AN ORDINANCE CLOSING THE HEARING ON SPECIAL BENEFITS TO
BE RECEIVED FROM PROPOSED STREET IMPROVEMENTS, AND ON
OTHER MATTERS WITH REFERENCE THERETO, ORDERED TO BE
MADE PURSUANT TO ORDINANCES NUMBERED 3997 To 4002, IN-
CLUSIVE, 4004 TO 4008, INCLUSIVE, 3811 TO 3814, INCLU-
SIVE, 4010 TO 4015, INCLUSIVE, AND 4031 TO 4039, IN-
CLUSIVE, AS AMENDED, AND PURSUANT TO SUBSEQUENT PRO-
CEEDINGS OF SAID CITY COUNCIL; LEVYING SPECIAL ASSESS-
MENTS; PROVIDING FOR THE ISSUANCE OF ASSESSMENT CERTIFI-
CATES; RATIFYING AND CONFIRMING ALL PROCEEDINGS HERETO-
FORE TAKEN BY THE CITY COUNCIL OF THE CITY OF FORT WORTH
IN CONNECTION WITH SUCH STREET IMPROVEMENTS AND THE
ASSESSMENTS WITH REFERENCE THERETO; MAKING- OTHER FINDINGS
AND ENACTING OTHER PROVISIONS INCIDENT AND RELATING TO
THE SUBJECT; PROVIDING THAT SHOULD ANY SECTION OF OR PART
OF ANY SECTION OF THIS ORDINANCE BE HELD VOID, THE RE-
MAINING PORTION SHALL NOT BE AFFECTED; AND PROVIDING THAT
THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY,
WHEREAS, the City Council of the City of Fort Worth has
heretofore by the following numbered ordinances duly passed and
enacted determined and declared the necessity for and ordered the
improvement of the hereinafter described streets and avenues or
portions thereof of the City of Fort Worth, within the limits
defined by said ordinances, and has determined to assess a portion
of the costs of the improvements against the properties abutting
the streets and avenues or portions thereof to be improved and
against the real and true owners thereof; said ordinances being
ordinances numbered 3997 to 4002, inclusive, 4004 to 4008, inclu-
sive, 3811 to 3814, inclusive, 4010 to 4015, inclusive, and 4031
LZ4039, inclusive, as amended by ordinances numbered -
4% ; and said streets and avenues

or portions thereof being describe as follows, which streets and
avenues or portions thereof are hereby designated as separate and
distinct improvement units to be identified by improvement unit
numbers as shown below, to-wit:

WHEREAS, such contracts with LEWIS AND LEWIS and FIRST OF
TEXAS CORPORATION were duly executed on behalf of the City and on
behalf of said LEWIS AND LEWIS and FIRST OF TEXAS CORPORATION; and
WHEREAS, said executed contracts, together with the 100%
Performance Bond of LEWIS AND LEWIS, were thereafter submitted to
the City Council of the City of Fort Worth for approval; and
WHEREAS, by an ordinance duly passed, adopted, approved
and enacted by the City Council of the City of Fort Worth on the
day of , 1959, the action of the City Mana-
ger in, executihg -the aforesai contracts and of the City Secretary
in attesting the same were approved and said contracts were rati-
fied and the 100% Performance Bond submitted by LEWIS ANDtLEWIS in
the sum of $290,744.75 was accepted and approved; and
WHEREAS, the City Council caused the City Engjneer (Pub-
lic Works Director) to prepare and file estimates of the cost of
the improvements in each unit, and estimates of the amounts per
front foot proposed to be assessed in each unit against the prop-
erties abutting the streets or avenues or portions thereof to be
improved, and against the real and true owners thereof; -. and
WHEREAS, the City Council, by ordinance, duly passed,
approved and enacted, found that the estimates as to each unit of
the amount per front foot proposed to be assessed in such unit
against the properties abutting the streets, avenues or portions
thereof to beimprovedand against the owners thereof, are all
made in conformity with the provisions of the aforementioned ordin-
ances ordering the improvements to be made, as amended, and in
conformity with the subsequent ordinances heretofore passed, ap-
proved and enacted by the City Council, above referred to, and in
conformity with the intention and desires of the City Council, and
will generally (with certain possible exceptions therein men-
tioned) result in just and equitable assessments and that the as-
sessments proposed to be levied against the properties abutting
the streets and avenues or portions thereof to be improved are ap-
portioned between such properties and the owners thereof substan-
tially in accordance with the Front Foot Plan or Rule; and
WHEREAS, by said ordinance, the City Council determined
