", AN ORDINANCE INCREASING THE ESTIMATED REVENUES ACCRUING TO THE GENERAL FUND OF THE CITY OF FORT WORTH FOR THE FISCAL YEAR 1984 BY TRANSFERRING THERETO THE SUM OF $382,000 FROM AN EXISTING ESCROW ACCOUNT AND APPROPRIATING FROM THE INCREASED ESTIMATED REVENUES OF THE GENERAL FUND THE SUM OF $382, 000 TO ACCOUNT NO. 35-40-00, INDEX CODE 399428, TO PAY AUTO POUND TOWAGE FEES AND EXPENSES; PROVIDING A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR ENGROSSMENT AND ENROLL- MENT; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That the estimated revenues accruing to the General Fund of the City of Fort Worth for the Fiscal Year 1984 are hereby increased by transferring thereto $382,000 from an existing escrow account and that in addition to providing the City Manager with such other reve- nue as may be secured from various sources included in Ordinance No. 8886 and in the Budget of the City Manager, there shall also be appropriated from the increased revenues of the General Fund the sum of $382,000 to Account No. 35-40-00, Index Code 399428, to pay auto pound towage fees and expenses. SECTION 2. This ordinance shall be cumulative of all provisions of ordi- nances and of the Code of the City of Fort Worth, Texas (1964), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitu- _~. ' " ;- tional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would h ave been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. The City Secretary of the City of Fort Worth is hereby directed to engross and enroll this ordinance by copying the caption in the minutes of the City Council and by filing the ordinance in the ordi- nance records of the City. SECTION 5. This ordinance shall be in full force and effect from and after its passage, and it is so ordained. As a result of this increased accountability, the current budget allotment for this section will need to have a supplemental appropriation in the amount of $382,000 to support this activity through the remainder of this fiscal year The Vehicle Pound Towing Fee, a General Fund Revenue Index Code 062620, will also be increased by $382,000, thereby offsetting the increased expenditures in the General Fund Recommendation It is recommended that the City Council 1) Adopt the attached Supplemental Appropriation Ordinance increasing General Fund appropriations in 35-40-00 (Index Code 399428) and, 2) Authorize the accrual of an offsetting amount to be recieved through reim- bursement to the City for fees paid, in Index Code 062620, as described above. vs kc !
