AN ORDINANCE APPROVING AND ADOPTING ESTIT,ATE .OF THE COST
OF IMPROMENTS AND OF AMOUNTS TO BE ASSESSED FOR IAZPROVE-
TLENTS ON A PORTION OF BEACH STREET IN THE CITY OF FORT WORTH,
TEXAS., FLING TITS AND PLACE FOR HEARING TO THE OWNERS OF
ABUTTING PROPERTY AND TO ALL OTHERS IITI'ERESTED: DIRECTING
THE CITY SECRETARY TO GIVE NOTICE OF SUCH HEARING; AND .
DIRECTING THE CITY SECRETARY TO ENGROSS AND ENROLL THIS
ORDINANCE BY COPYING THE CAPTION OF SPME IN THE MINUTE BOOK
OF THE CITY COUNCIL AND BY FILING THE COMPLETE ORDINANCE IN
THE APPROPRIATE ORDINANCE RECORDS OF THIS CITY; AND PROVIDING
AN EFFECTIVE DATE.
I'VHERE,3$ the City Council of the City of Fort Worth, Texas, here here-
tofore ordered. that hereinafter described portion of Beach Street in the City of Fort
Worth, Texas, be improved by raising, grading and filling same and by constructing
thereon:
On Beach Street, Unit b: A 741 reinforced ooncrete pavement;
together with combined concrete curbs and guttOrs on proper grade and line tifnere same
are not already so construdted, together with storm sewers and drains and other neces-
sary incidentals and appurtenances ; all of said improvements to be constructed as and
where shown on the Plans and in strict accordance with the Plans and Specifications
therefore; and contract therefor has been made and entered into with Uvalde Construc-
tion Company; and
W[1EREA3, the City Council of the City of Fort Worth, Texas, has caused
the Public Works Director to prepare and file estir_nates of the cost of such improve-
ments and estimates of the amounts per front foot proposed to be assessed against
abutting property and the owners thereof, and such estimates have been examined.
NOT,^4T, THEREFORE,
BE IT ORDAINED BY TINE CITY COUNCIL OF THE CITY OF FORT TVORTH, TEXAS,
THAT:
I.
Such estimates be, and they are hereby, adopted and approved.
II.
It is hereby _found and determined that the cost of improvements on
that portion of reach Street, hereinafter describee, with the amount or amounts per
front foot proposed to be assessed for such improvements against abutting property
and the owners thereof, are as follows, to-wit:
Beach Street: From the northerly line of Camilla Avenue to
the southerly line of East Carter Avenue knoim-

The estimated cost of the improvements is "'4107.,209.90., the estimated
amount per front foot to be assessed against abutting property and
the owners thereof for curb and butter is C1.67; the estimated
amount per front foot to be assessed against abutting property and
the owners thereof for improvements exclusive of curb and gutter is
X9.90; the total estimated amount per front foot to be assessed