the type of improvements to be made in each improvement unit;' the
estimated amount per front foot proposed to be assessed in each
unit against the owner or owners of properties abutting each
street or avenue or portion thereof to be improved, and against
their properties; the estimated total cost of such improvements
in each unit; the estimated amount of the total cost of such im-
provements in each such unit which it was proposed shall be paid
by the City of Fort Worth; the estimated amount of the total cost
of such improvements in each such unit which it was proposed shall
be assessed against the abutting properties and the real and true
owners thereof; and determined that such estimate and report as to
each improvement unit was correct and adopted said estimate as the
basis for levying the assessments for such street improvements, ex-
cept as otherwise providedtherein; and
WHEREAS, by said ordinance, the City Council of the City
of Fort Worth ordered that a hearing be given on the day of
1959, at o 'clock M before the City Council
of the City of Fort Worth in the City Hall of the City of Fort
Worth, to all owners and to all persons owning or claiming any
interest in or lien upon any property abutting the streets or
avenues or portions thereof of the City of Fort Worth, hereinafter
named, within the limits hereinafter set forth, and to all other
interested parties and to their agents and attorneys, on all mat-
ters as to which a hearing is a constitutional prerequisite to the
validity of the assessments herein levied, and for the purpose of
allowing said parties to contest the amounts of the proposed as-
sessments, the lien and liability thereof, the special benefits to
the abutting property and the owners thereof by means of the im-
provements for which such assessments are herein levied, the accur-
acy, sufficiency, regularity and validity of the proceedings, and
contracts in connection with such improvements and assessments, or
concerning any matter or thing connected therewith, and ordered
that a notice of such hearing be given and published in the manner
and for the time required by law; and
WHEREAS, the City Council of the City of Fort Worth has
examined into the manner and time of the giving and publishing of
the notice of such hearing and has found that due and legal notice
of said hearing was duly, properly and legally given as required
by law, said notice having been given by advertisement inserted at
least three times prior to the date of such hearing in a newspaper
published in and of general circulation in the City of Fort Worth,
Tarrant County, Texas, the first of which publications was made at
least ten days before the date of the hearing; and
WHEREAS, said hearing was duly opened at the time and
place mentioned in said ordinance calling said hearing, and in the
notices thereof which were duly published; and
WHEREAS, at said hearing all owners and all persons own-
ing or claiming any interest in, or lien against any property abut-
ting the streets or avenues or portions thereof, hereinafter named,
within the limits hereinafter defined, and all other interested
parties and their agents and attorneys, desiring to contest said
proposed assessments, the lien and the liability thereof, the spe-
cial benefits of the abutting property and the owners thereof by
means of said improvements, the accuracy, regularity, sufficiency
and validity of the proceedings in connection with such improve-
ments and the contracts therefor, and all matters with reference
thereto, were duly heard and their claims were duly considered;
and

TATHEREAS, Reverend William F. Fowler, Pastor of Alta Mere
Baptist Church, which is located at 3200 Ramona Drive, appeared before
the City Council and stated that at the time the paving of Ramona Drive,
from the Northerly line of U. S. Highway No. 80 to the Southerly line of
Slocum Avenue, was originally ordered,, the Church owned two lots affected
by the paving; that since the paving was ordered the Church has secured
and assumed the paving cost of five additional lots; that the Church
has funds on hand almst sufficient to pay cash for its portion of the
paving cost; and that the paving constitutes a special benefit to the
