AN ORDINANCE AMENDING SECTION 40-7(A) OF "DEPARTMENT OF
PUBLIC LIBRARIES," OF THE CODE OF THE CITY OF FORT WORTH
(1964), AS AMENDED, TO ALTER THE NUMBER OF MEMBERS OF THE
LIBRARY ADVISORY BOARD; ESTABLISHING A LIMIT TO TERMS OF
SERVICE OF BOARD MEMBERS; ESTABLISHING STAGGERED TERMS FOR
BOARD MEMBERS; MAKING THIS ORDINANCE CUMULATIVE OF ALL
PRIOR ORDINANCES AND CODE SECTIONS; REPEALING ALL ORDI-
NANCES AND CODE SECTIONS IN CONFLICT HEREWITH; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE DATE; ENGROS-
SING AND ENROLLING THIS ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Section 40-7(A) of Chapter 40 of the Code of the City of
Fort Worth be amended and that, thereafter, the said Section shall
read and be as follows:
"Sec. 40-7. Advisory Board
(A) Appointment; composition; term; compensation. The
City Council shall appoint an advisory board to act in an
advisory capacity to the City Council and the City Manager
in conjunction with the library department. The board
shall be composed of nine ( 9 ) citizens, who shall each be
appointed to Places 1 through 9. The terms of members
appointed to even numbered places shall expire October 1,
1984, and those appointed to odd numbered places shall
expire on October 1, 1983. Thereafter, members shall be
appointed for two-year terms. No member shall serve more
than three consecutive terms. Members shall serve without
compensation and shall be subject to removal at any time
by the City Council."
SECTION 2.
This ordinance shall repeal every prior ordinance and provi-
Sion of the Fort Worth City Code in conflict herewith but only inso-
far as any portion of such prior ordinance or provision shall be in
conflict, and as to all other ordinances or provisions of the Fort
rth City Code not in direct conflict herewith, this ordinance
shall be and is hereby made cumulative.
SECTION 3.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-

tional by the valid judgment or decree of any court of competent
jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4.
That the City Secretary of the City of Fort Worth is hereby
directed to engross and enroll this ordinance by copying the caption t
in the minutes of the City Council and by filing the ordinance in
the ordinance records of the City.
SECTION 5.
That this ordinance shall take effect and be in full force and
effect from and after its passage, and it is so ordained.

Backeround:
On March 15, 1983, the City Council approved Ordinance No. 8758, "Rules for
Boards and Commissions." That ordinance establishes nine membership places for
each City board, unless membership is governed by conflicting state law, City
Charter provision or Council exception. It also provides for two-year, staggered
terms for board members. The Library Advisory Board is currently composed of
thirteen members and does not have specific membership places or staggered
terms. The attached ordinance will incorporate the above provisions of Ordinance
No. 8758 for the Library Advisory Board. The ordinance also will provide that no
member shall serve more than three consecutive terms.
Recommendation:
It is recommended that the attached ordinance be adopted, amending City Code
Chapter 40, Section 40-7(A), "Advisory Board," establishing nine membership
places and staggered terms for members, limiting members' service to three con-
secutive terms, and maintaining the current two-year term for members.
