AN ORDINANCE AMENDING SECTION 37-25(c), SECTION 37-25(d)
AND SECTION 37-26(a), OF CHAPTER 37 OF THE CODE OF THE
CITY OF FORT WORTH (1964) , AS AMENDED, BY REVISING CERTAIN
WASTEWATER RATES AND CHARGES; MAKING THIS ORDINANCE CUMU-
LATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES AND
PROVISIONS OF THE CODE OF THE CITY OF FORT WORTH IN CON-
FLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Section 3 7-25 (c ) of Chapter 3 7 of the Code of the City of
Fort Worth (1964), as amended, be and is hereby amended and, after
having been so amended, shall hereafter read and be as follows:
"(c) The following schedule of rates per month or
fraction thereof shall be the basis for determining
charges to all customers for rendering sanitary sewerage
service, where the sewage produced by such customer is a
normal strength wastewater (two hundred ten (210) mg/1
B.O.D. and two hundred forty (240) mg/1 suspended solids)
and where such customer is located within the city:
"RATES FOR SEWERAGE SERVICE ONLY
"(1) A monthly service charge shall be charged
to all customers in the amount of three dollars
and thirty-five cents ($3.35).
"(2) A monthly volume charge shall also be
charged to all customers in the amount of four
hundred Ninety-three thousandths of a dollar
($0.493) per one hundred (100) cubic feet of
water used, or wastewater produced, as more
specifically set forth hereinafter.
"The monthly volume charges for residential class
customers will be based on the individual customer's
average monthly water use during the preceding winter
quarter months of December, January and February, but in
no event shall the volume used to compute this monthly
charge exceed one thousand five hundred (1,500) cubic
feet. The volumes used to compute these charges are based
on the amount of water used by the residential class cus-
tomer as measured by a meter. Where no preceding winter
quarter average is available from records, the director
shall estimate a volume to be used for this monthly volume
charge, such estimated volume not to exceed one thousand
five hundred (1,500) cubic feet.
"The monthly charges to commercial and industrial
class customers will be based on total water use as meas-
ured by appropriate meters, with the provision that if a
customer can show, to the satisfaction of the director of
the waterworks department, that a significant portion of
the metered water usage does not enter the sanitary
sewers, the customer will be charged for only that volume
entering the sewers, as determined by a method approved by
the director."

SECTION 2.
That Section 37-25(d) of Chapter 37 of the Code of the City of
Fort Worth (1964), as amended, be and is hereby amended and, after
having been so amended, shall hereafter read and be as follows:
"(d) The director of the waterworks department shall
establish a monitored group class, consisting of those
customers whose wastewater strength is, in his judgment,
abnormally high or whose wastewater contains limited sub-
stances or materials, and charges to customers in this
class shall be computed in accord with the following five-
part rate schedule:
"MONITORED GROUP
Customer monthly service charge $3.35
Volume charge, per 100 cubic feet 0.319
B.O.D. strength charge, per pound 0.0757
of B.O.D.
Suspended solids strength charge, per 0.0496

"The monitoring charge shall consist of all cost for
personnel, material, and equipment used to collect and
analyze samples from the customer wastewater to determine
the strength of the wastewater produced, and when appro-
priate, to inspect pretreatment facilities, to administer
pretreatment permit systems and to enforce ordinance re-
quirements. Pretreatment requirements primarily affect in-
dustries which discharge toxic substances into the sewer-
age system.
"This schedule shall replace all other charges previ-
ously made for industrial waste strength."
SECTION 3.
That "Schedule B" of Section 37-26(a), Connection Charge, of
Chapter 37 of the Fort Worth City Code (1964), as amended, be and
the same is hereby amended and, after having been so amended,
"Schedule B" shall hereafter read and be as follows:

SECTION 4.

That this ordinance shall repeal every prior
vision of the Fort Worth City Code in conflict
insofar as any portion of such prior ordinance or
in conflict, and as to all other ordinances or
Fort Worth City Code not in direct conflict herew
shall be and is hereby made cumulative.

That all rights or remedies of the City of Fort Worth, Texas,
are expressly saved as to any and all violations of Chapter 37 or of
any amendments thereto, of the Fort Worth City Code (1964), as
amended, which have accrued at the time of the effective date of
this ordinance; and as to such accrued violations, the Court shall
have all of the powers that existed prior to the effective date of
this ordinance.
SECTION 6.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this Ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this Ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this Ordinance, since the same would have been enacted by the City
Council without the incorporation in this Ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 7.
That this Ordinance shall become effective and be in full force
and effect from and after its passage, provided, however, that the
increased rates specified herein shall apply to customer utility

1983, and it is so ordained.

a The costs of providing adequate wastewater collection and treatment operations are
increasing annually. In the case of wastewater treatment, the power costs and
federal requirements will require increased expense. The aging wastewater
collection system also requires more of the Water Department's resources annually.

*Debt Service for 1981-82 had adequate reserves, therefore, funds from operating
budget in the amount of $2,952,533 were used in replacement projects
It should be noted that some expenditures for replacing existing mains which are
in poor condition are to be paid directly from current revenues instead of
financing these replacements through revenue bond proceeds The decision to fund
replacement mains from revenues began in the 1982-83 year when retained earnings
totalling $3,000,000 were used for this purpose instead of financing these
projects with increasingly expensive long-term debt. This year, it is proposed
that the same amount be budgeted from current revenues to fund replacements on a
"pay-as-you-go" basis

The service rates consist of a monthly service charge, a monthly volume charge and
a schedule of minimum charges varying with the size of the water meter Monthly
wastewater charges for residential class customers will continue to be based on
the individual customer's average rate of water use during the preceeding winter
months of December, January and February, with the maximum monthly charge not to
exceed the charge for 1500 cubic feet
The residential class average winter use per customer over the past four years
is approximately 1,260 cubic feet (9,450 gallons) per month The residential
class average sewer volume related to the 1,260 cubic feet of water use is
approximately 745 cubic feet per month. The proposed rate increase would have
the following effect on the residential class average billing

There are industrial and commercial customers whose wastewater has
significantly high quantities of biochemical oxygen demand (BOD) and suspended
solids which are costly to treat. Several customers in these classes also must
be monitored to make certain that prohibited levels of certain pollutants do
not enter the wastewater system. In order to recover costs related to serving
these customers, the costs for monitoring and for treating abnormally
strengthened wastewaters are to be charged in accordance with the following
schedule

and enforce ordinance requirements as necessary for each customer

In order to continue serving customers of the wastewater system in Fort Worth with
a reliable operation protecting health and the environment, it is necessary that
the costs of service be recovered through operating revenues
Recommendations
It is recommended that
1. The retail and monitored ind ustrial waste service rates as outlined above be
approved as the rates to be charged all customers of the Fort Worth Water
Department, and,
2. The City Council adopt the attached Ordinance, including the rate schedules
outlined above, with an effec tive date of billing on and after October 1, 1983