property in excess of the assessments and requested that the City proceed
with the paving construction on Ramona Drive, and
WHEREAS, Mr. Billy V. Pederson appeared before the City Council
and stated that he represents the five residential property owners living
on Brazos Street affected by the paving of Fairfax Avenue, from the Souther—
ly line of Garza Avenue to the West to the Northerly line of Garza Avenue
to the East; that Fairfax Avenu6 -abuts the property of the five owners of
residential property at the rear; that the five property owners do not have
access to Fairfax Avenue from their property and the property is fenced where
it abuts Fairfax Avenue; that the five property owners do not feel that their
property will be enhanced by the paving of Fairfax Avenue; and opposed
the assessment against the residential property on Brazos Street abutting
Fairfax Avenue at the rear, and
WHEREAS2 Mr. C. M. Thelin, Director of Public Works for the City
of Fort Worth, appeared before the City Council and stated that in his
opinion the paving of Fairfax Avenue will not enhance the value of the
residential properties on Brazos Street,, abutting Fairfax Avenue at the
rear, in excess of the residential assessment of $5.50 per linear foot,
but that it will enhance the value of the residential properties in excess
of fifty percent (50%) of the residential assessment of $5.50 per linear
foot, and that credits of fifty percent (50%) of the residential assessment
have been allowed on assessments against residential property on Brazos
Street., abutting Fairfax Avenue at the rear,, and
Section 4
It is hereby determined that no assessment is made in any
case against any abutting property and the owners thereof in excess
of the special benefits of such property and its owners in the en-
hanced value thereof by means of such improvements as determined at
said hearing. The amounts assessed against the various properties
and the owners thereof do not exceed the amounts which may be as-
sessed under the laws of the State of Texas, and the proceedings
heretofore held with reference to such improvements and assessments,
and do not exceed the estimates prepared by the City Engineer, and
are approved and adopted by the City Council.
Section 5
The amounts hereby assessed against the abutting properties
and the owners thereof shall be and become due and payable in five
(5) equal (or as nearly equal as possible) installments as follows:
The first of said installments shall be due and payable on or before
twenty (20) days from the date the improvements have been accepted
by ordinance by the City in the unit in which the street or avenue
which is abutted by the property assessed lies, and the four (4) re-
mainin installments shall be due and payable on or before one (1),
two (21, three (3) and four (4) years, respectively, from the date
of such acceptance. Interest shall run on the unpaid principal bal-
ance until paid from the date of the acceptance of such improvements
in each such unit at the rate of six (6%) per cent per annum, which
interest shall be due and payable at the time the principal install-
ments become due as above set out (or at the time of payment of such
installments in the event of prepayment). Past due principal and
interest shall bear interest at the rate of eight (8%) per cent per
annum. If default is made in the payment of any installment of
principal or interest when due, then at the option of the holder of
the special assessment certificate issued to evidence such assessment,
the entire amount of such certificate shall be and become immediately
due and payable, together with reasonable attorneys ' fees and court
costs, if incurred.
The several sums above assessed, together with interest as
specified, and costs of collection, including reasonable attorneys '
fees, if incurred, are hereby declared and ordained to be secured by
good and lawful liens on said respective parcels of abutting prop-
erties and to be a personal liability of the respective owners
thereof, whether correctly named or not, to be paid and collected as
provided by law, and such assessments and liens against such abutting
properties shall be superior to all other liens and claims except
State, County, School District and City ad valorem taxes.