III.
A hearing be given and held by and before the City Council of the
City of Fort Worth, Texas, to all owning or claiming any property abutting upon said
portion of Beach Street, as well as to all owning or claiming in any interest in any
such property. Such hearing shall be given and held on the 15th day of December,
1961, at 9 o'clock A.T,'I., in the Council Chamber in the City Hall in the City of Fort
Worth: Texas, and the City Secretary is hereby directed to give notice of the time
and place of such hearing and of other matters and facts in accordance with the
terms and provisions of an Act passed at the First Called. Session of the Fortieth
Legislature of the State of Texas, and known as Chapter 106 of the Acts of said Ses-
sion, now being shown as Article 1105b of Vernonts Temas Civil Statutes. Such notice
shall be by advertisement at least three times in a newspaper published in the City
of Fort Worth, Texas, the first publication to be made at least ten days before the
date of said hearing. Said notice shall comply with and be in accordance with the
terms and provisions of said Act4 The City Secretary is further directed to give per-
sonal notice of the time and place of such hearing to all owning or claiming any pro-
perty abutting on said portion of Beach Street, as well as to all owning or claiming
any interest in any such property. Such personal notice shall be given by the City
Secretary mailing said notice, postage prepaid, to the respective owners of record of
the properties to be assessed, and to any person owning or claiming any interest in
said properties, to the last known address of said owner or persons. It shall not
be necessary for the City Secretary to mail said notice to any owner or other person
claiming an interest in the property to be assessed when the address of such owner or
other person claiming an interest in the property to be assessed is unknown to the
City Secretary and cannot be determined by the City Secretary after reasonable investi-
gation. In this connection, the City Secretary shall prepare and file these proceed-
ings a list of the properties to be assessed, the names of those persons owning or
claiming any interest in said properties to whom the notice was mailed, together with
the last known address of the respective owners and those persons owning or claiming
any interest in said property. The City Secretary shall certify that each of the par-
ties named in said list whose address was known to him, was mailed a copy of the notice
of hearing and shall further certify the date or dates on which said notice was mailed.
A copy of the notice shall be attached to such certificate. The certificate of the
City Secretary shall be conclusive evidence of the facts therein recited. Failure of
the City Secretary to give notice of hearing by mail as herein provided for, or failure
of the owner or other persons interested to receive said notice, shall in nowise in-
validate said hearing or any assessments levied pursuant to said hearing, but notice of
hearing shall be sufficient, valid and binding upon all owning or claiming such abutting
property or any interest therein when same shall have been given by newspaper advertise-
ment as first hereinabove provided.
IV.
The City Secretary is hereby directed to engross and enroll this ordi-
nance by copying the caption of same in the Minute Book of the City Council and by
filing the complete ordinance in the appropriate Ordinance Records of this City.
V.
This ordinance shall take effect and be in full force and effect from
and after the date of its passage.

In accordance with the proceedings of you Honorable Body, I have prepared
estimates of the cost of street improvements as shown below:
Estimates of the total cost of improvements on a portion of Beach Street in
the City of Fort Worth, Texas, and estimated amounts per front foot to be assessed against
abutting property and the owners thereof, on a portion of Beach Street are as follows, to-
wit:

to the south line of East Carter Avenue

The estimated cost of the improvements is $407,209.90 the estimated amount per
front foot to be assessed against abutting property and the owners thereof for curb and
gutter is $1.67; the estimated amount per front foot to be assessed against abutting property
and the owners thereof for improvements exclusive of curb and gutter is $9.90; the total
estimated amount per front foot to be assessed against abutting property and the owners
thereof is $11.57.

City of Fort Worth from Camilla Avenue to

Mrs. McKnight and Gentlemen:
The 1960 and 1961 Capital Improvement Program schedules construction of the
Beach Street Extension from Camilla Avenue to Carter Avenue, which is the
final unit of construction of the Beach Street Extension. The completed
project Vill' extend from East Belknap to Mitchell Boulevard. This final
unit of construction consists of excavating and paving under the overpass
built by the Texas Highway Department on East Lancaster Avenue and under
the overpass for the Texas & Pacific Railroad financed jointly by the City
of Fort Worth and the railway company, and construction of the service
roads and ramps needed to provide access from Beach Street to East Lancaster
Avenue.
The units of Beach Street Extension which have been completed were financed
on an assessment basis and itis proposed that this final unit also be
financed on an assessment basis, as' shown in the attached plat. The pro-
perty between Camilla Avenue and the Texas & Pacific Railroad that it is
recommended be assessed has access to Beach Street, and the property be-
tween the Texas & Pacific Railroad and Carter Avenue that is proposed for
assessment has access to the frontage road paving. It is recommended that
the following ordinances be adopted:
1 . An ordinance declaring the necessity for and ordering the paving
on an assessment basis of,

and making provisions for the levying of assessments; directing
the Public Works Department to prepare estimates of cost, and
awarding the contract to Uvalde Construction Company on its low
bid �-f $407,209.90 and authorizing its execution, and making
appropriations to cover the indebtedness thereby incurred, The

Of the estimated total cost to the City of $440,000, there is presently
allotted to this project a total of $328,019. 12, of which $ 153,019. 12 is
available in Project 84-B3-25, Beach Street Extension, and $ 175,000 is
available in Project No. 94-B3-11 , Beach Street Extension. An 'additional
$ 111 ,980.88 is available for transfer to this project from savings in
various projects in the 84-Bond Fund on which construction has been com-
pleted.
