HomeMy WebLinkAboutResolution 4652-06-2016 A Resolution NO. 4652-06-2016 REVISING PREVIOUSLY ADOPTED RESOLUTION NO. 4554-12-2015 GRANTING CONSENT TO THE CREATION OF FAR NORTH FORT WORTH MUNICIPAL UTILITY DISTRICT NO. 1 TO REMOVE PROPERTY IN DENTON COUNTY WHEREAS, on December 15, 2015,the City Council adopted Resolution No. 4554-12-2015 (M&C L-15844) granting consent to the creation of Far North Fort Worth Municipal Utility District No.l within the City's extraterritorial jurisdiction by Lackland Holdings, LLC ("Owners"); and WHEREAS, the Far North Municipal Utility District No. 1 ("District") as consented to by the City Council consisted of approximately 733.648 acres of land situated in Wise, Tarrant and Denton County, all being within the extraterritorial jurisdiction of the City; and WHEREAS, Owners are requesting to reduce the size of the District by approximately 14 acres so as to locate the District exclusively within Tarrant and Wise Counties; and WHEREAS, the revised boundaries of the District will consist of approximately 719.903 acres; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: That the boundaries of the Far North Fort Worth MUD No. 1 consists of 719.903 acres of land situated in Tarrant and Wise Counties as described in Exhibit A, attached hereto, within the City's extraterritorial jurisdiction and as specifically conditioned as Resolution 4554-12-2015. DISCUSSION: On December 15, 2015, City Council adopted Resolution No. 4554-12-2015 (M&C L-15844) granting consent to the creation of a 733.486 acre municipal utility district - proposed Far North Fort Worth MUD No. 1 (MUD). The City Council also approved City Secretary Contract No. 47559 between the City of Fort Worth and Lackland Holdings, LLC (Owner) for the creation of Far North Fort Worth MUD No. 1. The property is located east of U.S. Highway 81/U.S. Highway 287 and west of Sendera Ranch Boulevard. The City will be the retail water and sewer supplier to the MUD, who will pay outside City limit rates and all other applicable charges. The City will also be the wastewater service provider to the MUD, pending the Trinity River Authority's consent. The City and the Owner are negotiating an east-to-west arterial roadway that will provide adequate capacity for the proposed development. The MUD will be responsible for construction and maintenance of the arterial roadway. In accordance with Resolution No. 4554-12-2015, the City and the Owner are currently negotiating the Utility Agreement and the Development Agreement. The Owner submitted an application for the creation of the MUD to the Texas Commission on Environmental Quality (TCEQ) on April 18, 2016. TCEQ requested an affidavit from each County's appraisal district stating that the ownership as submitted concurs with their records. Wise and Tarrant Counties' appraisal districts issued the affidavit; however, Denton County's appraisal district did not have a record of the property in Denton County. According to the City records, the original boundaries include an approximate 14-acre parcel of land within Denton County. Denton County's records do not show this parcel of land as being within their boundaries. The Owner is proposing to revise the MUD's boundaries to exclude the parcel of land within Denton County, reducing the acreage from approximately 733 acres to approximately 719 acres. TCEQ requests confirmation from the City acknowledging that the land area associated with the original boundary survey will be reduced to 719 acres. Staff will send a letter of the City Council's consent to reduction in size of the MUD to TCEQ. The Petitioners hold fee simple title to the Property, as indicated by the certificates of ownership provided by the Tarrant Appraisal District and the Wise County Appraisal District. V. The Petitioners represent that there are no lienholders on the Property. VI. The general nature of the work proposed to be done by the District at the present time is the purchase, construction, acquisition, maintenance and operation of a waterworks and sanitary sewer system for commercial and residential purposes,and the construction, acquisition, improvement, extension, maintenance and operation of works, improvements, facilities, plants, equipment and appliances helpful or necessary to provide more adequate drainage for the District, and to control, abate and amend local storm waters or other harmful excesses of waters, and road facilities, all as more particularly described in an engineer's report filed simultaneously with the filing of this petition, to which reference is hereby made for more detailed description, and such other purchase, construction, acquisition, improvement, maintenance and operation of such additional facilities, systems, plants and enterprises, as shall be consistent with all of the purposes for which the District is created (the"Project"). VII. There is a necessity for the improvements above described. The territory to be included in said proposed District will be developed for commercial and residential purposes. There is not available within the area proposed to be included in the District an adequate waterworks system, sanitary sewer system, drainage and storm sewer system, or road facilities,and the health and welfare of the present and future inhabitants of the District and of the areas adjacent thereto require the purchase, construction, acquisition, maintenance and operation of an adequate waterworks system, sanitary sewer system, and drainage and storm sewer system, and road facilities. VIII. The proposed improvements are feasible and practicable. There is an ample supply of water available, and the terrain of the territory to be included in the proposed District is such that a waterworks system, a sanitary sewer system, drainage and storm sewer system, and road facilities can be constructed at a reasonable cost. 16 06-07 FN FW MUD Petition 060616 -2- IX. A preliminary investigation has been made to determine the cost of the water, sewer and drainage facilities of the Project and it is now estimated by the Petitioners, from such information as they have at this time, that the cost of the water, sewer and drainage facilities of the Project will be approximately $43,945,000. X. There is not available within the area proposed to be included in the District adequate road facilities, and the health and welfare of the present and future inhabitants of the District and of the areas adjacent thereto require the purchase, construction, acquisition, maintenance and operation of adequate road facilities. The proposed improvements are feasible and practicable, and can be constructed at a reasonable cost. XI. A preliminary investigation has been made to determine the cost of the road facilities of the Project and it is now estimated by the Petitioners, from such information as they have at this time, that the cost of the road facilities of the Project will be approximately $12,470,000. XII. The total cost of the proposed District's projects is estimated by the Petitioners to be approximately$56,415,000. WHEREFORE, the Petitioners respectfully pray that this petition be properly filed, as provided by law;that all interested persons be notified of the procedures for requesting a public hearing on this petition as required by 30 Tex. Admin.
