TION OF SAME IN THE MINUTE BOOK OF THE CITY COUNCIL OF FORT WORTH,
TERAS, AND BY FILING THE COMPLETE ORDINANCE IN APPROPRIATE ORDINANCE
RECORDS OF SAID CITY; AND PROVIDING AHD EFFECTIVE DATE.
WITMEAS the City of Fort Worth, Texas, has heretofore entered into a contract
with :iORTH M11STRUCTION COITPAiNY for the making and construction of certain
street improvements on the hereinafter described portions of streets, avenues and public places
in said City, to-wit;
1. 1,1iller-Oakland: From Rosedale Street to the north
line of Lot 1, Block 41, Eastover
Addition, known and designated. as Unit
No. 2.
2. 1v1ILLER-0,=;ICLA1,0: From Burton Street to the north line
of Lot 1, Block 4, Eastover Addition,
known and designated. as Unit No. 3.
W119MS, by sundry proceedings heretofore passed by the City Council of the
City of Fort Worth, Texas, including Ordinance No. 4732_, a portion of the cost of
said improvements was levied and assessed against the respective properties abutting on each
of the above described portions of streets, avenues and public places and against the real
and true owners thereof; and,
W=WAS, the City Council of the City of Fort Worth, Texas, has, upon re-
view, found and determined that, in some instances, in order to effect substantial justice
and equality, it is desirable and necessary to grant and issue certain credits against
some one or more of the assessments levied by Ordinance No. 4739 , and
VAS, the street improvements hereinabove mentioned have been completed
upon each of the portions of streets, avenues and public places hereinabove described, and
have been inspected and found to be in complete accordance with the contract therefor;
NOW, TH7METFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF TEE CITY OF FORT WORTH,
TEXAS, THAT:
I.
The improvements on each of the portions of streets, avenues and public
places hereinabove described be, and they are hereby, accepted; and the contract with re-
ference thereto be, and it is hereby, found and declared fully completed and performed.
II.
The Mayor, be, and he is hereby, directed to issue and execute in the name
of the City, certificates in evidence of the special assessments levied against abutting
property and the owner thereof for such improvements, and the City Secretary is directed
to attest same and impress thereon the corporate seal of the City, all in accordance with
the proceedings relating to such improvements and assessments. The certificates shall be
numbered, shall describe the property against which the assessment has been levied, shall,
where known, state the name or names of the true owners of the respective parcels of pro-
perty assessed and shall be issued in an amount equal to the difference between the
principal amount of the assessment and the amounts of any credit issued thereon. The numbers
of the certificates, with the property descriptions to be shown on the respective certifi-
cates, to,-,:,ether with the names of the owners of said property, the principal amount of the
assessment, the respective credits, if any w�iich are hereby authorized, granted and allowed
against the principal amount of some one or more of the assessments heretofore levied, and the
principal amount for which each certificate is to be issued after giving effect to such credit,
if any, are hereby enumerated and itemized as follows:

When each of the certificates has been duly executed as hereinabove provid-
ed, same shall be delivered to the Tax Assessor-Collector as .part payment of the contract
price.
IV.
The City Secretary is hereby directed to engross and enroll this ordinance
by copying the caption of same in the Minute Book of the City Council of Fort Worth, Texas,
and by filing the complete ordinance in the appropriate Ordinance Records of said City.
V.
This ordinance shall take effect and be in full force and effect from and
after the date of its passage.

able grade to facilitate the movement of traffic + $3,656.00
(2) It was necessary to lower existing sanitary sewer
services to eliminate conflicts with street
construction. + 3,633.02
(3) In view of the condition of the residue of
property purchased for right-of-way, it was
determined that these lots should be cleared of
all debris in order to properly slope and drain + 2,500.00
(4) Variation between estimated and measured quantities
account for the additional difference between
contract cost and contract price - 590.87

Attached is a tabulation of paving test cores showingcompliance
with specifications within acceptable construction tolerances.
Tests made durin6 construction of the sub-base, base, and pavement
also show that the ma -erial used was in compliance with specifica-

That the above project be accepted by adoption of an ordinance and
that final payment of t27,697.73 be authorized to Worth Construction
Company.