Upon default in the payment of any installment of princi-
pal or interest when due and/or on the maturity of any special as-
sessment certificate issued to evidence any assessment against
abutting properties and the owners thereof levied hereunder, however
said maturity may occur, the assessment lien against the property
herein described and the personal liability and charge of the real
and true owner or owners thereof, whether correctly named herein or
not, may be enforced in any court having jurisdiction or at the option
of the holder of the certificate of special assessment evidencing such
liability and lien by sale of said property in the same manner as may
be provided by law in force in said City for sale of property for the
collection of ad valorem taxes, or in case of such default, at the
option, and upon the request of the legal holder of any certificate

WHEREAS, notices of the enactment of said ordinances,
signed in the name of the City of Fort Worth by its Mayor, identi-
fying or designating the streets and avenues or portions thereof to
be so improved, as ordered by said ordinances, and stating that a
portion of the cost of said improvements is to be specially assessed
as a lien against the property abutting on said streets or avenues
or portions thereof to be improved, and against the owners thereof,
in the manner provided by Article 1105b, Revised Civil Statutes of
Texas, 1925, as amended, were filed with the County Clerk of Tarrant
County, Texas, and recorded in the Deed of Trust Records of said
County in Volume 1391, pages 570 to 573; Volume 1+35, pages 434 to
450; Volume 1441, pages 625 to 631 and pages 633 to 637;. and notice
of the enactment of said amendatory ordinances, signed in the, name
of the City of Fort Worth by its Mayor, was filed with the County
Clerk of Tarrant County, Texas and recorded in Volume page
of the Deed of Trust Records of said County; and
WHEREAS, the City Engineer (Public Works Director) has
prepared plans and specifications for such proposed improvements,
and has submitted same to the City Council; and
WHEREAS, said plans and specifications were approved and
adopted by ordinances duly enacted by the City Council of the City
of Fort Worth; and
WHEREAS, due notice to bidders for the construction of
such proposed improvements and for the furnishing of certain fiscal
agency services was given as required by law and by the Charter of
the City of Fort Worth; and
WHEREAS, sealed bids were received for the construction
of such improvements and for the furnishing of fiscal agency serv-
ices to the City and were duly opened at the time and place provided
in the notice therefor; and
WHEREAS, after careful consideration of all bids received,
the City Council found that the bid of LEWIS AND LEWIS, when taken
into consideration with the proposal of FIRST OF TEXAS CORPORATION
to act as the City's Fiscal Agent, was the most advantageous bid for
the City to accept, and that LEWIS AND LEWIS and FIRST OF TEXAS COR-
PORATION are both responsible parties, and that LEWIS AND LEWIS was
the lowest and best bidder on the cash basis and that said bid is
fair and reasonable, and that FIRST OF TEXAS CORPORATION was the low-
est and best bidder on the proposed fiscal agency contract and that
its proposal is fair and reasonable; and
WHEREAS, by ordinance duly passed, adopted, approved and
enacted on the 27th day of March, 1959, the City Council of the City
of Fort Worth authorized the City Manager of the City of Fort Worth
to enter into a contract with LEWIS AND LEWIS, and authorized the
City Secretary to affix the seal of the. City thereto and attest same,
based upon said bidder's Bid No. 2 proposal (cash. basis Alternate No.
3), and authorized the City Manager to enter into a contract with
FIRST OF TEXAS CORPORATION to act as Fiscal Agent for the City in
connection with the construction of the proposed improvements and the
levying of the proposed' assessments, and authorized the City Secre-
tary to affix the City's corporate seal thereto and attest the same; .,
and appropriated from unappropriated monies on hand and to the credit
or the City a sufficient sum of money to satisfy the maximum amounts
which it was estimated would become due to LEWIS AND LEWIS and to
FIRST OF TEXAS CORPORATION; and

WHEREAS, all errors, mistakes and other matters requir-
ing rectification, which were brought to the attention of the
City Council have been corrected; and
WHEREAS, said City Council is of the opinion and finds
that the proposed assessments as set out in the Engineer's esti-
mate and roll should be adjusted in those instances where the
proposed improvements will abut property which is zoned residen-
tial or non-commercial so that the maximum assessment per front
foot shall be at a rate no greater than $5.50 per front foot for
curb, gutter and paving, and so that the assessment against any
such lot which abuts any street sidewise for a distance of more
than 100 feet shall be adjusted in such a manner so that no such
lot shall be assessed at a rate greater than a residential lot
which fronts on such a street for 100 feet; and
WHEREAS, said City Council is also of the opinion and
finds that certain of the properties abutting Fairfax Avenue in
Unit 6 will not be enhanced in value to the extent of the proposed
assessments since the improvements on such properties do not face
on such street and that the assessments against such properties in
such unit should be at the rate of $2.75 per front foot; and

of special assessment, said City will exercise its powers to enforce
and collect said certificates by suit in its own name for the bene-
fit of said legal holder, but at his or its expense.
