AN ORDINANCE AMENDING CHAPTER 33,"STREETS AND SIDEWALKS"
OF THE CODE OF THE CITY OF FORT WORTH (1964), AS AMENDED,
TO DESIGNATE EXISTING CATEGORIES OF SIDEWALK AND STREET
CONSTRUCTION CONTRACTORS AS "PARKWAY CONTRACTOR" AND
"STREET AND STORM DRAIN CONTRACTOR"; TO INCREASE LICENSE
FEES FOR SIDEWALK AND STREET CONSTRUCTION CONTRACTORS;
MAKING THIS ORDINANCE CUMULATIVE OF OTHER ORDINANCES AND
CODE PROVISIONS AND REPEALING ALL ORDINANCES AND CODE PRO-
VISIONS IN CONFLICT HEREWITH; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A PENALTY; PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Chapter 33 of the Code of the City of Fort Worth is
amended at Section 33-10, and hereafter the said Section 33-10 shall
read and be as follows:
"Sec. 33-10. Parkway contractor as construction of side-
walks, curbs, driveways, etc. - License and
permit required; bond, etc.
"A 'parkway contractor' is defined as a person or ,
firm of persons which lays, constructs, builds, repairs or
rebuilds any sidewalk, curb, gutter or driveway on any
street, alley or thoroughfare within the City of Fort
Worth. It shall be unlawful for any person or firm to per-
form the work of a parkway contractor, as defined in this
section, without first having obtained from the director
of public works a license to do such work, having made and
executed a bond to the city in the sum of twenty-five hun-
dred dollars ($2,500), without having obtained a parkway
contractor's license, the fee for which shall be three
hundred dollars ($300), and without having obtained a
permit from the director of public works to do such work.
The license provided for herein shall be renewed annually,
and the renewal fee shall be three hundred dollars
($300 00)."
SECTION 2.
That Chapter 33 of the Code of the City of Fort Worth is
amended at Section 33-13, and hereafter the said Section 33-13 shall
read and be as follows:
'"Sec. 33-13. Street and storm drain contractor for con-
struction, repair, etc., on streets, etc. -
license, bond and permit required.
"A 'street and storm drain contractor' is defined as
a person or firm of persons which lays, constructs,
builds, repairs, rebuilds, grades, gravels, paves, sur-
face, resurfaces or does any work in or upon any public
street, alley or thoroughfare within the City of Fort
Worth. It shall be unlawful for any person or firm to per-
form the work of a street and storm drain contractor, as
defined in this section, without first having obtained a

street and storm drain license, the fee for which shall be
three hundred dollars ($300), without having made and
executed a bond to the city in the sum of five thousand
dollars $5,000) and without having obtained a permit from
the director of public works to do the specific work con-
templated. The license provided for herein shall be re-
newed annually, and the renewal fee shall be three hundred
dollars ($300.00)."
SECTION 3.
That, should any portion, section or part of a section of
this Ordinance be declared invalid, inoperative or void for any
reason by a court of competent jurisdiction, such decision, opinion
or judgment shall in no way impair the remaining portions, sections
or parts of sections of this Ordinance, which said remaining provi-
sions shall be and remain in full force and effect.
SECTION 4.
That this Ordinance shall be cumulative of all other ordinances
and of the Code of the City of Fort Worth except in those instances
where the provisions of this Ordinance are in direct conflict with
such other ordinances and such Code, in which instances said con-
flicting provisions are hereby expressly repealed.
SECTION 5.
That any person, firm or corporation who violates, disobeys,
neglects or refuses to comply with or who resists the enforcement of
any of the provisions of this Ordinance shall be fined not more than
Two Hundred and No/100 Dollars ($200.00) for each offense. Each day
that a violation is permitted to exist shall constitute a separate
offense.
SECTION 6.
The City Secretary of the City of Fort Worth, Texas, is hereby
directed to publish the caption and penalty clause and effective
date of this ordinance for five (5) days in the official newspaper
of the City of Fort Worth, Texas, as authorized by TEX. REV. CIV.
STATS., Art. 1176b-1.

SECTION 7.
That this Ordinance shall take effect and be in full force and
effect from and after the date of its passage and publication, and
it is so ordained.
