HomeMy WebLinkAboutOrdinance 8801 a '~ ORDINANCE NO ~QIJ a AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF THE 800 BLOCK OF FOREST PARK BOULEVARD, A PORTION OF THE FORMER WORTH STREET RIGHT-OF-WAY LOCATED ADJACENT TO WE5T ROSEDALE STREET, AND A 4-FOOT WIDE ALLEY LOCATED ADJACENT AND NORTH OF LOTS 15 AND 16, EVERETT'S ADDITION; PROVIDING FOR REVERSION OF FEE IN SAID LAND; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE. ' BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. THAT the following be and the same are vacated, abandoned and permanently closed as street and alley rights-of-way: A. That certain portion of the 800 block of Forest Park Boulevard which is described by metes and bounds in Exhibit "A", attached hereto and incorporated as if set out in full herein. B. That certain portion of the former Worth Street right-of- way described by metes and bounds in Exhibit "B"; attached hereto and incorporated as if set out in full herein C. That certain 4-foot wide alley located adjacent to the north boundary lines of Lots 15 and 16, Everett's Addition, said alley being more ,particularly described by metes and bounds in Exhibit "C", attached hereto and in- corporated as if set out in full herein. ~`.___ SECTION 2. That the fee to the land in the above described vacated street and alley rights-of-way is hereby released and shall revert to the `" adjacent owner as provided by law. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so or- dained. TO BE VACATED A portion of Forest Park Blvd. adjacent to the T. & P. Railroad right of way and westerly of a tract of land conveyed to the City of Fort Worth, by deed recorded in Volume 7371, Page 1051, Deed Records, Tarrant County, Texas, and more particularly described as follows. COMMENCE at the northeast corner of Lot 16, Everetts Addition, according to plat recorded in Volume 63, Page 116, Plat Records, Tarrant County, Texas, and run north 1 degree 03 minutes 23 seconds east 4.0 feet and north 88 degrees 56 minutes 37 seconds west 157.25 feet and north 1 degrees 06 minutes 23 seconds east 68.06 feet to the point of beginning, said point being in the easterly right of way line of Forest Park Blvd., said point also being on a curve, the center of which bears south 65 degrees 20 minutes O1 seconds west a radius distance of 492.14 feet; THENCE Northwesterly, along said right of way and said curve to the left, an arc distance of 23 42 feet to a point in the southerly line of said rail- road, THENCE North 58 degrees 43 minutes O1 seconds east, with the southerly line of said railroad, 12.65 feet to a point in the westerly line of said tract of land recorded in Volume 7371, Page 1051, THENCE. (1) A portion of the 800 block of Forest Park Blvd ,.being a small triangular tract of land out of the E S Harris Survey and located north. of Lots 15 and 16, Everett's Addn , (2) A portion of the former Worth Street right-of-way from Jerome Street westward along and north of the west right-of-way line of West Rosedale ~ Street 320.6' to a point in the south property line of Lot 6, Mistletoe Heights Addition, and, (3) The 4' wide alley adjacent to and north of Lots 15 and 16, Everett's Addition, from Forest Park Blvd. eastward to the west property line of Tract 2-A, E. S Harris survey, all as sho~,m on the attached map. The subject street and alley rights-of-way, acquired by dedication, art not open on the ground and contain no utility facilities. The subject vacation request is made in order to replat the vacated rights of way with abutting property, to expand the building area, and provide more usable yard space. Reviewing City departments and private utility companies have raised no objec- tions to this request, provided the vacated rights-of-way are replatted with abutting property A satisfactory replat has been submitted. The City Plan Commission has reviewed this request and recommends that the subject rights-of-way be vacated as requested Recommendation It is recommended that an ordinance be adopted vacating the 800 blook of Forest Park Boulevard, a portion of Worth Street, and the 4' wide alley, north of Lots 15 & 16, Everett's Addition, as recommended by the City ~~~li~'~lon.