The assessments so levied above on each particular abut-
ting property are for such properties ' proportionate part of the
cost of said improvements in the particular unit in which the street
or avenue or portion thereof to be improved lies, upon which such b
property abuts, and the said improvements, and the assessment levied
therefor in any one unit are in no wise related to or connected with
the improvements or assessments in any other unit; and in levying
said assessments the amounts so assessed, and the validity of such
assessments in any one of said units shall in no wise be affected
by any fact or matter connected with the improvements or the assess-
ments therefor in any other unit; and the omission of part or all of
said improvements in any one unit shall in no wise affect or impair
the improvements in any other unit or the validity of the assessments
therefor in any other unit. Further, the omission of said improve-
ments in any particular unit in front of any parcel or parcels of
property, any interest in which is exempt from the lien of the assess-
ment, shall in no wise affect or impair the validity of the assess-
ments against the other properties abutting the street, avenue or por-
tion thereof in such unit.
Section 6
The Contractor shall not be compelled to construct street
improvements on that portion of any street or avenue immediately
abutting any property any interest in which was exempt at the time
the improvements were ordered, from the lien of special assessment
and against which the owners are not willing to fix a valid, volun-
tary mechanics ' lien, but the Contractor shall be permitted to omit
such improvements on any such street or avenue immediately abutting
any such exempt property (which improvements may be omitted to the
centerline of such streets). If, however, the owners of any such
exempt properties execute valid mechanics ' lien contracts, agreeing
to pay the property owners ' share of the cost of such improvements
and fixing a valid lien upon their properties to. secure such costs,
then such improvements shall be constructed by the Contractor on
the portion of the street or avenue abutting such property; provided
however that in any case where valid assessments may not be levied
against one or more parcels of exempt property, and the Contractor
is unable to obtain the execution of a valid mechanics ' lien con-
tract or contracts by the owners of said property for the payment of
the portion of the costs properly chargeable against such property,
or cash in advance, or the deposit in escrow, until the completion
and acceptance of such improvements by the City of such owners ' part
of such costs, then the entire unit in which such property is situ-
ated may be deleted from the contract, insofar as the street im-
provements are concerned, at the option of the City. In the event
such improvements are omitted abutting any particular properties,
the lien on such properties which was fixed by the filing of the
notices of the enactment of the aforementioned ordinances ordering
the street improvements shall be released.
Section 7
Upon completion and acceptance of such improvements in
each unit or group of units, as such improvements are accepted, as-
signable certificates of special assessment evidencing said respec-
tive sums payable by said owners of abutting property shall be
issued in the name of the City to the Contractor constructing such
improvements, or to its assigns, and shall be made payable to said
Contractor or its assigns, which assessment certificates shall be
signed by the Mayor and attested by the City Secretary with the
corporate seal, and shall have five (5) coupons which shall bear
the facsimile or actual signatures of the Mayor and City Secretary
and otherwise shall be in form consistent with these proceedings.
Any such facsimile signature may be either lithographed or printed.
Each certificate shall contain an adequate description of the re-
spective parcel of property assessed, together with the designation
of the owner or apparent owner, if known. Each such certificate
shall set forth and evidence the personal liability of the real and
true owner or owners of such property, whether correctly named
therein or not, and each such certificate shall set forth and
evidence the lien on the respective property described therein, and
shall evidence the fact that said lien is a first and paramount
lien thereon, superior to all other liens and claims except for
valid State, County, School District and City ad valorem taxes.
Each certificate shall be dated as of the date that the improvements
in the unit in which the street or avenue or portion thereof abutted
by the particular property therein described lies have been accepted.
by the City Council of the City of Fort Worth, and shall recite, in
substance, that the improvements abutting the property therein de-
scribed, and in the unit in which said street, avenue or portion
thereof abutted by such property lies, have been completed in full
compliance with the terms of the contract entered into between the
Contractor and the City of Fort Worth, and that said improvements
have been accepted by the City Council of the City of Fort Worth on
the date of said certificate. Each certificate shall provide for
acceleration of maturity at the option of any holder thereof upon
default in payment of any installment of principal or interest as
above set out; shall provide for reasonable attorneys ' fees and
costs of collection, if incurred; and shall contain such other terms
and provisions as are customarily contained in special assessment
certificates issued under the provisions of the Acts of the 40th
Legislature, First Called Session of the State of Texas, Page 489,
Chapter 106, as amended, commonly known and referred to as Article
11.05b, Revised Civil Statutes of Texas, 1925, as amended. No error
or mistake in describing any property, or in giving the name of any
owner or owners shall in anywise invalidate or impair the assess-
ments or any of them or any certificate issued in evidence thereof.
