' `i sECRETAW ''ONTRACT NO 14 AMENDMENT No . 1 G CC�CtSOP EfAR TO CITY SECRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and Freese & Nichols, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 46258, (the CONTRACT) which was authorized by M&C C-27124 on the 9th day of December, 2014 in the amount of $1, 650,000 . 00; and WHEREAS, the CONTRACT involves engineering services for the following project: Northside II 48-inch Water Main, Phase II from Heritage Trace Parkway to Longhorn Road; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated February 08, 2016 a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $180,593 . 00 . 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $1, 830,593 . 00 OFFICIAL RECORD CITY SECRETARY Page -1- FT,WORTH,TX 3 . Dear Mr.Sauceda: Per the City's request we propose the following scope and fee for additional services as part of the Northside II Transmission Main.These services included design pavement replacement of 1.5 mile segment of Old Decatur Road,an archaeological survey,and the design of re-alignment through the Williamson Dickie's Property. As part of an agreement with the City of Saginaw,a 1.5 mile segment of Old Decatur Road from McLeroy Boulevard to Bailey Boswell Road will be removed and reconstructed to allow the City of Fort Worth to Install the new 48"water line along Old Decatur Road through Saginaw.The roadway construction will be included In the construction package for the water line construction. Attached is the scope and fee for this design of Old Decatur Road. FNI is proposing an Archaeological Survey for the stream crossings at and near Big Fossil Creek. The Texas Historical Commission requested that an Archaeological Survey be done for the project in the attached letter dated June 3, 2015. FNI's sub-consultant AR Consultants, Inc.will perform the Archaeological Survey. The alignment for Heritage Trace Parkway was adjusted from the previous Master Thoroughfare Plan (MTP)in the meeting on December 2,2014.FNI designed the water line along the new alignment for Heritage Trace Parkway.On January 12,2016 Williamson-Dickie asked if the alignment for the water main and future Heritage Trace Parkway could be adjusted to the south to follow the previous MTP. Attached is the scope and fee to survey and design the re-alignment to follow the previous MTP. A summary of the additional costs are shown in the table below. DISCUSSION: On December 9, 2014, (M&C C-27124) the City Council authorized an engineering agreement with Freese & Nichols, Inc., in the amount of$1,650,000.00 for Engineering and Design Services for Northside 1148- Inch Water Main, Phase II from Heritage Trace Parkway to Longhorn Road. Amendment No. 1 will provide for the following: . Design for the reconstruction of Old Decatur Road from McLeroy Boulevard to Bailey Boswell Road. . Additional coordination with Oncor Electric, City of Saginaw, Texas Department of Transportation and other Franchise Utilities. . Additional service during construction. . Additional traffic control plans. Freese and Nichols, Inc., proposes to provide the additional services for a lump sum fee of$180,593.00. In addition to the amendment amount, $63,000.00 is required for project management, utility coordination, and inspection. This project will have no impact on the Water Department's operating budget. This project is anticipated to be included in a future revenue bond issue for the Water and Sewer Fund. Available cash within the Water and Sewer portfolio and the City's portfolio along with the appropriation authority authorized under the Direct Purchase Note (DPN) Program will be used to provide interim financing for this project until debt is issued. To the extent resources other than the Water and Sewer portfolio are used to provide interim financing, the Water and Sewer Fund will be charged interest that is Logname: 60NSII48WPH2A1-FNI Page I of 3 equivalent to the overall rate of return being earned by the City portfolio (currently approximately one percent annually). Should the City's portfolio not support the liquidity needed to provide an interim short- term financing source, another funding source will be required, which could mean issuance of securities under the DPN Program or earlier issuance of Water and Sewer revenue bonds than is currently planned. Once debt associated with this project is sold, bond proceeds will be used to reimburse the Water and Sewer portfolio and the City's portfolio in accordance with the Reimbursement Resolution for the entire Northside II 48-inch Water Main, Phase II Improvement Project that is on today's agenda. The City Council adopted the Water Department's Fiscal Year 2016-2020 Five-Year Capital Improvement Plan on February 2, 2016 (M&C G-18662). This City Council adopted plan includes this specific project, with funding identified through the DPN program to be reimbursed with future revenue bonds. In accordance with the provisions of the Financial Management Policy Statements, Staff anticipates presenting revenue supported debt issuances to the City Council for consideration within the next three years. This debt must be issued within approximately three years to provide reimbursement for these expenses. If that does not occur, the costs will no longer be reimbursable by issuing tax-exempt debt and the funding source will have to be made whole through other budgetary methods. The adopted resolution does not obligate the City to sell bonds, but preserves the ability to reimburse the City from tax-exempt bond proceeds. M/WBE OFFICE: Freese & Nichols, Inc., is in compliance with the City's BDE Ordinance by committing to five percent SBE participation on this Amendment No. 1. The City's goal on this Amendment is five percent. This project is located in COUNCIL DISTRICTS 2 and 7.
