C~ C3 O AN ORDINANCE AMENDING ORDINANCE N0. 8219, "BUILDING CODES" OF THE CITY OF FORT WORTH, TEXAS, BY CHANGING CERTAIN BUILDING PERMIT FEES; PROVIDING A BUILDING PERMIT ISSUANCE FEE; PROVIDING A BUILDING PLAN CHECK FEE; CHANGING CERTAIN FEES FOR DEMOLITION, AND MOVING AND OTHER BUILDING INSPECTION FEE5, PROVIDING THAT THIS ORDINANCE IS CUMULATIVE OF ALL ORDINANCES AND PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE. A ..1' ~ar~t~ BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT, TEXAS: SECTION 1. That Section 302 (b), "Plans and Specifications," of Ordinance 8219, "Building Codes" of the City of Fort Worth, Texas, shall hereafter be and read as follows: "Section 302 (b). Plans and Specifications "With each application for a building permit, and when required by the Building Official for enforcement of any provisions of this Code, two sets of plans and specifications shall be submitted. The Building Official shall require plans and specifications to be prepared and designed by an engineer or architect licensed by the State of Texas to practice as such. "A plan check fee shall be charged for each set of plans and specifications submitted as follows: Plans requiring inspection by only the Department of Development $50.00 Plans requiring inspection by other departments in addition to Department of Development $150.00 The plan check fee will be credited to the cost of the building permit at the time a building permit is issued. EXCEPTIONS: When authorized by the Building Official, plans and specifications need not be submitted for the following: 1. Any Group R-3 or M occupancy, or 2. Other buildings not exceeding one story in height and 5,000 square feet in area, provided that no clear span exceeds 24 feet, or 3. Small and unimportant work." SECTION 2. That Section 304 (a), "Building Permit Fees," of Ordinance 8219 is amended and shall hereafter be and read as follows: Section 304 (a). Building Permit Fees "A fee for each building permit shall be paid to the Building Official, as set f orth in Table No. 3-A. The determination of value or valuation under any of the provi- sions of this Code shall be made by the Building Official. The valuation to be used in computing the permit shall be the total value of all construction work. A building permit issuance fee of ten dollars ($10.00) shall be required upon issuance of a permit. EXCEPTIONS: 1. The value of work on which a separate Inspection Fee is charged under the Fort Worth Electrical, Plumbing, Gas, Mechanical and Sign Ordinances. 2. The value of all portable heating, cooling or cooking equipment. 3. The value of all repainting and rede- corating that does not involve the installation of materials with flame- spread classifications or fire-resisti- vity of the building. Where work for which a permit is required by this Code is started or commenced prior to obtaining said permit or permission from the Building Official, the fees specified in Table No. 3-A shall be doubled. The payment of such double fee shall not relieve any person from fully complying with the re- quirements of thisCode in the execution of the work, nor f rom anyother penalties pre- scribed herein." SECTION 3. That Table No. 3-A, "Building Permit Fees", of Section 304 of Ordinance 8219, is amended and henceforth shall be and read as follows: ice.. _ , ~. "TABLE N0. 3-A -- BUILDING PERMIT FEES TOTAL VALUATION $1.00 to $500.00 $501.00 to $2,000.00 $10.00 $10.00 for the first $500.00 plus $1.54 for each additional $100.00 or f raction thereof, to and including $2,000.00 $2,001.00. to $25,000.00 $32.50 for the first $2,000.00 plus $6.00 for each additional $1,000.00 or f raction thereof, to and including $25,000.00 $25,001.00 to $50,000.00 $170.50 for the first $25,000.00 plus $4.50 for each additional $1,000.00 or fraction thereof, to and including $50,000.00 $50,001.00 to $100,000.00 $283.00 for the first $50,000.00 plus $3.00 for each additional $1,000.00 or fraction thereof, to and including $100,000.00 $100,001.00 and up $433.00 for the first $100,000.00 plus $2.50 for each additional $1,000.00 or fraction thereof." SECTION 4. That Section 304 (d) of Ordinance 8219 is amended and hereafter, shall be and read as follows: "(d) In addition to the fees charged in Table No. 3-A, the following Inspection Fees shall be charged: (1) Demolition and Moving Inspection Fee, based upon total square footage, as follows: 1 through 1,000 $ 30.00 1,001 through 2,000 60.00 2,001 through 3,000 120.00 3,001 through 5,000 180.00 5,001 through 10,000 270.00 10,001 through 20,000 360.00 20,001 and above 450.00 ~ `, ~ EXCEPTIONS: 1) Buildings ordered demolished by the City of Fort Worth. 2) Those inspection fees specified in Chapter 46 for the permanent or temporary use of public property. 3) A fee of Ten Dollars ($10.00) shall be charged for a change of occupancy where an occupancy permit is required by this code. A fee shall not be paid for new construction where a building permit inspection fee has been paid." SECTION 5. Section 304 (f) of Ordinance 8219 is hereby amended and as amended it shall read and be as follows: " (f ) The Building Official may charge an inspec- tion fee for any inspection where such inspection has not been paid by a permit fee or other fees. Such fee shall not exceed Twenty Dollars ($20.00) per hour per inspec- tion assigned to make such inspection, pro- vided however, that the maximum charge for any such inspection shall be Eighty Dollars ($80.00). The inspections covered by this Section shall include, but not be limited to, the following: Annual Inspection Fee Dance Halls Mobile Home Parks Night Clubs Day Care Rest Homes Auto Junk Yards Miscellaneous Ordinance and Occupancy Inspection All User Meter Changes Inspections for Licensing Dance Halls Night Clubs Day Care Rest Homes Auto Junk Yards House Moving and Demolition PPYm1 f'" ~. t ~ ~ • ~ t • • r ~ o ~~ SECTION 6. That, should any portion, section or part of a section of this Ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections or parts of sections of this Ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 7. That this ordinance shall be cumulative of all other ordinances and of the Code of the City of Fort Worth, except in those instances where the provisions of this Ordinance are in direct conflict with such other ordinances and such Code, in which instances said conflicting provisions are hereby expressly repealed. SECTION 8. That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained.
