ORDINANCE NO.

AN ORDINANCE VACATING, ABANDONING, AND CLOSING AND
EXTINGUISHING CERTAIN ALLEY RIGHTS-OF-WAY, UTILITY
EASEMENTS, AND PUBLIC OPEN SPACE EASEMENTS LOCATED IN
BLOCK 6, LEGACY VILLAGE, PHASE I, AND IN BLOCK 6, LEGACY
VILLAGE, PHASE II; PROVIDING FOR REVERSION OF FEE IN SAID
LANDS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
THAT those certain alley rights-of-way, utility easements, and
public open space easements located in Block 6, Legacy Village,
Phase I, and in Block 6, Legacy Village, Phase II, and which are
more particularly described in Exhibit "A" and shown on the map
marked Exhibit "B", both of said Exhibits being attached hereto and
incorporated herein, be and the same are vacated, abandoned, and
permanently closed and extinguished as alley rights-of-way, utility
easements, and public open space easements, respectively.
SECTION 2.
That the fee to the lands in the above described vacated alley
rights-of-way, utility easements, and public open space easements is
hereby released and shall revert to the adjacent owner as provided
by law.
SECTION 3.
That all ordinances or parts of ordinances in conflict herewith
are hereby repealed.
SECTION 4.
That this ordinance'shall take effect and be in full force and
effect from and after the date of its passage, and it is so or-
dained.

Being a 0.36 acre tract of land in the W.C. Smith Survey, Abstract Number
1440, and the J.W. Haynes Survey, Abstract Number 795, City of Fort Worth, Tarrant
County, Texas, said alley being more particularly described as follows:

Freedom Financial Corporation, owner of all abutting property, has requested
that the City vacate the following:
(1) The 15' wide east/west alley in and between Lots 25-48, Block b, Legacy
Village, Phase I, and Lots 1-15, 16 & 17, Block 6, Legacy Village, Phase
II, from Broadleaf Drive, eastward to a point 20' west of North Academy
Boulevard,
(2) The two (2) 15' x 15' public open space easements at the intersection of
Broadleaf Drive and the 15' wide north/south alley in and between Lots
25-48, Block 6, Legacy Village, Phase I, and Lots 1-15, lb & 17, Block 6,
Legacy Village, Phase II,
(3) The 7.5' wide east/west utility easement, adjacent to, parallel and
co-linear with the south right-of-way line of the 15' wide east/west
alley in said Block 6, Legacy Village, Phases I and II, and 7.5' south
of the north property line of Lots 25-48, Block 6, Legacy Village,
Phase I; from Broadleaf Drive east to North Academy Boulevard,

(6) The 10' wide north/south utility easement, from Long Rifle Drive, 5' on

(8) The variable width (15' at the narrow point and 65' at the wide point)
north/south alley in Block 6, Legacy Village, Phase II, from Long Rifle
Drive southward, to the north right-of-way of the 15' wide east/west alley
in said Block 6, Legacy Village, Phase II; and,
(9) The two (2) 15' x 15' Public Open Space Easements at the intersection of
Long Rif 1e Drive and the variable width, north/south alley, the same being
the northeast corners of Lots 15 and 16, Block 6, Legacy Village, Phase II,
respectively All of the subject alley and utility easement rights-of-way
are as shown on the attached map
The subject alley and utility easement rights-of-way, acquired by dedication, are
platted but contain no utility facilities. The subject vacation request is made
in order to replat the vacated rights-of-way with adjacent property, thus
expanding the building area and providing more usable yard space.
The Necessary and appropriate monetary consideration has been placed in escrow
with the Real Property Department of the City. Reviewing City departments and
private utility companies have raised no objections to this request provided the
vacated rights-of-way are replatted with adjacent property. A satisfactory has
been submitted.
The City Plan Commission has reviewed this request and recommends that the sub-
ject alley and utility easements be vacated as requested.
Recommendation
It is recommended that an ordinance be adopted vacating the alley and utility
easements in Block 6, Legacy Village, Phases I and II.
