ORDINANCE NO . 7 ~"`
AN ORDINANCE AMENDING ORDINANCE NO. 8140 WHICH ADOPTED THE
UNIFORM PLUMBING CODE, AS AMENDED, BY AMENDING SECTION 2.1
REGARDING REQUIRED EXPERIENCE FOR MEMBERS OF THE BOARD OF
PLUMBERS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULA-
TIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A PENALTY
CLAUSE; PROVIDING A SAVINGS CLAUSE; AUTHORIZING THE CITY
SECRETARY TO PUBLISH 'THIS ORDINANCE IN PAMPHLET FORM; PRO-
VIDING FOR ENGROSSMENT AND ENROLLMENT OF THE CAPTION AND
PENALTY CLAUSE; PROVIDING FOR PUBLICATION AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Ordinance No. 8140, as amended, be hereby amended by
amending Section 2.1, "Board of Plumbers - Created: Composition:
Appointment of Members: Filling Vacancies: Compensation", by revis-
ing the required experience for members in Place No. 3 and Place
No. 4, and following such amendment, Section 2.1 shall read as fol-
lows:
"Section 2.1. Board of. Plumbers: Created: Composition:
Appointment of Members: Filling Vacancies:
Composition
There is hereby created and established a Board of
Plumbers. The Board of Plumbers shall consist of nine mem-
bers and four ex-officio members as follows:
Place #1. A Master Plumber licensed by the .State of Texas
and having ten years of active continuous exper-
ience in the plumbing field.
Place #2. A Master Plumber licensed by the State of Texas
and having ten years of active continuous exper-
ience in the plumbing field.
Place #3. A Journeyman Plumber licensed by the State of
Texas and having five years of active continuous
experience in the plumbing field.
Place #4. A Journeyman Plumber licensed by the State of
Texas and having five years of active continuous
experience in the plumbing field.
Place #5. A Mechanical Contractor whose firm is licensed
by the City of Fort Worth.
Place #6. A Mechanical Engineer licensed by the State of
Texas and who regularly designs plumbing instal-
lations.
Place #7. A Landscape Irrigator licensed by the State of
Texas.
Place #8. A citizen who is not connected with the cons-
truction industry in any way.
Place #9. A citizen who is not connected with the con-
struction industry in any way.
The City Sanitary Engineer, the Director of the Water
Department or his authorized representative, the
Supervisor of Plumbing Inspection, and the Building
Official shall serve as ex-officio members. As ex-officio
members they shall have the right to make and second
motions but shall not have the power to vote.. The
Supervisor of Plumbing Inspection shall serve as Secretary
to the Board.
The nine members shall be appointed by the City
Manager with the advice and consent o.f the City Council.
Should any one of the .nine members of the Bard of Plumbers
die, become unable to act for any reason, resign from his
respective position, or be removed for any cause, as here-
inafter provided, the City Manager shall appoint a succes-
sor to fill the unexpired term or to serve until a new
member shall be duly appointed. A1.1 members of the board
shall serve the City without any compensation. Members
shall not serve more than three (3) consecutive two-year
(2) terms."
SECTION 2.
That this ordinance shall be cumulative of all provisions of
Ordinance No. 8140, as amended, and any other ordinances and the
Code of the City of Fort Worth, and all prior ordinances and City
Code sections in conflict herewith are hereby repealed but only
insofar as such ordinances and code sections are in conflict with
the provisions of this ordinance.
SECTION 3.
That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and
phrases of this ordinance are severable, and, if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared
void, ineffective or unconstitutional by the valid judgment or final
decree of a court of competent jurisdiction, such voidness., ineffec-
tiveness or unconstitutionality shall not affect any of the remain-
ing phrases, clauses, sentences, paragraphs and sections of this
ordinance since the same would have been enacted by the City Council
without the incorporation herein of any such void, ineffective or
unconstitutional phrase, clause, sentence, paragraph or section.

SECTION 4.
That, prior to September 1, 1983, any person who violates, dis-
obeys, omits, neglects or refuses to comply with or who resists the
enforcement of any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor, and each such person shall be guilty
of a separate offense for each day or portion thereof during which
any violation of any of the provisions of this ordinance is com-
mitted, continued or permitted, and each violation shall be punish-
able by a fine not to exceed $200.00. Effective September 1, 1983,
any person who violates, disobeys, omits, neglects or refuses to
comply with or who resists the enforcement of any of the provisions
of this ordinance shall be deemed guilty of a misdemeanor, and each
such person shall be guilty of a separate offense for each day or
portion thereof during which any violation of any of the provisions
of this ordinance is committed, continued or permitted, and each
violation shall be punishable by a fine not to exceed $1,000.00.
SECTION 5.
That all rights and remedies of the City of Fort Worth, Texas,
are expressly saved as to any and all violations of the provisions
of Ordinance No. 8140, as amended, or any other ordinance affecting
plumbing which have accrued at the time of the effective. date of
this ordinance; and, as to such accrued violations and all pending
litigation, both civil and criminal, whether pending in court or
not, under such ordinances, same shall not be affected by this ordi-
nance but may be prosecuted until final disposition by the courts.
SECTION 6.
That the City Secretary of the City of Fort Worth, Texas, is
hereby authorized to publish this ordinance in pamphlet form for
general distribution among the public, and the operative provisions
of this ordinance as so published shall be admissible in evidence in
all courts without further proof than the production thereof, as
provided in Chapter XXV, Section 3, of the Charter of the City of
Fort Worth, Texas.

SECTION 7.
That the City Secretary of the City of Fort Worth, Texas, is
hereby directed to engross and enroll this ordinance by copying the
caption and penalty clause of same in the minutes of the City
Council of the City of Fort Worth, Texas, and by filing the ordi-
nance in the ordinance records of said City.
SECTION 8.
That the City Secretary of the City of Fort Worth, Texas, is
hereby directed to publish the caption, penalty clause and effective
date of this ordinance for five (5) days in the official newspaper
of the City of Fort Worth, Texas, as authorized by Art. 1176b-1,
Revised Civil Statutes of Texas.
SECTION 9.
That this ordinance shall be in full force and effect from and
after the date ofFits passage and publication as required by law,
and it is so ordained.

he Plumbing Code of the City of Fort Worth (Ordinance No. 8140, as amended)
provides for the creation of a Board of Plumbers for the purpose of reviewing
nd interpreting the Plumbing Code, hearing appeals from decisions of the Chief
Plumbing Official and Building Official, and otherwise implementing the terms of
the Plumbing Code. The Board consists of nine (9) members with varying degrees
f experience and licensing qualifications. The Plumbing Code currently requires
that two members of the Board be licensed Journeyman Plumbers with at least ten
ears experience. Because of this experience requirement, many qualified
Journeyman Plumbers have been excluded from serving on the Board.
