AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND EXTINGUISHING CERTAIN ALLEY RIGHTS-OF-WAY, UTILITY EASEMENTS, AND PUBLIC OPEN SPACE EASEMENTS LOCATED IN BLOCK 6, LEGACY VILLAGE, PHASE I, AND IN BLOCK 6, LEGACY VILLAGE, PHASE II; PROVIDING FOR REVERSION OF FEE IN SAID LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT those certain alley rights-of-way, utility easements, and public open space easements located in Block 6, Legacy Village, Phase I, and in Block 6, Legacy Village, Phase II, and which are more particularly described in Exhibit "A" and shown on the map marked Exhibit "B", both of said Exhibits being attached hereto and incorporated herein, be and the same are vacated, abandoned, and permanently closed and extinguished as alley rights-of-way, utility easements, and public open space easements, respectively. SECTION 2. That the fee to the lands in the above described vacated alley rights-of-way, utility easements, and public open space easements is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance'shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. The subject vacation request is made in order to replat the vacated rights-of-way with adjacent property, thus expanding the building area and providing more usable yard space. The Necessary and appropriate monetary consideration has been placed in escrow with the Real Property Department of the City. Reviewing City departments and private utility companies have raised no objections to this request provided the vacated rights-of-way are replatted with adjacent property. A satisfactory has been submitted. The City Plan Commission has reviewed this request and recommends that the sub- ject alley and utility easements be vacated as requested. Recommendation It is recommended that an ordinance be adopted vacating the alley and utility easements in Block 6, Legacy Village, Phases I and II.
