M ORDINANCE NO. ~~~/~~ AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTIN- GUISHING MARLENE DRIVE, LOIS ANN LANE, ATTLEE PLACE (STEPHEN DRIVE), AN UNNAMED PORTION OF STREET RIGHT-OF-WAY ADJACENT TO ATTLEE PLACE (STEPHEN DRIVE), AND PORTIONS OF HAMLET DRIVE AND ALANBROOKE DRIVE AS PUBLIC STREET RIGHTS-OF-WAY; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT THE following be and the same are vacated, abandoned, and permanently closed and extinguished as public street rights-of-way: A. Marlene Drive, from the south right-of-way line of Everman Parkway southward through and including its intersection with Attlee Place (also known as Stephen Drive); B. That portion of Marlene Drive located south of Attlee Place (Stephen Drive), designated and described as Tract 1 (Marlene Drive "Stub-Out") in Exhibit "A", attached hereto and incorporated herein. C. Lois Ann Lane, from the south right-of-way line of Everman Parkway southward through and including its intersection with Attlee Place (Stephen Drive); D. That portion of Lois Ann Lane located south of Attlee Place (Stephen Drive), designated and described as Tract 3 (Lois Ann Lane "Stub-Out") in Exhibit "A", attached hereto and incorporated herein; E. Attlee Place (Stephen Drive), from the west right- of-way line of Michael Drive west-northwesterly through and including its intersection with Marlene Drive; F. That portion of street right-of-way located south of and adjacent to Attlee Place (Stephen Drive) desig- nated and described as. Tract 2 (Unnamed "Stub-Out") in Exhibit "A", attached hereto and incorporated herein; G. That portion of Hamlet Drive located west of Michael Drive, said portion being designated and described as Tract 4 (Hamlet Drive west of Michael Drive) in Exhibit "A", attached hereto and incorporated herein; H. That the fee to the land in the above described vacated public street rights-of-way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. SOUTHFIELD STREET RIGHT-OF-WAY VACATION DESCRIPTIONS TRACT I (MARLENE DRIVE "STUB-OUT") A portion of the street right-of-way of Marlene Drive South of Attlee Place (platted as Stephen Drive) as shown on the plat of Everman Park South as recorded in Volume 388-69, Pages 02, 03, 04, 05 & 06 Plat Records Tarrant County, Texas, being more particularly described as: BEGINNING at a point in the Southeast corner of the intersection of said Marlene Drive and said Attlee Place; THENCE in a Southerly direction along anon-tangent curve to the left with a radius of 527.08 feet, and a long chord of 50.98 feet with long chord bearing of South 09 degrees 49 minutes 19 seconds West, a distance of 51.0 feet; THENCE North 82 degrees 58 minutes 20 seconds West a distance of 60.0 feet; THENCE in a Northerly direction along anon-tangent curve to the right with a radius of 587.08 feet and a long chord of 43.356 feet with a long chord bearing of North 09 degrees 09 minutes 50 seconds East, a distance of 43.356 feet; THENCE North 89 degrees 55 minutes 00 seconds East a distance of 61.341 feet, to the POINT OF BEGINNING, and containing 2830 square feet, more or less. The subject street rights-of-way, acquired by dedication., are not open on the ground and contain no utility facilities. The subject vacation request is made in order to consolidate the vacated rights-of-way with adjacent property, thus ex- panding the building area, and~xoviding more usable yard space The necessary and appropriate monetary consideration has been placed in escrow with the Real Property Department of the City Reviewing City departments and private utility companies have raised no objections to this request provided the vacated right-of=way is replatted with adjacent property. A satisfactory replat will be-submitted as development occurs, ixt. accordance with City Plan Commission Rules and Regulations. The City Plan Commission has reviewed this request and recommends that the subject streets be vacated as requested. Said Commission also recommends that the required replat be submitted as development occurs.
