HomeMy WebLinkAboutOrdinance 22294-06-2016 ORDINANCE NO. 22294-06-2016 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PACS GAS LEASE CAPITAL PROJECT LEGACY FUND IN THE AMOUNT OF $20,888.00,FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING PARK IMPROVEMENTS AT HIGHLAND HILLS PARK; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2015-2016 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the PACS Gas Lease Capital Project Legacy Fund in the amount of$20,888.00, from available funds, for the purpose of funding park improvements at Highland Hills Park. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to appropriate $20,888.00 for park improvements at Highland Hills Park. On September 13, 2011 (M&C L-15241), the City Council authorized the execution of an Agreement with Barnett Gathering, LP (Barnett Gathering), to allow temporary workspace and ingress and egress access on a portion of Highland Hills Park in exchange for payment of a mitigation fee in the amount of $20,888.00. The funds generated from these mitigation fees are to be used in Highland Hills Park for park improvements in compliance with the Park and Recreation Park Facility Development Guidelines. In November of 2013, Park and Recreation Department (PARD) staff met with the Highland Hills community to discuss possible park improvements. It was determined that the community desired decorative benches or seating in front of the Highland Hills Community Center. The community provided Staff with examples of decorative benches that they desire, most being tile mosaic with various colors. PARD staff informed the community that they were unable to procure or fabricate such amenities, but that they would engage Fort Worth Public Art to determine if it might be interested in taking on such a project. Fort Worth Public Art agreed to manage the project and has included this project in their Fiscal Year 2016 Work Plan. In January of 2016, Fort Worth Public Art engaged a local artist from the Highland Hills Community, Sedrick Huckaby, to be the artist on the project. The PARD, Fort Worth Public Art and the community have agreed to allow Fort Worth Public Art to manage this project, utilizing available mitigation fees in the amount of$20,888.00, for the design and construction of decorative benches at Highland Hills Park. Highland Hills Park is located in COUNCIL DISTRICT 8. This M&C does not request approval of a contract with a business entity. FISCAL INFORMATION /CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendation, funds will be available in the current capital budget as appropriated of the PACS Gas Lease Capital Project Legacy Fund.