Each certificate shall provide in substance, among other things:
"That all the proceedings with reference to making
such Improvements have been regularly had in compliance
with the law and that all prerequisites to the fixing of
the assessment lien against the above described property
and the personal liability of the owner or owners thereof
have been performed, and this certificate shall be prima
facie evidence of the matters herein recited, and no fur-
ther proof thereof shall be required.
"That the sums of money evidenced hereby shall be
payable to the owner or owners of this certificate at
the office of the City Assessor and Collector in Fort
Worth, Tarrant County, Texas; provided however, that if
the place of payment has been varied by written agree-
ment between the Contractor, or the legal holder of this
certificate and the Owners of the above property, then
the provisions of such agreement shall control.
to exercise all of its lawful powers for the purpose of supplying
any deficiency in the proceedings with reference to such assessment
and to correct any mistake or irregularity in connection therewith,
and after notice and hearing, to levy a reassessment or reassess-
ments if it is necessary to do so in order to fix a valid lien upon
any property or properties abutting the streets or avenues or por-
tions thereof being improved and a personal liability on the owners
thereof for its and their just and proportionate part of the cost
of such improvements. No such reassessment against any abutting
property or the owner thereof shall be made in excess of the special
benefits of such property and the owners thereof in the enhanced
value thereof by means of such improvements, and in no event shall
more than the proportionate share of all of the cost of constructing
curbs and gutters and more than nine-tenths (9/10) of the remaining
cost of such improvements be reassessed against any such property
and its owners.
Section 11
All proceedings heretofore taken by the City Council of
the City of Fort Worth in connection with the street improvements
herein referred to and the assessments hereby levied are hereby
ratified and confirmed in all things, including the action of the
City Manager and the City Secretary in executing the contract with
the Contractor for the construction of such improvements, and in
executing the contract with the Fiscal Agent of the City.
Section 12
Should any section or sections or any part of any section
or sections of this ordinance be held to be void and without force
and effect for any reason whatsoever by any court of competent jur-
isdiction, the remaining portions of the ordinance shall not be
thereby affected, but they shall remain in force and effect as
though the void and unenforceable portion thereof, if any, had not
been incorporated`h4t rein.
Section 13
This ordinance shall take effect and be in full force
and effect from and after the date of its passage, and it is so
ordained.

WHEREAS, such adjustments have been made and are herein-
after reflected in this ordinance; NOW, THEREFORE:
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH:
Section 1
The City Council of the City of Fort Worth, Texas, hereby
finds and determines that the assessments herein levied and the per-
sonal liabilities hereby declared are just and equitable, and that
no assessment is made herein in any case against any parcel of prop-
erty abutting any street or avenue or portion thereof to be improved
in excess of the special benefits of such property and its owners in
the enhanced value thereof by means of such proposed improvements
and that all proceedings in connection with such improvements and
said assessments, including the contract for the construction of the
improvements, are in all respects regular and valid; and that the
assessments herein made against said properties abutting said streets,
avenues or portions thereof and the real and true owners thereof are
lawful, just and equitable; and in levying the same against the abut-
ting properties and the owners thereof, the City Council adopts the
apportionment set forth below and finds that the division of the
costs of said improvements between said abutting properties and the
real and true owners thereof is lawful, jurat and equitable and pro-
vides substantial equality considering the benefits to be received
and the burdens to be imposed thereby.
Section 2
There being no further protests or testimony for or against
or with reference to such improvements, benefits or proceedings, said
hearing as to all units of improvement is hereby closed, and all pro-
tests and objections, whether specifically mentioned in the minutes
of the hearing or not shall be and the same are hereby overruled and
denied.
