ORDINANCE NO. D
AN ORDINANCE AMENDING CHAPTER 19, "HEALTH AND SANITATION,"
OF THE CODE OF THE CITY OF FORT WORTH (1964), AS AMENDED,
ADDING FEES TO BE CHARGED BY THE HEALTH DEPARTMENT FOR
COMMUNICABLE DISEASE BIOLOGICALS, THE HEALTH PROMOTION
PROGRAM, THE DENTURE PROGRAM, AND THE ADULT CLINIC FRO-
GRAM; AUTHORIZING PUBLICATION IN PAMPHLET FORM; MAKING
THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING
ALL ORDINANCES AND PROVISIONS OF THE FORT WORTH CITY CODE
IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING FOR THE ENGROSSMENT AND ENROLLMENT OF THIS ORDI-
NANCE; AND DECLARING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Section 19-440.1 of Chapter 19 of the Code of the City of
Fort Worth (1964), as amended, be, and the same is hereby amended so
that hereafter same shall read and be as follows:
"Sec. 19-440.1. Public Health Service Fees.
The Department of Public Health shall be
entitled to collect the following fees from those
individuals using the facilities and/or services of
the department as listed below:
(a) Public Health Laboratory -
(1) bacteriological analysis of standard
water sample .$ 5.00
(2) chemical analysis of standard water
sample .$ 50.00
Regulatory or complaint water samples that are
submitted to the laboratory from the
Environmental Health Division of the City of
Fort Worth Health Department, the Environmental
Health Division of the Tarrant County Health
Department, or the State Health Department,
Region V., shall be exempt from imposition of
these fees.
(b) Sexually Transmitted Disease Clinic
(1) clinic fee, includes initial and two
follow-up visits .$ 6.00
(2) laboratory fee
(a) Tarrant County Hospital District
facilities $ 3.00
(b) All other outside agencies $ 5.00
(3) prophylactics, five (5) for. .$ 1.00
(c) Immunization Clinic
(1) yellow fever immunization. .$ 1G.00
(2) clinic fee .$ 2.00
(3) copy of immunization record. .$ 2.00
(4)~ Immunoblobulin fee .$ 2.00
(5) Hepatitis B vaccine fee. .$105.00

SECTION 2.
That the City Secretary of the City of Fort Worth is hereby
authorized to publish this ordinance in pamphlet form for general
distribution among the public, and this ordinance as so published
shall be admissable in evidence in all courts without further proof
than the production of said pamphlet, as provided in Section 3,
Chapter XXV of the Charter of the City of Fort Worth.
SECTION 3.
This ordinance shall repeal every prior ordinance and provi-
sions of the Fort Worth City Code in conflict herewith but only
insofar as any portion of such prior ordinance or provision shall be
,~ in conflict, and as to all other ordinances or provisions of the
Fort Worth City Code not in direct conflict herewith, this ordinance
shall be and is hereby made cumulative.
SECTION 4.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by they valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such un-
constitutional phrase, clause, sentence, paragraph or section.
SECTION 5.
That the City Secretary shall engross and enroll this ordinance
by copying the caption and effective date in the minutes and by fil-
ing the ordinance in the ordinance records of the City.

SECTION 6.
That this ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

Background
Four (4) programs currently being planned and developed in the Health Department
will require approval of supplemental appropriations. These programs are
briefly described below
Program I
Routinely, the Public Health Department receives requests from individuals for
assistance in obtaining protection from communicable disease by vaccination or
immunoglobulin (biologicals). These individuals are concerned that they may be
susceptible to the disease due to exposure or possible exposure to patients
diagnosed with the communicable disease. Repeatedly, high cost and inaccessa-
bility are identified as barriers to obtaining the vaccine or immunoglobulin.
In order to provide a needed service to the communty, it is proposed that the
Public Health Department purchase biologicals to be administered in the
immunization clinic at the Public Health Center.
Program II
For the past six (6) months, the Public Health Department has been investi-
gating the feasibility of implementing a Health Promotion Program, which
employees of the Health Department can voluntarily participate in The
objective of the program is to focus on disease prevention and health promotion
activities, which result in the employee making a constructive behavior change
and an improved lifestyle. Self indulgent lifestyles characterized by
overeating, overdrinking, and smoking, coupled with lack of adequate exercise
are in many ways directly related to the leading causes of death--cancer,
heart and lung disease, hypertension, diabetes, and obesity.
Program III
For the past two (2) years, the Neighborhood Resource Development Program (NRDP)
has funded the Community Dental Clinic to provide routine dental care and
dental health education to the adult indigent population. In a recent decision
by the NRDP board, the Community Dental Clinic was advised monies would be
available to fund a low cost denture program.
Program IV
In the daily operation of the Adult Clinic, approximately eighty (80) patients,
primarily in the 18-24 age group are examined Immediate treatment for
infected cases is provided by the clinic staff. Educational counseling
addressing prevention and spread of disease is included in the clinic visit.
The client is advised of the necessity of taking appropriate preventive measures
To help achieve compliance by the client, it is proposed that the Public Health
Department purchase supplies to be sold to the client population.

Financing
The fees charged for providing these services will cover the cost of the service.
In order to record fees from clients and payments to vendors, it will be
necessary to approve supplemental appropriations. These funds will cover
activities from July 1, 1983, through September 30, 1983.
Recommendation
It is recommended that City Council;
1. Authorize the collection of fees to cover the costs of the programs
listed above by adopting the attached ordinance amending Sec. 19-440.1,
Public Health Service Fees, of the City Code.
2 Adopt the attached supplemental appropriation ordinance appropriating
additional anticipated revenues of the general fund to the Health
Department in the amounts indicated below
