ORDINANCE NO.-G-25L—A
AN ORDINANCE PERMITTING GEORGE LEMON, HIS HEIRS AND ASSIGNS,
TO LEAVE THE EXISTING BUILDING FOR A MAXIM[M DISTANCE OF FOUR AND
SEVEN TENTHS FEET AS IT IS NOW LOCATED IN THE ALLEY FOR SOME SEVEN-
TEEN AND NINE TENTHS FEET ALONG THE WEST LINE OF LOT 6 AND THE SOUTH
ONE-HALF OF LOT 5, BLOCK 7, SANGAMO PARK AEDITION TO THE CITY OF FORT
WORTH, TARRANT COUNTY, TEXAS; AND PROVIDING THAT THIS ORDINANCE SHALL
BECOME EFFECTIVE IMKEDLATELY.
WHEREAS, George Lemon is the owner of Lot 6 and the South one-half of Lot 5,
Block 7, Sangamo Park Addition to the City of Fort Worth, Tarrant County, Texas,
along the west side of which a property encroachment exists in the alley; NOW,
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That George Lemon, the owner of said land above described and the improve-
ments situated thereon, and his heirs and assigns, be permitted to leave the exist-
ing building for a maximum distance of four and seven tenths feet as said building
now exists in the alley for some 17.9 feet along the west 6; and
that said.,improvesments on said above-described real property be. allowed .to stand
during the life of said building as the same is- now constructed, provided, however,
that in the event such building be demolished or major alterations and repairs be
made to said building in the future, said building shall be reconstructed or re-
paired so as not to encroach in the alley and so as to be in compliance with the
then existing ordinances, rules and regulations of the City of Fort Worth, Texas.
It is not the intention of the City Council to adversely affect or diminish the
rights of the public in and to the property encroached upon by the existing building
in the event the City Council may determine to devote the property encroached upon
to public use.
SECTION 2.
That this ordinance shall take effect and be in full force and effect from
and after the date of its passage, and it is so ordained.

The Plat hereon is a true, correct and accurate representation of the property as deter-
mined by survey, the lines and dimensions of said property being as indicated by the Plat,
the size, location and type of buildirigs and improvements are as shown, all irnprov*ments
being within the boundaries of the property, except as shown, set back from the property
lines the distances indicated, and that the distance from the nearest intersecting street or
road is as shown on said Plat. There are no encroachments, conflicts, protrusions, or

In order to clear title necessary for sale of the property, the owner of
Lot 6, and the south one-half of Lot 5, Block 7, Sangamo Park Addition,
has requested that the City enact an ordinance permitting the encroachment
of a garage apartment at that location onto the alley right-of-way. The
property owner has provided a survey which shows that there is an encroach-
ment of 4.7 feet x 17.9 feet by the existing garage apartment.
The Public Works Department has investigated the request and has determined
that the location of the encroachment on the back of the subject lot does
not constitute a major interference with the public's rights. There are
no present plans for further use of this alley and, therefore, it would not be
adversely affected by granting the encroachment for the life of the existing
building.
It is recommended that an ordinance be adopted granting this 4.7 feet x 17.9
feet encroachment for the existing garage apartment building on Lot 6 and the
south one-half of Lot 5, Block 7, Sangamo Park Addition, for the remaining
life of the building, subject to revocation at any time the City Council
determines that the encroached land is needed for public purposes.
