HomeMy WebLinkAboutOrdinance 18043-04-2008Ordinance No. 18043-04-2008 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $346,170 SUBJECT TO THE RECEIPT OF THE GRANT FROM THE U.S. DEPARMTENT OF JUSTICE (DOJ), NATIONAL INSTITUTE OF JUSTICE (NIJ) FOR THE PURPOSE OF SOLVING COLD CASES WITH DNA; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2007- 2008 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $346,170, subject to the receipt of the grant from the Department of Justice (DOJ) National Institute of Justice (NIJ) for the purpose of solving cold cases with DNA. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize the City Manager to apply for and accept, if awarded, Grant Funds for Solving Cold Cases with DNA from the U.S. Department of Justice (DOJ), National Institute of Justice (NIJ) in the amount of $346,170.00; 2. Authorize the City Manager to enter into a contract with the U.S. Department of Justice, National Institute of Justice, in the amount not to exceed $346,170.00; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grant Fund by $346,170.00; and 4. Apply indirect costs at the rate of 18.09 percent, which is the most recently approved rate for this department. DISCUSSION: Currently the City of Fort Worth has 755 open cold cases that have the potential to be solved using DNA analysis. Although physical evidence was preserved and retained, the majority of unsolved homicides that occurred between 1966 and 1990 were not analyzed for the presence of biological evidence. However, by applying the advanced scientific methods within the field of DNA analysis, these cases may have the potential to produce a DNA profile. Advances in DNA technologies have substantially increased the successful DNA analysis of aged, degraded, or limited biological evidence. In addition, by utilizing newer methods, samples that were thought to be compromised or that previously generated inconclusive DNA results may now be successfully analyzed. Grant funds will be used to identify, review, and investigate violent crime cold cases that have the potential to be solved through DNA analysis and to locate and analyze biological evidence associated with these cases. Of the total requested amount, $157,651.00 has been budgeted to pay the salary and fringe benefits for one full-time grant-funded detective, as well as overtime and associated fringe benefits for one evidence Logname: 35NIJ/DNA08 Page 1 of 2 technician in the crime laboratory for the 18 month grant cycle; $160,000.00 has been budgeted to outsource biological samples for DNA analysis and profiling; and the remaining $28,519.00 has been budgeted for indirect costs in accordance with the City of Fort Worth's Indirect Cost Allocation Plan. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations,acceptance and receipt of the grant and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Grant Fund.