Section 3
The respective itemized amounts hereinafter shown opposite
the name or names of the person or persons hereinafter listed and op-
posite the description of the parcel or parcels of property hereinaf-
ter listed, which parcels of property abut the hereinafter listed
streets or avenues or portions thereof of the City of Fort Worth,
shall be and the same are hereby assessed, levied and charged against
said respective properties hereinafter listed, and against the real
and true owners of such respective properties, whether the real and
true owners of such properties are correctly named below or not.
Each such street or avenue or portion thereof of the City of Fort
Worth which constitutes a unit of improvement is described below and
there is shown the unit number given to each such unit. Each lot or
parcel of property abutting on each such street or avenue or portion
thereof is hereunder described whenever practicable by the Block
number, if any, and by the Lot number of each such Block wherein
such lot lies, and by the Addition or Subdivision, if any, wherein
such lot in such block lies, in the City of Fort Worth, Tarrant
County, Texas, as shown by the plats on file in the Office of the
Assessor and Collector of Taxes of the City of Fort Worth and by the
Flat and Deed Records of the County Clerk of Tarrant County, Texas,
and by also referring to the units of improvement in which the
streets or avenues to be improved (which are abutted by .said respec-
tive properties ) are situated; and the frontage of each of said lots
or parcels of abutting property on the streets and avenues or por-
tions thereof of the City of Fort Worth to be improved is shown
hereunder in feet in the column headed "Frontage" and each such
description and assessment shall be held to extend back from the
property line abutting on said street or avenue or portion
thereof to be improved, and to include the entire depth and area
of each such respective parcel, lot or lots of abutting property
as same were owned and bounded on the date the improvements were
ordered by ordinances and notices of the enactment thereof filed
with the County Clerk of Tarrant County, Texas.

"That by the provisions of the proceedings of the
City Council of the City of Fort Worth and the law in
force, under which said proceedings were had, upon de-
fault in the payment of any installment of principal or
interest hereon when due and/or at maturity of this
certificate, however same may occur, the assessment
lien against the property herein described and the
personal liability and charge of the real and true
owner or owners thereof (whether correctly named
herein or not) may be enforced in accordance with the
provisions of this certificate in any court having
jurisdiction, or at the option of the legal holder
hereof, by sale of said property in the same.manner
as may be provided by law in force in said City for
the sale of property for collection of ad valorem
taxes. The City of Fort Worth does not guarantee
collection of the assessment evidenced hereby; however,
said City will exercise and exhaust all of its lawful
powers in enforcing collection of said assessment.
"That said assessment was levied pursuant to
ordinances of the City of Fort Worth, Texas, as amended,
determining the necessity for and ordering the improve-
ment of certain streets and avenues or portions thereof
of said City, and upon procedure had and pursued in
conformity with the laws of the State of Texas; notices
of the enactment of said ordinances being recorded in
the Deed of Trust Records of Tarrant County, Texas in
Volume 1391, pages 570 to 573; Volume 1435, pages 434
to 450; Volume 1441, pages 625 to 631 and pages 633 to

ordinances being of record in the Deed of Trust Records

Section 8
Should more than one person own an interest in a parcel
of property on the date said improvements were ordered, such per-
son shall be liable for its, his or her interest in such property,
and its, his or her interest in such property may be released from
the lien created by said assessment upon payment of such propor-
tionate sum.
Section 9
All other matters and proceedings shall be regulated and
conducted as provided by law and full correction of any mistake or
irregularity in any of said proceedings, and reassessment, if neces-
sary, shall be made in any case where the holder of any assignable
certificate of special assessment shall request same; the City Coun-
cil of the City of Fort Worth reserving the right to exercise all
such powers as provided by the street improvement laws of the State
of Texas.
Section 10
The City of Fort Worth, Texas, shall not be liable for
the payment of any sums hereby assessed against any abutting prop-
erty and the real and true owners thereof, but the City shall be
obligated to furnish the Contractor, or its assigns, valid assess-
ments and assessment certificates, and shall exercise all of its
lawful powers to aid in the enforcement and collection of said liens
and assessments. In case, in the opinion of the attorneys of the
Contractor, any assessment shall for any reason whatsoever be inval-
id or unenforceable, then the City of Fort Worth shall be obligated
