proven that all or some of the damages being soueht were caused, in whole or in part, by any act, omission or neLdilzence of the city. Any provision or part of the Contract Documents held to be unconstitutional, void or unenforceable by a court of competent jurisdiction shall be deemed stricken, and all remaining provisions shall continue to be valid and binding upon CITY and CONTRACTOR. 7.5 Governing Law and Venue. This Agreement, including all of the Contract Documents is performable in the State of Texas.
